"Use of public buildings and facilities" refers to the planning and design functions of public buildings and facilities. Otherwise, the planning and design will not only fail to play its due role, but may bring all kinds of inconvenience to the residents of the community and even cause all kinds of accidents. For example, public corridors and stairs are used for normal traffic, and sundries cannot be piled up, otherwise it will hinder traffic and may cause fires; Fire evacuation stairs are used for emergency evacuation of personnel in case of fire. Under normal circumstances, it should not be used as access stairs, nor should it be piled up with sundries, causing congestion. Therefore, neither the owner nor the property service enterprise can change the "use of public buildings and facilities" without authorization, otherwise the consequences will be serious and the responsibility will be great.

According to Article 14 of the Measures for the Administration of Newly-built Urban Residential Quarters, if a real estate owner or user violates the provisions of these Measures and commits any of the following acts, the property service company shall stop it, criticize and educate it, order it to be restored to its original state, and compensate for the losses: ① changing the land use of the residential quarter without authorization; (two) unauthorized changes in the use, structure and appearance of houses and supporting facilities, damage to facilities and equipment, endangering the safety of houses; (3) Unauthorized construction, parking of vehicles, stacking of objects in the * * * used parts of the house, random occupation, damaging greening, polluting the environment, affecting the landscape of residential areas, and disturbing the people with noise. Article 15 stipulates that property service companies have the right to complain if they build buildings or change the use of public real estate facilities without authorization. The property management committee has the right to stop it and ask it to make corrections within a time limit; The real estate administrative department may give a warning, order it to make corrections within a time limit, compensate for the losses, and may also impose a fine.

In addition, according to Article 58 of Chapter VI "Legal Liability" of the Property Management Regulations, in violation of these regulations, if the construction unit arbitrarily disposes of the ownership or use right of the parts and facilities owned by the owners, the real estate administrative department of the local people's government at or above the county level shall impose a fine of more than 50,000 yuan but less than 200,000 yuan; If losses are caused to the owners, they shall be liable for compensation according to law. It can be seen that the construction and use of public facilities in the property management area are very important and cannot be changed without authorization.

(2) If the owners really need to change the use of public buildings and facilities according to law, they shall inform the realty service enterprise after going through the relevant formalities according to law.

As mentioned above, the use of public buildings and facilities in the property management area cannot be changed at will, but this is not the case. Owners must change the use of public buildings and public facilities according to law because of public interests or their own basic needs, and can inform the property service enterprises after applying to the relevant departments and obtaining approval, and the property service enterprises will make overall arrangements and supervision to reduce the impact on the public. Then the owner can appropriately change the use of public buildings and facilities.

(three) if the realty service enterprise really needs to change the use of public buildings and facilities, it shall be submitted to the owners' meeting for discussion and approval, and the owners shall go through the relevant formalities according to law.

Similarly, if the realty service enterprise really needs to change the use of public buildings and facilities to benefit the development of the public or the community, it can apply to the relevant departments for approval after submitting it to the owners' meeting for discussion and decision, and supervise the behavior of the realty service enterprise according to law (because the owner is the owner of the community).
