Is Nanchong Wanmei International Plaza an unfinished building?
Hey, how to say it! In fact, this is also the most puzzling and distressing point in my heart. In 2020, the advertisement of Wanmei International Plaza in Nanchong City was overwhelming, and the swearing-in meeting was held. Banners that have settled in businesses are hung all over the external walls of the whole shopping mall, claiming that it is a prime location and 80% of the shops have settled in. Now it is being renovated and will be officially opened to the public at the end of this year1February, so I bought the shop here in full and signed a house purchase contract. And a management agreement, the purchase contract is voluminous and it is impossible to read it in a short time. The contract says that the house will be delivered this year1February 2 1 day, so I ask for an additional clause. The clause states that if the house is delivered 90 working days overdue, I have the right to cancel the house purchase contract and ask the other party to refund the house purchase price, and then I signed it. However, I didn't notify the closing of the house until the end of March this year. I also went to their office for consultation many times, but there was no positive answer. So I asked to cancel the purchase contract. Their reply to me was that it was 90 working days overdue, not 90 days. I refused to cancel and went home and waited. However, a week later, they sent a letter saying that it had been entrusted to its Ministry of Commerce in last year1February. Only then did we find that the management agreement was completely hegemonic, and only then did we know that the Ministry of Commerce was a developer, and there was no third party or even a second party. They have the right to decide all the delivery and use of the store by themselves. As for the delivery time, acceptance criteria, etc., there is no need to inform the owner of the house. But I went to the inside of the building and looked at it, which was completely inconsistent with its propaganda. Merchants settled in 80%. In fact, there are no businesses, and the decoration has stopped. The five floors of the whole shopping mall are empty, and no shop is open, not even a shop is being renovated. Actually, the elevator shaft was not installed, leaving a hole leading to the fifth floor, so I sorted out their promotional materials and pictures, and planned to sue the developer for false propaganda to induce me to buy a property that was seriously inconsistent with the facts, and asked the other party to refund the purchase price, and took the original contract and information to the local lawyer. Guess what, lawyers say that developers are most afraid of lawsuits, and there are only a handful of successful real estate rights protection in China. Just tell me directly. What should I do? I know it's unreasonable, but I just can't do anything about the developer. Nanchong's uncompleted residential flats rank high in Sichuan, but they just can't be solved. Developers are fearless.
