Regulations of Chongqing Municipality on Fire Control

Chapter I General Provisions Article 1 In order to prevent fires and reduce fire hazards, protect citizens' personal safety, public property and citizens' property safety, safeguard public safety and ensure the smooth progress of socialist modernization, these Regulations are formulated in accordance with the Fire Prevention Law of People's Republic of China (PRC) and in light of the actual situation of this Municipality. Article 2 Units and individuals within the administrative area of this Municipality shall abide by these Regulations. Article 3 Fire control work shall follow the policy of "putting prevention first and combining prevention with elimination", adhere to the principle of combining specialized agencies with the masses, and implement the responsibility system for fire control work. Article 4 The fire control work shall be under the unified leadership of the Municipal People's Government, and the district and county (city) people's governments shall be responsible for the fire control work within their respective administrative areas.

People's governments at all levels shall incorporate fire control work into the national economic and social development plan to ensure that fire control work is compatible with economic construction and social development.

People's governments at all levels or competent departments shall commend and reward units and individuals that have made remarkable achievements in fire control work. Fifth Municipal Public Security Bureau is the competent authority of the city's fire supervision and management work, and the public security fire control institutions at or above the county level shall specifically implement the fire supervision and management work.

The fire control work of the underground part of military facilities mines is supervised by the competent department and guided by the public security fire control institutions.

The fire control work of railways, civil aviation, shipping and ports shall be supervised by local public security fire control institutions.

Where laws and regulations provide otherwise, such provisions shall prevail. Chapter II Fire Control Duties Article 6 People's governments at all levels shall set up fire control safety committees to organize, guide and urge units and individuals in their own areas to do a good job in fire control under the leadership of the people's governments at the corresponding levels.

Education, labor and other administrative departments should incorporate fire safety knowledge into teaching and training.

Departments and units in charge of news, publishing, radio, film and television shall regularly publicize fire laws, regulations and fire safety knowledge. Seventh public security fire control institutions shall perform the following duties in accordance with the provisions of fire laws, regulations and rules:

(a) to supervise the implementation of fire laws, regulations, rules, technical specifications and standards by units and individuals;

(two) to organize the preparation of the overall planning of urban fire protection, and organize, supervise and coordinate the relevant departments to implement the planning;

(3) Organizing fire prevention publicity and education;

(four) to supervise the rectification of fire hazards;

(five) responsible for building fire audit and fire acceptance of project completion;

(six) to supervise the quality of fire protection products, organize the appraisal of fire protection scientific research achievements, and popularize and use advanced fire protection technology and equipment;

(seven) to supervise the production, storage, transportation, sale, use and destruction of inflammable and explosive dangerous goods;

(eight) to guide the organization construction and business training of full-time fire brigade and volunteer fire brigade;

(nine) command fire fighting and participate in other emergency rescue;

(ten) to investigate and deal with fire accidents and violations of fire control management according to law;

(eleven) other duties as prescribed by laws, regulations and rules.

The public security organ shall perform the duties of fire control supervision and inspection of local residents, villagers and units authorized by the public security organ at a higher level. Article 8 State organs, organizations, enterprises and institutions shall perform the following duties:

(a) the implementation of fire laws, regulations, rules, technical specifications and standards;

(two) the fire control work into the work, production, operation and management, the implementation of full fire safety responsibility system;

(three) to develop a fire safety system, carry out fire knowledge propaganda, organize fire safety inspection, and eliminate fire hazards in time.

(four) in accordance with the relevant provisions of the state, the allocation and maintenance of fire control facilities and equipment, to ensure that fire control facilities and equipment are in good condition and effective;

(five) to ensure the smooth evacuation routes and exits, set up fire safety evacuation signs in line with state regulations, and equipped with emergency lighting facilities;

(six) the management of full-time fire brigade, volunteer fire brigade, to carry out fire drills, improve the ability of fire fighting;

(seven) when a fire breaks out, timely organize employees to evacuate people in distress, put out the fire, protect the scene of the fire, and assist in investigating the cause of the fire;

(eight) actively complete other fire control work deployed by the local people's government and higher authorities.

The fire control work of organs, organizations, enterprises and institutions shall be under the legal representative responsibility system, and the person in charge of fire prevention shall be the legal representative. Article 9 Key fire safety units with high fire risk that may cause heavy casualties or property losses in case of fire shall perform the following fire safety duties in addition to the duties specified in the preceding article:

(a) the establishment of fire archives, determine the key parts of fire safety, strict management;

(two) the implementation of daily fire inspection system, the establishment of daily inspection records;

(three) to provide fire safety training for employees;

(four) to formulate fire fighting and emergency evacuation plans and organize regular fire drills.

In a building with workshops or warehouses, employees' collective dormitories and family dormitories shall not be set up, and those that have been set up shall be corrected within a time limit. Tenth people's governments at or above the county level shall establish public security fire brigade and full-time fire brigade in accordance with the standards of fire brigade (station) stipulated by the state. The Town People's Government may, according to the needs of local economic development and fire control work, establish full-time fire brigades and voluntary fire brigades.
