Regulations of Ji 'an Municipality on the Administration of Residential Property
This Ordinance referred to in residential property management (hereinafter referred to as property management), refers to the activities of residential owners to maintain, conserve and manage buildings, structures, supporting facilities and related sites by hiring property service enterprises, and to maintain environmental sanitation and related order in the property management area.
The term "owner" as mentioned in these Regulations refers to the owner of the house. The confirmation of the owner's identity is based on the real estate register or other valid documents stipulated by laws and administrative regulations. Article 3 The people's governments of cities and counties (cities, districts) shall uniformly lead the supervision and management of property management activities within their respective administrative areas, establish and improve comprehensive coordination mechanisms such as joint meetings on property management, urge relevant departments to perform their duties of supervision and management according to law, coordinate and solve major problems in property management, incorporate property management into the assessment of government target management, and ensure the funds for street offices and township people's governments to carry out property management guidance and supervision.
The Administrative Committee of Jinggangshan Economic and Technological Development Zone and the Administrative Committee of Luling New District, which have administrative functions, shall undertake the duties as prescribed in the preceding paragraph in accordance with the provisions of the Municipal People's Government. Fourth city and county (city, district) people's government housing and urban and rural construction departments responsible for the supervision and management of property management activities within their respective administrative areas.
Urban management, natural resources, development and reform, public security, civil air defense, emergency management, fire rescue, market supervision and other departments should do a good job in property management according to their respective responsibilities.
Sub-district offices and Township People's governments shall establish the working system of property management within their respective jurisdictions, determine the working institutions, implement the staff, and jointly with the property management departments of the county (city, district) people's governments, specifically guide and supervise the establishment of the owners' assembly and the election of the owners' committee according to law, supervise the owners' assembly and the owners' committee to perform their duties according to law, guide and supervise the transfer of property management projects within their respective jurisdictions, mediate and handle property management disputes, and coordinate the relationship between property management and community management and community services.
Neighborhood (village) committees shall assist neighborhood offices and township people's governments in carrying out relevant work of property management according to law. Article 5 The people's governments of cities and counties (cities, districts) shall establish and gradually popularize the use of property management information service platforms for electronic voting of owners' decision-making, information disclosure related to property management, complaint handling of property management disputes, etc. , guide owners to participate in public affairs and carry out consulting activities, and promote property management departments, property service enterprises and owners' committees to adopt information and intelligent technologies to improve the quality of property services and the level of supervision and management. Article 6 The competent department of property management of the people's governments of cities and counties (cities, districts) shall establish a training system, and regularly organize relevant personnel of sub-district offices, township people's governments, neighborhood committees, owners' committees and property service enterprises to carry out property management laws and regulations and business knowledge training, so as to improve the level of property management.
City, county (city, district) people's government property management departments, street offices, Township People's governments and neighborhood (village) committees shall actively carry out publicity and education activities on property management laws, regulations and related policies, and enhance the awareness and ability of owners to implement self-management.
The property management industry association shall strengthen the self-discipline management of the industry, formulate and organize the implementation of the code of conduct for self-discipline management of property service enterprises according to law, promote the standardization of property services, improve the level of property services, and promote the healthy and orderly development of the industry. Chapter II Property Management Areas and Supporting Facilities and Equipment Article 7 Before handling the pre-sale permit or on-sale record, the construction unit shall apply to the property management department of the county (city, district) people's government where the property is located according to law, and the county (city, district) people's government shall verify the property management areas in accordance with the relevant provisions of the state and province, issue verification opinions, and send a copy of the verification opinions to the neighborhood offices and township people's governments where the property is located.
After the acceptance of the property management area, the construction unit shall express the following contents to the buyer when selling the house as an annex to the house sales contract:
(a) the scope of the property management area;
(two) the area and location of public places and public green spaces;
(three) the name, location, area and ownership of the basement and ground floor;
(four) the name, purpose and ownership of the facilities and equipment used by * * * *;
(five) the area and location of the property management room;
(six) planning the number and location of parking spaces, garages and electric bicycle charging places for parking motor vehicles and non-motor vehicles;
(seven) other places and facilities that need to be clearly stated.
