Regulations of Beijing Municipality on Property Management
The term "property management" as mentioned in these Regulations refers to the activities of the owners to maintain, conserve and manage the buildings, structures and their supporting facilities, equipment and related sites within the property management area through self-management or entrusting property service providers to make joint decisions, and to maintain environmental sanitation and related order. Property service providers include property service enterprises, professional units and other property managers. Article 3 Property management in this Municipality shall be incorporated into the community governance system, and adhere to the working pattern of Party committee leadership, government leadership, residents' autonomy, multi-party participation, consultation and co-construction, and scientific and technological support. Establish and improve the governance structure under the leadership of community party organizations, with the participation of residents' committees, villagers' committees, owners' committees or property management committees, owners and property service providers.
Promote the establishment of party organizations by property service enterprises, owners' committees and property management committees, and give play to the leading role of party building. Article 4 Relevant entities of property management shall abide by the market rules of property services that are consistent in power and responsibility, consistent in quality and price, fair and open, maintain the market order of enjoying property services and paying fees according to law, and optimize the market environment.
Support social capital to participate in the comprehensive improvement and property management of old communities. Article 5 This Municipality supports the establishment of the owners' meeting in the property management area, the election of the owners' committee, and the decision on major issues in the property management area and related matters concerning the use and management of some properties. Sixth city housing and urban and rural construction departments shall perform the following duties:
(a) to formulate policies related to property management in this Municipality and organize their implementation;
(two) to guide and supervise the district housing and urban and rural construction or the housing authorities to carry out the supervision and management of property management;
(three) to guide and supervise the collection, management and use of special residential maintenance funds in this Municipality;
(four) to establish and improve the training system for members of the owners' committee and the property management committee;
(five) to formulate temporary management regulations, management regulations, rules of procedure of the owners' congress, property service contracts and other model texts and related standards;
(six) the establishment of a unified property management credit information, owners of electronic decision-making and other information systems;
(seven) to guide industry associations to formulate and implement self-discipline norms;
(eight) to perform other duties of supervision and management of property management.
District housing and urban and rural construction or housing authorities shall perform the following duties:
(a) the implementation of property management policies and systems;
(two) supervision and management of the property service enterprises and employees within their respective jurisdictions;
(three) to guide and supervise the collection, management and use of residential special maintenance funds within the jurisdiction;
(four) to organize the training of members of the owners' committee and the property management committee within their respective jurisdictions;
(five) to guide the street offices and Township People's governments to implement property management related work;
(six) to perform other duties of supervision and management of property management.

Article 7 The District People's Government shall strengthen the organization and leadership of property management within its jurisdiction, establish a comprehensive coordination mechanism for property management, organize sub-district offices, township people's governments, housing and urban and rural construction or housing authorities and relevant departments and units within its jurisdiction, make overall plans to promote property management within its jurisdiction, and coordinate and solve major problems in property management within its jurisdiction. Article 8 Sub-district offices and township people's governments shall organize, coordinate and guide the establishment of the owners' congress and the election of the owners' committee and the establishment of the property management committee within their respective jurisdictions, and handle relevant filing procedures; To guide and supervise the owners' congress, the owners' committee and the property management committee to perform their duties according to law, and have the right to revoke their decisions that violate laws, regulations and rules; Participate in property inspection, guide and supervise the handover of property management projects within the jurisdiction, guide and coordinate property service providers to perform their obligations according to law, mediate property management disputes, and make overall coordination, supervision and management of property management activities within the jurisdiction.
Residents' committees and villagers' committees carry out specific work under the guidance of sub-district offices and township people's governments, and establish a consultation and governance mechanism for property management under the guidance of party building; Have the right to inquire about the property management matters reflected by the owners to the owners' congress and the owners' committee, and guide the standardized operation; Guide and supervise property service providers to perform their obligations according to law and mediate property management disputes. Article 9 Sub-district offices and Township People's governments shall exercise the power of administrative law enforcement according to the list of administrative law enforcement matters determined by the Municipal People's Government, establish a comprehensive law enforcement mechanism, and strengthen the inspection, inspection and handling of illegal acts in residential areas. Tenth during the emergency response, the subdistrict office and the Township People's Government shall be responsible for implementing the emergency measures taken by the Municipal People's Government according to law; Guide the property service personnel to carry out the corresponding level of response work, and give material and financial support.
Property service providers should obey the unified command of the government as required, actively cooperate with the work of residents' committees and villagers' committees under the guidance of neighborhood offices and township people's governments, and implement emergency plans and emergency measures according to law.
