Interpretation of "Regulations on Fire Safety Management of High-rise Civil Buildings"
In order to strengthen the fire safety management of high-rise civil buildings, prevent fires and reduce fire hazards, the Emergency Management Department formulated the Regulations on Fire Safety Management of High-rise Civil Buildings, which was promulgated in June 20021year and came into force in August 20021year.
There are two kinds of high-rise civil buildings, high-rise residential buildings and high-rise public buildings. High-rise residential buildings are residential buildings with a building height of more than 27 meters, and high-rise public buildings are non-single-storey public buildings with a building height of more than 24 meters, including dormitories, apartments, offices, scientific research, culture, commerce, sports, medical care, transportation, tourism, communications and other buildings.
This paper interprets the relevant key clauses in the Regulations, aiming at clarifying responsibilities and preventing risks.
1. The owners and users of high-rise civil buildings are responsible for the fire safety of high-rise civil buildings and are responsible for the fire safety of high-rise civil buildings. Owners and users are responsible for the fire safety of their proprietary parts, and at the same time, they are responsible for the fire safety of some parts of * * * *.
At present, the main body of fire safety responsibility stipulated by the fire protection law, the regulations on fire protection management of high-rise civil buildings and other laws and regulations is mainly organs, organizations, enterprises, institutions and other units. Villagers' committees and residents' committees carry out mass fire control work, but they don't clearly define the fire safety responsibility of building owners, which leads to the owners' weak awareness of fire safety subject, and even leads many people to mistakenly believe that fire control work is only the responsibility of the government and users, which has little to do with themselves and is not conducive to fire safety management.
Articles 4 and 6 of the Regulations on Fire Safety Management of High-rise Civil Buildings make it clear for the first time that the owner of high-rise civil buildings is the subject of fire safety responsibility, the owner is the unit, and the legal representative or main person in charge of the unit is the person in charge of fire safety.
Two, high-rise civil building owners, users and property services companies between the fire safety responsibility, should be clearly agreed in writing.
If there are more than two owners and users of the same high-rise civil building, it shall entrust a realty service enterprise or a unified manager to uniformly manage the fire safety of some areas of the building, coordinate and guide the owners and users to do a good job in the fire safety of the whole building, and stipulate the fire safety responsibilities of all parties in writing.
Three, to contract, lease or entrust the operation and management of high-rise civil buildings. For contractors, lessees, managers, contractors, lessees, entrusted managers, etc. , should be clear about the fire safety responsibility of all parties. At the same time, the owner should provide buildings that meet the fire safety requirements and urge users to strengthen fire safety management.
If the building or house rented by the owner is directly used in accordance with the law without fire-fighting acceptance or unqualified fire-fighting acceptance, even if the lessor takes advantage of its dominant position and stipulates in the lease contract that the lessee shall bear all fire-fighting safety responsibilities, the agreement is likely to be deemed invalid and the lessor cannot be exempted.
Four, the owners of high-rise public buildings, users and entrusted property service enterprises shall designate a person as the fire safety manager, responsible for the fire safety management of the whole building, and publicize their names, contact information and fire safety management responsibilities in a prominent position in the building.
Five, high-rise civil building fire control room should be implemented by a single management unit 24-hour duty system, each shift should not be less than 2 people on duty. The operator on duty in the fire control room shall obtain the corresponding professional qualification certificate for special jobs in the fire protection industry according to law, master the fire alarm processing procedures and requirements, and check the operation of automatic fire control facilities and linkage control equipment in accordance with relevant regulations to ensure that they are in normal working condition.
The fire control room shall keep high-rise civil construction site plan, floor plan, fire control facilities system diagram and control logic description, building fire control facilities maintenance records and test reports.
6. It is forbidden to park or charge electric bicycles in public halls, evacuation walkways, stairwells and safety exits of high-rise civil buildings.
Seven, in order to meet the use function of high-rise civil buildings, it is forbidden to set up other warehouses in high-rise civil buildings except temporary warehouses, archives and data rooms for personal use.
Eight, high-rise civil buildings with external thermal insulation system, the management unit should be in the main entrance and exit and the surrounding relevant prominent position, set up suggestive and warning signs, indicating the combustion performance and fire protection requirements of external thermal insulation materials. It is forbidden to use flammable and combustible materials as external thermal insulation materials for external walls of high-rise civil buildings.
Nine, high-rise residential buildings without automatic fire control facilities, encourage the installation of fire alarm and automatic sprinkler system, fire emergency broadcast and combustible gas detection, wireless manual fire alarm, wireless acousto-optic fire alarm and other fire control facilities according to local conditions.
