When explaining the draft, Jiang Daming, Minister of Land and Resources, said that in the administrative areas of 33 pilot counties (cities, districts), the provisions of Articles 43 and 63 of the Land Management Law and Article 9 of the Urban Real Estate Management Law that the right to use collective construction land cannot be transferred are suspended, and the existing rural collective construction land use right is explicitly allowed to be transferred, leased and invested, with the same rights and the same price as the state-owned construction land use right.

Jiang Daming said that only collectively-operated construction land is allowed to enter the market in the pilot administrative area, and non-operating collective construction land is not allowed to enter the market. Entering the market must meet the requirements of planning, use control and legal acquisition. The scope of entering the market is limited to the stock of land.

The pilot areas will increase the income ratio of landless farmers.

Jiang Daming said that the provisions of Article 47 of the Land Management Law on collective land expropriation compensation should be temporarily adjusted and implemented, and the land use and location, economic development level, per capita income and other factors should be comprehensively considered, the compensation standard for land expropriation should be reasonably determined, and the housing and social security of landless farmers should be arranged. All eligible land-expropriated farmers will be included in the urban social security system such as pension and medical care. Where conditions permit, it can be managed by rural collective economic organizations in various ways, such as reserving land and production.

Jiang Daming said that the pilot administrative region will reasonably increase the proportion of land-expropriated farmers sharing land value-added benefits. The relevant departments of the State Council will strengthen the supervision of the masses on the land acquisition process by promoting the disclosure of land acquisition information and improving the land acquisition procedures.

Decentralize the examination and approval of homestead to prevent city people from buying land and building houses in rural areas.

According to the draft, the provisions of Articles 44 and 62 of the Land Management Law on the authority to examine and approve homestead are temporarily adjusted, and it is clear that the use of existing construction land is delegated to the township (town) people's government for examination and approval, and the use of new construction land is delegated to the county-level people's government for examination and approval.

Jiang Daming said that at this stage, the pilot administrative region should not take the right to use the homestead as a condition for entering the city. The withdrawal of homestead is voluntary and paid, and the transfer is limited to collective economic organizations to prevent urban people from buying land and building houses in rural areas, which will lead to the problem of anti-urbanization.
