Chapter I General Provisions Article 1 In order to continuously improve the quality of atmospheric environment in our city, prevent and control air pollution, safeguard public health, promote the construction of ecological civilization and promote the sustainable development of economy and society, these Regulations are formulated in accordance with the Law of People's Republic of China (PRC) on the Prevention and Control of Air Pollution, the Regulations of Liaoning Province on the Prevention and Control of Air Pollution and other relevant laws and regulations, and combined with the actual situation of this city. Article 2 These Regulations shall apply to the prevention and control of air pollution and its supervision and management activities within the administrative area of this Municipality. Article 3 To prevent and control air pollution, we should aim at improving the quality of the atmospheric environment, adhere to source control, give priority to planning, change the mode of economic development, optimize the industrial structure and layout, adjust the energy structure, follow the principles of combining prevention and control, comprehensive improvement, and whoever damages will be responsible, and establish a prevention and control system with government-led, departmental supervision, enterprises as the main body, social groups and public participation. Article 4 The people's governments of cities and counties (cities) shall be responsible for the quality of the atmospheric environment within their respective jurisdictions, formulate and implement plans for the prevention and control of atmospheric pollution, incorporate the prevention and control of atmospheric pollution into the plans for national economic and social development, and take measures to control or reduce the emission of atmospheric pollutants, so that the quality of the atmospheric environment can meet the national and provincial standards and be gradually improved.

Development Zone Management Committee (including Anshan High-tech Industrial Development Zone Management Committee, Anshan Economic Development Zone Management Committee, Anshan Qianshan Scenic Area Management Committee, the same below) is responsible for the atmospheric environmental quality within its management area, and carries out supervision and management according to law.

Township (town) people's governments and sub-district offices shall do a good job in the prevention and control of air pollution in accordance with relevant regulations.

The Municipal People's Government shall establish an assessment system for the prevention and control of air pollution. The evaluation results shall be announced to the public. Article 5 The municipal competent department of ecological environment shall exercise unified supervision and management over the prevention and control of air pollution in the whole city.

Other relevant departments of the municipal and county (city) people's governments shall supervise and manage the prevention and control of air pollution within their respective functions and duties. Article 6 Enterprises, institutions and other producers and operators shall take effective measures to prevent and reduce air pollution, and shall be liable for the damage caused according to law.

Encourage enterprises, institutions and other producers and operators to adopt advanced technology and equipment to reduce air pollutant emissions.

Citizens should enhance their awareness of atmospheric environmental protection, abide by laws and regulations on the prevention and control of atmospheric pollution, adopt a green, low-carbon, frugal and civilized lifestyle, and reduce the emission of atmospheric pollutants.

Encourage social organizations and the public to participate in air pollution prevention and public welfare activities. Chapter II Supervision and Management Article 7 The municipal competent department of ecological environment shall be responsible for the preparation of the plan for reaching the standard of atmospheric environmental quality within a time limit in this Municipality, and organize its implementation after being approved by the Municipal People's Government, which shall be announced to the public and put on record in accordance with regulations.

The county (city) people's government that fails to meet the standards of atmospheric environmental quality shall, according to the requirements of the municipal atmospheric environmental quality deadline planning, formulate the local atmospheric environmental quality deadline planning and announce it to the public.

The district people's government that fails to meet the atmospheric environmental quality standards shall, in accordance with the requirements of the plan for reaching the standards within a time limit, do a good job in organizing and implementing the work in this area. Article 8 When examining and approving the environmental impact assessment documents of construction projects, the administrative examination and approval department shall control the emission of major air pollutants within the total emission control index of major air pollutants where the construction project is located.

Enterprises, institutions and other producers and operators shall conduct environmental impact assessment in accordance with the law when building projects that have an impact on the atmospheric environment. If the environmental impact assessment report or report form of a construction project has not been examined by the examination and approval department prescribed by law or has not been approved after examination, the construction unit shall not start construction. Article 9 The people's governments of cities and counties (cities) shall rationally plan the layout of industrial parks according to the land and space planning. Newly-built industrial projects that produce air pollutants shall meet the standards for the discharge of air pollutants, and shall be centrally arranged in industrial parks in accordance with the principles of reducing the discharge of air pollutants, recycling resources and centralized management.

City, county (city) District People's government in the preparation of land spatial planning, should fully consider the natural landforms and climatic conditions within their respective administrative areas, scientifically plan the spatial structure and overall layout of ventilation corridors, as well as the density and height of buildings, and maintain the smooth flow of urban ventilation corridors. Enterprises and institutions that discharge industrial waste gas or air pollutants listed in the National List of Toxic and Harmful Air Pollutants into the atmosphere, production and business units of coal-fired heat sources for central heating facilities and other pollutant discharge units that are subject to the management of pollutant discharge licenses according to law shall obtain pollutant discharge licenses in accordance with the relevant provisions of the state and discharge air pollutants in accordance with the provisions of the pollutant discharge licenses.

It is forbidden to discharge atmospheric pollutants by stealing, tampering with or forging monitoring data to evade supervision, temporarily stopping production for the purpose of evading on-site inspection, opening emergency discharge channels in non-emergency situations, and abnormal operation of air pollution prevention and control facilities. The Municipal People's Government shall decompose and implement the total air pollutant emission control indicators issued by the provincial people's government step by step to the county (city) District People's government.

County (city) District People's Government shall decompose the annual total control index of key air pollutants into pollutant discharge units.

The discharge of atmospheric pollutants by pollutant discharge units shall not exceed the key total amount control indicators approved by the competent department of ecological environment.
