Is the property responsible for the theft of the residential car?

Legal analysis: whether the residential property company bears the liability for damages caused by the car being damaged or stolen in the residential area, firstly, it mainly proves that the car is scratched or stolen in the residential area, and secondly, it determines whether there is a contract with the residential property company, and whether the fee agreed in the contract is parking fee or storage fee. If it is a storage fee, the property company should be liable for compensation; if it is a parking fee, it will not be liable for compensation. If there is no contract agreement or the agreement is not clear, and the property management company does not explicitly charge the fees only for venue rental and does not bear the custody responsibility, it shall bear the custody responsibility. In addition, if the owner just parks his car on the residential road or other places at will, in this case, the property company generally does not bear the liability for compensation, and the infringer can only bear the corresponding legal liability. However, if there is a major fault in the management of the residential property company, the residential property company shall bear the corresponding liability for compensation according to the degree of its fault.

Legal basis: Article 34 of the Property Management Regulations, the owners' committee shall conclude a written property service contract with the property service enterprise selected by the owners' congress. Property service contracts shall stipulate property management matters, service quality, service fees, rights and obligations of both parties, management and use of special maintenance funds, property management premises, contract term, liability for breach of contract, etc.
