The community maintenance fund can be used under the following circumstances: after the warranty period expires, the maintenance fund can only be used when the public parts of the property, facilities and equipment are overhauled, updated and transformed. The property management company can temporarily borrow the reserve fund equivalent to one month's daily maintenance and update cost of the property from the maintenance fund; Unless otherwise agreed in the property management service contract.

I. The procedures for applying for special housing maintenance funds are as follows:

1, make a plan. The applicant shall formulate a maintenance, renewal and transformation plan;

2. The owner confirms. The applicant applies to the district housing security and real estate management bureau with the maintenance, renewal and transformation plan. If the application materials meet the requirements, the applicant will send the written confirmation list of the maintenance, renewal and transformation scheme to the owner for confirmation;

3. Publicity of the plan. The application materials shall be publicized in the community for 7 days after the proprietary part accounts for more than two-thirds of the total construction area and accounts for more than two-thirds of the total number of owners within the scope of residential special maintenance funds;

4. At the expiration of the publicity period, if the owners have no objection or the number of objections does not exceed one-third of the total construction area and one-third of the total number of owners, the municipal residential special maintenance fund management center will notify the special bank to allocate funds. Apply for maintenance funds before construction, first allocate 30% of the approved amount, and the balance will be allocated after completion and acceptance. If it is completed before the application, the approved amount will be allocated in one lump sum.

Two, the following circumstances can apply for emergency use of housing maintenance funds:

1. There are potential safety hazards or faults in the facilities and equipment of the elevator system, and the elevator quality supervision department or testing organization explicitly requests emergency maintenance or replacement of parts or the community neighborhood committee issues the on-site confirmation certificate;

2, fire protection system facilities and equipment safety hazards or failure, the public security fire control institutions or police stations issued a rectification notice, it is really necessary to emergency maintenance or rectification or community neighborhood committees issued on-site confirmation certificate;

3, water supply and drainage system facilities and equipment safety hazards or failures, resulting in a large area of water supply or overflow, etc. , by the local village (neighborhood) committee sent with some beneficial owners on-site confirmation and issue a written certificate.

Legal basis: Article 6 of the Measures for the Administration of Residential Special Maintenance Funds The owners of the following properties shall deposit residential special maintenance funds in accordance with the provisions of these Measures:

(a) residence, except that it is jointly owned by the owners and does not use parts and facilities with other properties;

(2) Non-residential buildings in residential quarters or non-residential buildings connected with single residential structures outside residential quarters.

If the property listed in the preceding paragraph belongs to the sale of public housing, the selling unit shall deposit special housing maintenance funds in accordance with the provisions of these measures.
