Legal analysis: if one party delays the performance of the contract by exercising the right of defense to perform first, the responsibility for the delay shall be borne by the other party. The parties owe each other debts and have the order of performance. If the first performing party fails to perform, the second performing party has the right to refuse its performance requirements. If the first performing party fails to perform the contract, the second performing party has the right to reject its corresponding performance requirements.
Legal basis: Article 526 of the General Principles of Civil Law of People's Republic of China (PRC) gives priority to the right of defense, which means that at the end of the performance period, one party refuses to perform his contractual obligations after performing his contractual obligations.
