Chapter VI Legal Responsibility of Hangzhou Property Management Regulations
The administrative punishment prescribed in these Regulations belongs to the scope of the relatively centralized administrative punishment right of urban management approved by the people's government of the State Council or the province, and shall be implemented by the administrative law enforcement organs of urban management.
Sixtieth, if the construction unit fails to pay the preparatory funds for the first meeting of the owners' congress in accordance with the provisions of the first paragraph of Article 16 of these regulations, the district and county (city) real estate departments shall order it to make corrections within a time limit; If no correction is made within the time limit, a fine of 5000 yuan will be imposed.
Sixty-first property service enterprises in violation of the provisions of the third paragraph of article thirty-fourth, not in accordance with the requirements of the property service contract for the record, the district and county (city) real estate departments shall be ordered to make corrections within a time limit; If no correction is made within the time limit, a fine of two thousand yuan or more and five thousand yuan or less shall be imposed.
Sixty-second property service enterprises in violation of the provisions of the first paragraph of article thirty-sixth, did not hand over the property management files, materials and related property when withdrawing from property services, the district and county (city) real estate departments shall order it to make corrections within a time limit; If no correction is made within the time limit, a fine of 1 10,000 yuan or more and10,000 yuan or less shall be imposed.
Sixty-third property service enterprises in violation of the provisions of the third paragraph of Article 39 of these regulations, not in accordance with the requirements of the announcement of operating income and expenditure, the district, county (city) real estate departments shall order it to make corrections, and may be fined between 5,000 yuan and 10,000 yuan.
Article 64 Where an owner or non-owner user violates the provisions of Items 1 and 2 of Paragraph 1 of Article 42 of these Regulations, the district/county (city) real estate administrative department shall order him to make corrections and restore to the original state, and may impose a fine of not less than 50,000 yuan but not more than 100,000 yuan; If the circumstances are minor, a fine of not less than 10,000 yuan but not more than 50,000 yuan may be imposed.
Sixty-fifth owners or non-owners who violate the provisions of the third, fourth and fifth items of the first paragraph of Article 42 of these regulations shall be investigated and dealt with by the competent department of urban and rural planning according to law; In violation of the provisions of the sixth paragraph of article forty-second, the municipal facilities and public utilities departments shall be investigated and dealt with according to law; In violation of the provisions of the seventh paragraph of the first paragraph of article forty-second, the competent department of greening shall investigate and deal with it according to law; Violation of the provisions of the eighth paragraph of the first paragraph of article forty-second, shall be investigated and dealt with by the fire department of the public security organ or the public security police station according to law; Violation of Article 42, Paragraph 1, Item 9 shall be investigated and dealt with by the competent department of environmental protection according to law.
In violation of the provisions of Article 42, paragraph 1, Item 10 of these regulations, the relevant interested parties may bring a lawsuit to the people's court according to law.
Article 66 If the construction unit violates the provisions of Articles 48 and 52 of this Ordinance and fails to deposit the property warranty fund and special maintenance fund as required, the city and county (city) real estate administrative department shall order it to make corrections within a time limit; If no correction is made within the time limit, a fine of not less than ten thousand yuan but not more than thirty thousand yuan shall be imposed.
Sixty-seventh in violation of the provisions of this Ordinance, the staff of the real estate department or other relevant administrative departments have one of the following acts, and the directly responsible person in charge and other directly responsible personnel shall be punished according to law:
(a) misappropriation of special maintenance funds or property maintenance funds;
(2) Failing to investigate and deal with illegal acts according to law;
(three) taking advantage of his position to accept illegitimate interests such as property of the construction unit or others;
(four) other dereliction of duty, abuse of power, abuse of power.
