Regulations of Gansu Province on the Management of Rural Domestic Waste

Chapter I General Provisions Article 1 In order to strengthen and standardize the management of rural domestic garbage, protect and improve the rural living environment, and promote the construction of beautiful and livable villages and ecological civilization, these Regulations are formulated in accordance with the provisions of the Law of People's Republic of China (PRC) on the Prevention and Control of Environmental Pollution by Solid Wastes and other laws and administrative regulations, combined with the actual situation of this province. Article 2 These Regulations shall apply to the cleaning, classification, delivery, collection, transportation, treatment, supervision and management of rural domestic garbage within the administrative area of this province. Where there are provisions in laws and administrative regulations or otherwise, those provisions shall prevail.

The term "domestic waste" as mentioned in these Regulations refers to the solid waste generated in daily life or activities providing services for daily life, and the solid waste regarded as domestic waste according to laws and administrative regulations. Article 3 The management of rural domestic waste shall adhere to the principles of government leading, public participation, local conditions, long-term, comprehensive utilization and overall promotion. Article 4 The people's governments at or above the county level shall strengthen the organization and leadership over the management of rural domestic waste, incorporate the management of rural domestic waste into the national economic and social development plan, determine the management objectives of rural domestic waste, coordinate the planning and layout of facilities, formulate policies and measures to promote the reduction, recycling and harmlessness of rural domestic waste, and increase the capital investment required for the management of rural domestic waste.

The people's government at the county level is the main body responsible for the management of rural domestic waste.

Township people's governments shall cooperate with the daily management of rural domestic garbage within their respective jurisdictions. Fifth provincial people's government housing and urban and rural construction administrative departments and city (state), county (city, district) people's government environmental sanitation administrative departments responsible for the supervision and management of rural domestic garbage cleaning, collection, transportation and disposal. Article 6 The competent administrative department of environmental protection of the people's governments at or above the county level shall exercise unified supervision and management over the prevention and control of environmental pollution caused by rural domestic garbage.

The people's governments at or above the county level shall be responsible for development and reform, finance, agriculture and animal husbandry, commerce, health and family planning, land and resources, transportation, water conservancy, forestry, tourism and other relevant administrative departments. , should do a good job in the management of rural domestic waste in accordance with their respective responsibilities. Article 7 The villagers' committee shall, by making village rules and regulations, sign letters of responsibility, etc., carry out the cleaning and classified delivery of rural domestic garbage, and urge the units and individuals in the village to do a good job in cleaning the village. Eighth people's governments at all levels should strengthen the publicity and education of rural domestic waste management, advocate a green, civilized and healthy lifestyle, cultivate demonstration models, and commend and reward civilized farmers, healthy families, beautiful courtyards and beautiful countryside demonstration villages.

Radio and television, newspapers and magazines, the Internet and other news media should strengthen the public welfare propaganda of rural domestic waste management.

The villagers' committee shall make use of such carriers as the village broadcasting room, cultural activity room, moral lecture hall, blackboard newspaper and village affairs public column. And take the form that the villagers like to hear and hear, publicize the knowledge of garbage classification, environmental protection obligations, advanced typical deeds, etc.

Rural primary and secondary schools and kindergartens shall, according to the characteristics of minors, regularly carry out education and practice activities on health knowledge and garbage reduction and classification knowledge. Chapter II Planning Compilation and Facilities Construction Chapter II Planning Compilation and Facilities Construction Article 9 The people's governments at or above the county level shall formulate special plans or implementation plans for the treatment of rural domestic waste within their respective administrative areas, and link them with the plans for improving rural living environment and rural environmental improvement.

When making a plan or an implementation plan, the opinions of relevant departments, deputies to the National People's Congress, members of the CPPCC, experts and scholars and the public shall be solicited. Tenth city (state), county (city, district) people's government is responsible for the construction of rural domestic waste collection, transportation and treatment facilities and places within their respective administrative areas.

No unit or individual may damage, dismantle, stop using, occupy, relocate or rebuild rural domestic garbage collection, transportation and treatment facilities, equipment and places. Article 11 The site selection of rural domestic waste disposal sites shall conform to the overall planning of villages and towns, the professional planning of environmental sanitation, the pollution control standards for domestic waste landfills, the pollution control standards for domestic waste incineration and other regulations and requirements. City (state) and county (city, district) people's governments shall make overall arrangements, and the site selection shall not be in the following areas:

(a) close to the water source;

(two) basic farmland protection areas, nature reserves, cultural relics protection areas and scenic spots;

(three) other areas that need special protection. Chapter III Cleaning, Classification and Delivery Article 12 The system of responsible person shall be implemented for cleaning and cleaning rural domestic garbage.

Villagers or users are responsible for the garbage in front of and behind villagers' houses.

Garbage in villagers' residential areas is managed by property enterprises, and property service enterprises are responsible persons; Without the implementation of property enterprise management, the villagers' committee shall be responsible for it.

The village committee is responsible for the garbage in public areas and buildings such as roads, rivers, canals and cultural squares in the village.

The responsible person shall be responsible for the garbage in the offices of organs, enterprises, institutions, social organizations and other organizations.

The garbage in bazaars, exhibitions, shopping malls, shops, catering services and other business places shall be the responsible person.

The landowner is responsible for the garbage in the field.

If the person responsible for garbage management is not clear, the villagers' committee or the township people's government shall designate the person responsible.
