Second, the legal basis

Article 59 of the Road Traffic Safety Law of the People's Republic of China

Non-motor vehicles should be parked at the specified places. If there is no parking place, non-motor vehicle parking shall not hinder the passage of other vehicles and pedestrians.

Three, the provisions of the temporary parking of motor vehicles on the road

1. No parking is allowed on the road section without parking signs and markings, on the road section with isolation facilities between motor vehicle lanes and non-motor vehicle lanes and sidewalks, as well as on crosswalks and construction sections;

2. No parking is allowed at intersections, railway crossings, sharp detours, narrow roads, bridges, steep slopes, tunnels and sections within 50 meters from the above locations;

Four, illegal parking punishment standard

1. On-site parking violation penalty. If the driver is present, the traffic police can point out the illegal behavior and give a verbal warning to make the driver leave immediately. The average driver just needs to drive faster, and there is no punishment. If the driver refuses to leave and drives the vehicle to obstruct the passage of other vehicles and pedestrians, the traffic police will impose a fine of more than 20 yuan and less than 200 yuan.

2. Off-site parking violation punishment. If the driver is not present, and the parked vehicle obstructs the traffic of other vehicles and pedestrians, in addition to fines and tickets, the traffic police department has the right to tow the vehicle to a place that does not obstruct the traffic or park it at a place designated by the traffic management department of the public security organ.
