Land occupation is obviously a kind of construction behavior, which must be approved by the planning department in advance and go through the relevant formalities. Therefore, the act of "heightening" without authorization is illegal, and the heightening part is illegal construction.
In China's Property Law and General Principles of Civil Law, it is clearly stipulated that the infringement treatment and compensation for lighting and ventilation should be handled: "The neighboring parties of real estate should correctly handle the neighboring relations in terms of water interception, drainage, transportation, ventilation and lighting in the spirit of benefiting production, facilitating life, solidarity and mutual assistance, and fairness and rationality. If it causes obstacles or losses to the neighboring parties, the infringement shall be stopped. If it has caused the result of obstructing the normal life of others, it should be dismantled as soon as possible and restored to its original state. If it has caused economic losses to others, it should also compensate for the losses according to law. " Unauthorized "heightening" not only violates the neighboring rights of owners such as ventilation and lighting, but also violates the relevant provisions of the Urban Planning Law. Therefore, the construction should be stopped as soon as possible, the illegal buildings should be demolished and the original state should be restored.
