Regulations of Inner Mongolia Autonomous Region on Property Management (202 1 Revision)

Chapter I General Provisions Article 1 In order to standardize property management activities, safeguard the legitimate rights and interests of owners and property service providers, and create a good living and working environment, these Regulations are formulated in accordance with the General Principles of the Civil Law of People's Republic of China (PRC), the Regulations on Property Management of the State Council and other relevant laws and administrative regulations, in combination with the actual situation of the autonomous region. Article 2 These Regulations shall apply to the use, maintenance, service and related supervision and management activities of the property within the administrative area of the autonomous region. Article 3 Property management activities shall follow the principles of party building leading, government organization, territorial management, owner autonomy and professional service. Fourth people's governments at or above the county level shall incorporate property management into the urban management system and the comprehensive target responsibility system, and establish a comprehensive coordination mechanism for property management and a professional, socialized and market-oriented property service mechanism. Article 5 The people's governments at or above the county level shall establish a guarantee mechanism for the investment of property management funds, strengthen the transformation of old residential areas, support the participation of social capital, comprehensively manage the property areas with incomplete supporting facilities and no property service conditions, and gradually realize the full coverage of property management in residential areas. Article 6 The property administrative department of the people's government at or above the county level shall be responsible for the supervision and management of property service activities within their respective administrative areas.

The departments and institutions of the people's governments at or above the county level, such as housing and urban and rural construction, development and reform, comprehensive law enforcement of finance, ecological environment, urban management, public security, civil affairs, health, market supervision and management, emergency management, natural resources, civil air defense, fire rescue, etc., shall, according to their respective functions and duties, do a good job in relevant property supervision and management.

Sumu Township People's Government and sub-district offices are responsible for organizing, guiding and coordinating the work of the owners' assembly in the property management area within their respective jurisdictions, urging the owners' assembly to perform their duties according to law, coordinating the relationship between community building and property services, and handling disputes over property services.

Gacha villagers' committees and residents' committees assist Sumu Township People's governments and sub-district offices in property management.

Water supply, power supply, heating, gas supply, communication, cable television and other units shall, in accordance with their respective responsibilities, do a good job in related property services. Article 7 The property administrative department of the people's government at or above the county level shall announce the ways of accepting complaints and reports in a prominent position in the property management area, promptly accept complaints and reports from owners and relevant units, and investigate and deal with illegal acts according to law. Reply to real-name complaints and reports within a limited time, and keep the real-name complainant confidential. Eighth property management to implement the joint meeting system. The joint meeting was convened by Sumu Township People's Government and sub-district offices, and attended by representatives of the property administrative departments of the people's governments at the county level, Gacha villagers' committees, residents' committees, construction units, property service providers, owners' committees and relevant administrative departments. If the owners' committee is not established, there shall be representatives of the owners.

The joint meeting of property management mainly coordinates and solves the following main problems:

(a) the owners' committee fails to perform its duties according to law;

(two) there are problems in the process of the election of the owners' committee and the general election;

(three) there are problems in the performance of the property service contract by the property service provider;

(four) problems in the process of property service handover;

(five) other property service disputes that need to be resolved through coordination. Article 9 Property service industry associations shall strengthen industry self-discipline, standardize industry behaviors and promote the healthy development of the property service industry. Chapter II Owners and Owners' Congress Article 10 The owner of a house is the owner.

Owners have the ownership of exclusive parts of buildings such as houses and business buildings, and have the right to co-manage the parts other than the exclusive parts. The owner's exercise of rights shall not endanger the safety of the building or damage the legitimate rights and interests of other owners.

If the house has been actually occupied due to legal relations such as sale, gift and inheritance, but the ownership registration has not been handled according to law, the house owner shall enjoy the rights of the owner and assume the obligations of the owner in the property service. Eleventh owners in property management activities, enjoy the following rights:

(a) in accordance with the provisions of the realty service contract, accept the services of the realty service provider;

(two) proposed to convene a meeting of the owners' congress, and put forward suggestions on matters related to property services;

(three) put forward suggestions on formulating and amending the management statute and the rules of procedure of the owners' congress;

(four) to participate in the owners' meeting and exercise the right to vote;

(five) to elect members of the owners' committee and enjoy the right to be elected;

(six) to supervise the work of the owners' committee;

(seven) to supervise the performance of the realty service contract by the realty service provider;

(eight) the right to know, supervise and benefit from the use of the * * * parts of the property, * * facilities and equipment and related sites;

(nine) to supervise the management and use of residential special maintenance funds;

(ten) other rights stipulated by laws and regulations. Twelfth owners in the property management activities, fulfill the following obligations:

(a) abide by the management statute or interim management statute, the rules of procedure of the owners' meeting;

(2) Abide by the rules and regulations on the use of * * * parts and facilities, the maintenance of public order and environmental sanitation, and the response to public emergencies in the property management area;

(three) to implement the decisions of the owners' congress and the owners' committee;

(four) in accordance with the relevant provisions of the state to pay residential special maintenance funds;

(five) to pay the property service fee as agreed;

(six) to fulfill the responsibility for the safe use of houses;

(seven) to cooperate with property service providers in the implementation of property management;

(eight) in accordance with the provisions of the classification of domestic waste;

(nine) other obligations stipulated by laws and regulations.
