Measures of Handan Municipality on the Administration of Property Fire Safety

Article 1 In order to strengthen the city's property fire safety management and further clarify the responsibility for fire safety, these Measures are formulated in accordance with the Fire Protection Law of People's Republic of China (PRC) and the Regulations on Property Management. Article 2 The term "property" as mentioned in these Measures refers to all kinds of houses that have been built and put into use and their supporting equipment, facilities and venues, mainly including office buildings, commercial buildings, residential quarters, villas, industrial parks, hotels, factories and warehouses. Article 3 These Measures shall apply to the areas where property management is implemented in the whole city. Article 4 Public security organs shall supervise and manage the property service enterprises within their respective administrative areas in performing their duties. Property management administrative departments, industrial and commercial administrative departments and other units shall do a good job in fire safety within their respective responsibilities. Article 5 Merchants, residents and other personnel shall perform the following obligations:

(a) to cooperate with the property service enterprises to do a good job in fire safety, and to do a good job in fire safety of self-use parts and equipment;

(2) Educating the guardians of the elderly, the disabled, the mentally ill, the paralyzed, the persons without or with limited capacity for civil conduct, and implementing the necessary fire safety protection measures;

(three) when decorating and decorating houses, installing and using electrical products and gas appliances, and designing and laying pipelines in accordance with the relevant fire safety technical specifications;

(4) Park gas and fuel mopeds and motorcycles in safe places, and implement fire safety measures to prevent gas and fuel from leaking;

(five) to set off fireworks and firecrackers safely in the specified area, road section and within the specified time, and not to illegally store, sell or set off fireworks and firecrackers;

(6) Don't set off Kongming lanterns;

(seven) according to the requirements of the "notice" issued by the realty service enterprise, timely rectification of fire hazards, and accept the supervision of the realty service enterprise;

(eight) after the fire, cooperate with the relevant departments to carry out fire accident investigation, and shall not clean up and destroy the scene of the fire accident without authorization;

(nine) according to the provisions of the maintenance, update and purchase of fire facilities related expenses. Article 6 The owners' committee shall perform the following duties:

(a) to organize and urge merchants and residents to abide by fire laws and regulations;

(two) to cooperate with the residents' committees to perform their duties of self-management of fire safety according to law, support the residents' committees to carry out fire control work, and accept their guidance and supervision;

(three) to supervise and assist the property service enterprises to implement fire safety services;

(four) according to laws, regulations and technical standards, maintain and update fire control facilities. Seventh community residents' committees shall establish a responsibility system for fire safety, formulate a convention on fire prevention for residents, and establish and implement a fire safety management system; At least once a month to the units and residential areas within the jurisdiction of the fire safety inspection, such as fire electricity, evacuation routes, fire spacing, fire facilities and equipment, etc., to urge and assist the units and residents within the jurisdiction to carry out fire safety self-examination and self-correction, timely discover and eliminate fire hazards; Carry out fire safety publicity and education, and strengthen the key monitoring of special groups such as the old, the weak, the sick, the disabled and the widowed. Eighth community residents' committees shall set up voluntary firefighters and voluntary fire propagandists in each building.

The fire warden is responsible for conducting a fire safety inspection once a week, and the fire propagandist is responsible for publicizing the common sense of fire safety. Article 9 A realty service enterprise shall be responsible for the management of fire safety in the service area, strictly abide by fire laws and regulations, perform fire safety duties and maintain fire safety.

The main person in charge of the property service enterprise is the person in charge of fire safety in the property management area, and the person in charge is the fire safety manager in the property management area; Property service enterprises shall set up full-time (part-time) fire management personnel. Article 10 The fire safety responsibility of a realty service enterprise shall be clearly written into the realty service contract, and the administrative department of realty management shall incorporate the fire safety responsibility of the realty service enterprise into the model text of the realty service contract. Article 11 The person in charge of fire safety, the fire safety administrator, the full-time (part-time) fire safety administrator and the operator of the fire control room of the realty service enterprise shall, within 5 working days from the date of confirmation or change, fill in the Record Form of Fire Safety Administrator's Report and report it to the fire department of the local public security organ or the public security police station for the record. Article 12 A realty service enterprise shall conduct a self-assessment on fire safety in the realty management area every quarter, fill in the record form of the self-assessment report on fire safety, and report to the fire control institution of the local public security organ or the police station in time. Thirteenth property services companies should carry out daily maintenance of building fire facilities to ensure that they are in good condition and effective; Entrust a qualified testing institution to conduct a comprehensive inspection of automatic fire-fighting facilities every year, report the inspection results to the local public security organ fire-fighting institution or police station in time, and publicize them in a prominent position in the unit. Article 14 When a fire breaks out, the realty service enterprise shall immediately organize merchants, residents and other personnel to call the police, carry out fire fighting and self-help, start fire-fighting facilities, open fire exits, and call relevant personnel to the scene to cooperate and assist the fire department of the public security organ to carry out fire accident investigation. Article 15 The realty service enterprise shall conduct regular fire prevention publicity and education for merchants, residents and other personnel by posting propaganda slogans and setting up advertising columns, so as to improve their abilities of investigating and eliminating fire hazards, fighting initial fires, organizing evacuation and escape, and publicity and education.
