What is the legal basis of property fees?
Property service charges should distinguish the nature and characteristics of different properties, and implement government-guided prices and market-regulated prices respectively. The specific pricing form shall be determined by the price departments of the people's governments of provinces, autonomous regions and municipalities directly under the Central Government in conjunction with the real estate administrative departments.
The standard basis for collecting property fees is the maintenance fees of public properties and supporting facilities, including external walls, stairs, walkways, elevators, central air conditioning systems, fire fighting systems, security systems, television audio systems, telephone systems, power distribution systems, water supply and drainage systems and other machines, equipment, machinery and facilities.
Basic conditions for collecting property fees:

In addition to the basic conditions, public order maintenance and cleaning services must meet the corresponding standards. The Measures also set out corresponding regulations on housing management, facility maintenance, greening maintenance management and comprehensive management services, and the property department must meet all conditions before it can charge the corresponding fees.

Notice of the National Development and Reform Commission and the Ministry of Construction on Printing and Distributing the Measures for the Administration of Property Service Charges Article 1 In order to standardize the behavior of property service charges and protect the legitimate rights and interests of owners and property management enterprises, these measures are formulated in accordance with the Price Law of People's Republic of China (PRC) and the Regulations on Property Management.
Article 2 The term "property service charges" as mentioned in these Measures refers to the fees charged by property management enterprises to the owners for the maintenance, conservation and management of houses, supporting facilities and related sites, and for maintaining the environmental sanitation and order in the relevant areas.
Fifth property service charges should follow the principles of rationality, openness and the adaptation of charging standards to service levels.
