Regulations of Guangzhou Municipality on the Administration of Urban Rail Transit

Chapter I General Provisions Article 1 In order to standardize the management of urban rail transit, ensure the smooth progress and safe operation of urban rail transit construction and safeguard the legitimate rights and interests of passengers, these Regulations are formulated in accordance with relevant laws and regulations and in light of the actual situation of this Municipality. Article 2 The term "urban rail transit" as mentioned in these Regulations refers to the public * * * passenger transport system of urban rapid rail such as subway and light rail.

Urban rail transit facilities include urban rail transit subgrade, tracks, tunnels, elevated roads (including bridges), stations (including entrances and exits, passages), ventilation booths, rolling stock depots and control centers, stations, vehicles, electromechanical equipment, power supply systems, communication signal systems and their ancillary facilities. Article 3 These Regulations shall apply to the planning, construction, operation and related management activities of urban rail transit within the administrative area of this Municipality. Article 4 Urban rail transit shall follow the principles of unified planning, safe operation and standardized service. Article 5 The municipal construction administrative department is the competent department of urban rail transit management in this Municipality, and is responsible for the organization, implementation, supervision and inspection of these Regulations.

The relevant municipal administrative departments shall coordinate the implementation of these regulations in accordance with their duties.

The people's governments of all districts and counties along the urban rail transit shall cooperate with the construction and protection of urban rail transit. Sixth urban rail transit business units shall be determined by the Municipal People's government according to law.

Urban rail transit business units shall, in accordance with the relevant authorization of these regulations, implement administrative management and administrative punishment on public affairs such as the protection of urban rail transit facilities, the operation order and appearance of public places within the scope of urban rail transit, and the maintenance of environmental sanitation and safety emergency.

Urban rail transit business units shall determine the specialized agencies of their own units to be specifically responsible for administrative management and administrative punishment. Law enforcement officers are appointed in accordance with the conditions stipulated in the Regulations of Guangdong Province on Administrative Law Enforcement Responsibility System.

Law enforcement officers of urban rail transit business units shall hold valid law enforcement certificates when implementing administrative management and administrative punishment. Chapter II Construction Management Article 7 The municipal development and reform administrative department and the municipal finance department are responsible for raising and managing the funds invested by the government for urban rail transit construction.

The municipal development and reform administrative department shall, in accordance with the basic construction procedures stipulated by the state, handle the project examination and approval and issue the urban rail transit investment plan. Urban rail transit planning should be linked with other public transport planning, and necessary space should be reserved to ensure safe and convenient transfer conditions and sufficient evacuation capacity.

When examining and approving other construction projects connected with rail transit entrances, ventilation kiosks and other facilities, the municipal urban planning administrative department shall put forward the planning and design requirements for reserving the necessary space connected with rail transit. Article 9 The construction of urban rail transit projects shall comply with the laws and regulations on construction safety management, meet the requirements of technical standards and specifications, and establish and implement a dynamic safety monitoring system for the construction process. Article 10 When underground space is used in urban rail transit construction, the owners and users of the buildings (structures) and land above it shall provide necessary convenience.

Urban rail transit business units shall take measures to prevent and reduce the impact on buildings (structures) and other facilities above and around. If losses are caused, they shall bear legal responsibilities according to law.

During the construction of urban rail transit projects, urban rail transit business units shall conduct necessary investigations, records and dynamic monitoring of existing buildings along urban rail transit. Eleventh according to the planning requirements, urban rail transit entrances, ventilation kiosks and other facilities need to be combined with the surrounding property construction, the owners and users of the surrounding property should obey; If the joint construction causes losses to the interests of the surrounding property owners and users, the urban rail transit business unit shall bear legal responsibility according to law. Chapter III Protection of Facilities Article 12 Urban rail transit control protection zones shall be established along the urban rail transit, and their scope includes:

(a) within fifty meters of the periphery of the underground station and tunnel structure;

(2) Within 30m of the outside of the ground, elevated station and track structure;

(3) Outside of buildings (structures) such as entrances and exits, ventilation kiosks, rolling stock depots, control centers, substations and centralized cooling stations 10 meter;

(4) Within the range of 100 meters on both sides of the river-crossing tunnel of urban rail transit.

The specific scope of protected areas shall be controlled, and the planning shall be put forward by the urban rail transit business unit, and shall be approved and promulgated by the Municipal People's Government after being audited by the planning administrative department. (three) building ponds, digging canals, quarrying and dredging, and drilling wells to get water;

(4) Overhead operations such as laying pipelines or erecting crossing lines;

(5) Dredging the river in the river-crossing tunnel section;

(six) other operations that may endanger urban rail transit facilities.

If the activities listed in the first paragraph of this article do not require the administrative license of the administrative department in the urban rail transit control and protection zone, the operating unit shall inform the urban rail transit operating unit in writing before the construction.
