Chapter I General Provisions Article 1 In order to standardize the payment, use and management of property maintenance funds and the allocation, use and management of property management houses, safeguard the legitimate rights and interests of owners and users, and promote the healthy development of property management, these Measures are formulated in accordance with the provisions of the Regulations of the State Council Municipality on Property Management and the Regulations of Hangzhou Municipality on Property Management, combined with the actual situation of this Municipality. Article 2 These Measures shall apply to the payment, use and management of property maintenance funds and the allocation, use and management of property management houses within the urban area of Hangzhou (excluding Xiaoshan District and Yuhang District).

The term "property maintenance fund" as mentioned in these Measures only refers to the commercial housing property maintenance fund. Article 3 The * * part of the property and the scope of facilities and equipment used by the property as mentioned in these Measures shall be implemented in accordance with the Regulations of Hangzhou Municipality on Property Management.

The property management area belongs to the facilities and equipment such as municipal utilities, city appearance and sanitation, greening, water supply, heating, power supply, communication, radio and television and other departments responsible for the management of urban roads, public drainage, environmental sanitation, public green space, urban water supply, gas supply, heating, power supply, communication pipelines, cable TV lines, etc., and does not belong to the * * part of the property as mentioned in these Measures. Article 4 A maintenance fund for * * * parts and * * * facilities (hereinafter referred to as the property maintenance fund) shall be established for newly-built properties. The property maintenance fund belongs to the owner.

The principle of unified deposit, special account storage, earmarking, owner's decision-making and government supervision shall be implemented for the property maintenance fund.

The newly-built property of two or more property owners shall be equipped with property management houses according to law. Fifth Hangzhou real estate administrative department is the administrative department in charge of property management in this Municipality, and is responsible for organizing the implementation of these measures.

The municipal property maintenance fund management institution under the Hangzhou real estate administrative department is responsible for the supervision and management of the collection and use of property maintenance funds within the urban area.

District property management administrative departments in accordance with the provisions of these measures, responsible for the supervision and management of property maintenance funds and property management houses within their respective jurisdictions.

Construction, planning, price, finance and other administrative departments shall be responsible for coordinating the implementation of these measures in accordance with their respective responsibilities. Chapter II Raising of Property Maintenance Fund Article 6 The property maintenance fund for the first phase of newly-built property shall be paid by the purchaser according to the construction area of not less than 5% of the construction and installation project cost, and shall be collected from the purchaser by the construction unit when the house is sold (pre-sold). The property maintenance fund collected is not included in the house price, unless otherwise agreed by both parties.

The newly-built real estate mentioned in the preceding paragraph includes the resettlement houses where the property rights of private houses are exchanged during urban house demolition.

The specific payment standard of the property maintenance fund is calculated by the municipal property management administrative department in conjunction with the municipal price administrative department according to the actual construction and installation cost of Hangzhou, and published regularly. The owners' committee or its entrusted property management unit shall timely transfer maintenance funds to the municipal property maintenance fund management institution. Chapter III Management of Property Maintenance Fund Article 9 The property maintenance fund shall be deposited into the special account of bank maintenance fund by the municipal property maintenance fund management institution, with a property management area as the management unit, set up building by building and accounted for by households. The contents announced include the payment, use, value-added income and balance of the maintenance fund. Chapter IV Use of Property Maintenance Fund Article 13 In addition to reasonable management fees, the property maintenance fund and its value-added part shall be used exclusively for the maintenance and renewal of property parts and facilities that have been repaired or above after the warranty period expires, and it is forbidden to use them for other purposes. Fourteenth property parts, facilities maintenance, update the need to use the property maintenance fund, the property management unit put forward the use of the program, with the consent of more than two-thirds of the relevant owners and the owners' committee, reported to the municipal property maintenance fund management institutions for approval. (three) after the completion of the project, the property management unit shall report the following information to the municipal property maintenance fund management institution, and after verification, allocate the balance of maintenance expenses:

4, the owners' committee acceptance certificate.
