Article 1 In order to strengthen the protection of ancient and famous trees, build a beautiful and livable park city, and promote the construction of ecological civilization and the coordinated development of economy and society, these Provisions are formulated in accordance with the Forest Law of People's Republic of China (PRC), the Regulations on Urban Greening, the Regulations on the Protection of Ancient and Famous Trees in Sichuan Province and other laws and regulations, combined with the reality of Chengdu. Article 2 These Provisions shall apply to the protection and management activities of ancient and famous trees that are distributed outside the virgin forests within the administrative area of this Municipality and are legally recognized and published. Article 3 The term "ancient trees" as mentioned in these Provisions refers to trees whose age is more than 100 years.

The ancient trees mentioned in these Provisions refer to trees with important historical, cultural, ornamental and scientific research value or important commemorative significance. Article 4 The protection and management of ancient and famous trees shall adhere to the principles of government leading, social participation, territorial management, local protection and scientific management and protection. Article 5 The municipal, district (city) and county people's governments shall strengthen their leadership in the protection and management of ancient and famous trees within their respective administrative areas, incorporate the protection of ancient and famous trees into the national spatial planning, and include funds for resource investigation, identification, rescue, conservation, publicity, scientific research and economic compensation of private ancient and famous trees in the fiscal budget at the corresponding level. Sixth city and district (city) county forestry, urban landscaping departments (hereinafter referred to as the competent departments of ancient and famous trees) are responsible for the protection and management of ancient and famous trees within their respective administrative areas.

City and district (city) county planning and natural resources, ecological environment, housing construction, urban management, agriculture and rural areas, cultural tourism, ethnic and religious departments to do a good job in the protection and management of ancient and famous trees within the scope of their duties.

Neighborhood offices and town people's governments shall assist in the protection and management of ancient and famous trees within their respective jurisdictions according to their duties. Article 7 The municipal, district (city) and county people's governments and their relevant departments shall strengthen the publicity and education on the protection of ancient and famous trees, actively integrate the socialist core values in the publicity, organize activities convenient for the public to participate widely, and enhance the consciousness of the whole society to protect ancient and famous trees. Article 8 The municipal, district (city) and county people's governments and their relevant departments shall support the research on the scientific protection of ancient and famous trees, strengthen the protection of genetic resources of ancient and famous trees, popularize and apply scientific research results, and improve the level of protection and management. Ninth units and individuals are encouraged to donate money to protect or adopt ancient and famous trees. Units and individuals who donate or adopt ancient trees can enjoy the right to sign for a certain period of time and the right to compulsory tree planting due diligence certification according to the donation protection or adoption agreement.

City and district (city) county people's governments may, in accordance with the relevant provisions of the state, commend units and individuals that have made remarkable achievements in the protection of ancient and famous trees. Tenth all units and individuals have the obligation to protect ancient and famous trees and their ancillary facilities; Have the right to stop and report acts that damage ancient and famous trees and their ancillary facilities.

The competent department of ancient and famous trees shall establish a complaint reporting system, accept complaints and reports from units, individuals and other organizations, and promptly handle and reply to complainants. Eleventh departments in charge of ancient and famous trees shall, in accordance with the requirements of "one tree and one file", establish graphic files of ancient and famous trees; Conduct a general survey every five years, organize an inspection once a year, and implement dynamic management of information on ancient and famous trees. Twelfth ancient trees should be protected at different levels. Those with a tree age of more than 500 years are first-class ancient trees, and the first-class protection is implemented; Trees that are more than 300 years old and less than 500 years old are second-class ancient trees, which are subject to second-class protection; Trees that are more than 0/00 years old and less than 300 years old are Grade III ancient trees, and shall be protected at Grade III.

Famous trees are not limited by the age of trees, and the first-class protection is implemented. Thirteenth departments in charge of ancient and famous trees shall, according to the norms for the identification of ancient and famous trees, organize experts to identify the trees included in the protection of ancient and famous trees. First-class ancient and famous trees shall be audited and summarized by the municipal department in charge of ancient and famous trees, and shall be audited by the provincial department in charge of ancient and famous trees according to the prescribed procedures, and reported to the provincial people's government for identification and publication; Two ancient trees by the competent department of ancient and famous trees audit, the Municipal People's government identified and published; Three ancient trees by the district (city) county departments in charge of ancient and famous trees audit, district (city) county people's government identified and announced.

Where ancient and famous trees are privately owned, the owner shall be informed before being announced as ancient and famous trees, and appropriate economic compensation shall be given. Article 14 The competent department of ancient and famous trees shall, in combination with the general survey of ancient and famous trees, improve the archives of follow-up resources of ancient and famous trees, and establish and improve the archives of follow-up resources of ancient and famous trees for trees whose age is more than 50 years and less than 100; Trees with a tree age of more than 80 years but less than 100 years shall be protected with reference to Grade III ancient trees. Article 17 The person responsible for the daily maintenance of ancient and famous trees shall be determined in accordance with the following provisions:

(a) state organs, military units, schools, social organizations, enterprises and institutions or cultural relics protection units, religious activities and other places within the scope of land, by the unit responsible for;

(two) within the scope of urban roads, squares and public green spaces, the units responsible for management shall be responsible, and if the units responsible for management are not determined, the sub-district offices and the Town People's Government shall be responsible;

(three) within the scope of land for railways, highways, rivers and reservoirs, the railway, highway, river and reservoir management units shall be responsible respectively;

(four) within the scope of national parks, natural and cultural heritage sites, nature reserves, tourist resorts, scenic spots, forest parks, geological parks, wetland parks and urban parks, the management agencies shall be responsible;

(five) residential areas, residential courtyards, the implementation of property management, by the property service enterprises responsible for, not the implementation of property management, by the street offices, the town people's government is responsible for;

(6) Contractors and operators are responsible for contracted land in rural areas, users are responsible for rural homesteads, and villagers' groups or villagers' committees are responsible for other rural areas;

(seven) old and famous trees owned by individuals shall be maintained by individuals.

If the person responsible for daily maintenance is not clear or has any objection, it shall be determined by the people's government of the region (city) or county where the ancient and famous trees are located.
