Chapter II Production

Tenth elevator installation, renovation and maintenance, must be carried out by the manufacturing unit or its entrusted units with corresponding qualifications. The entrusted unit shall not entrust or entrust the elevator installation, renovation and maintenance business in disguised form.

Original manufacturing unit

If the manufacturing license of the corresponding type of elevator has been cancelled or is no longer valid, the use management unit may entrust a unit with corresponding qualifications to carry out renovation or maintenance with the consent of the elevator owner. Chapter III Utilization

(four) the lease of places equipped with elevators, the lease contract shall stipulate the elevator use management unit; If there is no agreement or the agreement is unclear, the owner of the elevator is the elevator use management unit.

Seventeenth elevator management units shall, within 30 days from the date of putting the elevator into use, go through the registration formalities with the special equipment safety supervision and management department and obtain the elevator use registration certificate.

If the elevator use management unit is changed, the new elevator use management unit shall go through the registration formalities with the special equipment safety supervision and management department within 30 days from the date of change.

If the elevator is scrapped, the elevator use management unit shall go through the cancellation registration formalities with the special equipment safety supervision and management department within 30 days.

Within the validity period of the elevator use sign, if the use sign is damaged, lost or the relevant information changes, the use management unit shall apply to the special equipment inspection agency for a new elevator use sign; If the maintenance unit is changed, the use management unit shall apply for a new elevator use sign with the maintenance contract within 15 days from the date of the maintenance unit change.

Eighteenth elevator use management units shall apply to the special equipment inspection agency for regular inspection before the expiration of the elevator inspection period 1 month, and elevators that have not been regularly inspected or failed to pass the inspection shall not continue to be used.

Nineteenth elevator management units shall perform the following safety management duties:

(a) to establish and strictly implement the elevator safety operation management system and establish a complete elevator safety technical file;

(two) the establishment of elevator safety management institutions in accordance with the provisions or equipped with elevator safety management personnel with corresponding qualifications;

(3) Entrust an elevator maintenance unit that has obtained the qualification according to law to carry out the daily maintenance of the elevator, and sign a maintenance contract with the validity period covering the inspection period;

(six) to supervise and cooperate with the installation, renovation and maintenance of the elevator, and arrange the safety management personnel to supervise and confirm the maintenance work of the maintenance unit on the spot;

(seven) when the elevator is out of use, the elevator hidden danger sign shall be posted in a prominent position, and the elevator production and maintenance units shall be organized in time to eliminate the hidden danger, and report to the district special equipment safety supervision and management department;

(eight) when the elevator passengers are trapped, they should take prompt measures to comfort the trapped people and organize the implementation of rescue. If you don't have the emergency rescue conditions, you should immediately notify the elevator maintenance unit to rush to the scene to carry out rescue;

(nine) to formulate emergency plans and exercise regularly;

(ten) other safety management responsibilities as stipulated by laws, regulations and safety technical specifications.

Twentieth airports, docks, stations, rail transit stations, pedestrian overpasses, pedestrian underpasses and other public transport places, the use management unit shall entrust the manufacturing unit or a unit with corresponding qualifications agreed by the manufacturing unit to carry out maintenance; During the peak hours of passenger flow, the use management unit shall arrange special personnel to be on duty in key positions to divert passenger flow and guide passengers to take the ladder safely.

Article 21 The elevators provided by hospitals for patients, passenger elevators with a speed greater than 2.5 meters per second that are directly used for sightseeing, and other elevators that must be operated by elevator drivers according to the requirements of elevator safety technical specifications shall be operated by elevator drivers with elevator operator certificates.

Article 22 The use management unit shall reasonably allocate safety management personnel according to the number of elevators it manages, with 1 person for every 50 elevators, or at least 1 person for less than 50 elevators.

The use management unit shall urge the elevator safety management personnel to perform the following duties:

(a) the elevator management personnel shall patrol at least 1 time every day, and truthfully record the daily use of the elevator, which shall be kept for at least 2 years;

(three) to cooperate with the elevator installation, renovation, maintenance, inspection and testing, and assist the construction unit to implement safety protection measures;

(four) to cooperate with the maintenance unit to carry out the work, and sign the maintenance record of the maintenance unit;

(five) if it is found that there are hidden dangers in elevator operation and it is necessary to stop using it, it shall decide to stop using it and report to the person in charge of the unit immediately;

(six) after receiving the fault alarm, immediately rushed to the scene to organize the implementation of rescue, do not have the ability of emergency rescue, it should immediately notify the elevator maintenance unit to rush to the scene to implement rescue.

Twenty-third property services companies as residential elevator management units, elevator daily operation and maintenance costs from the property management costs. Chapter IV Maintenance

Twenty-ninth elevator maintenance units shall establish a 24-hour duty system and set up emergency rescue telephones. After receiving the report that the elevator passengers are trapped, the elevator maintenance unit shall arrive at the scene in time to carry out rescue; After the rescue, passengers should report to the district special equipment safety supervision and management department within 24 hours.

Chapter V Inspection and Safety Evaluation

Chapter VI Supervision and Administration

Thirty-fifth city special equipment safety supervision and management department shall formulate the annual inspection plan for elevator safety supervision and report it to the Municipal People's government for the record. District special equipment safety supervision and management department shall, according to the annual inspection plan, conduct daily supervision and inspection of elevator production, use, maintenance and inspection and testing institutions in accordance with relevant regulations.

Article 39 After an elevator accident occurs, the user management unit shall organize risk removal and rescue, protect the scene of the accident, and report to the district special equipment safety supervision and management department and other relevant departments in time. After receiving the elevator accident report, the district special equipment safety supervision and management department shall immediately rush to the scene to verify the situation and report it according to the regulations.

The municipal special equipment safety supervision and management department shall, in accordance with the law, jointly investigate the general accidents with the supervision, public security and other organs and trade unions, and report the investigation report to the Municipal People's government. The handling of major accidents shall be carried out in accordance with relevant state regulations.

Fortieth District People's Government shall establish special funds for elevator safety emergency for elevator emergency and accident handling under special circumstances.

Chapter VII Legal Liability

Article 45 If the user management unit fails to perform its management duties and violates the provisions of Article 17, Item 2 to Item 5, Item 7 of Article 19, Item 1 of Paragraph 2 of Article 22 and Article 25, the district special equipment safety supervision and management department shall order it to make corrections within a time limit; If no correction is made within the time limit, a fine ranging from 1000 yuan to 5,000 yuan shall be imposed.

Forty-sixth hospitals and other elevator management units in violation of the provisions of article twenty-first, the district special equipment safety supervision and management department shall order them to make corrections within a time limit; If no correction is made within the time limit, a fine ranging from 1000 yuan to 5,000 yuan shall be imposed.

Forty-seventh property services companies in violation of the provisions of article twenty-third, the district housing security housing management department shall be ordered to make corrections within a time limit; Overdue correction, by the district housing security housing management department credited to the property service enterprise credit information files.

Forty-eighth elevator maintenance units in violation of the provisions of the first paragraph, second paragraph, third paragraph and twenty-ninth of this Ordinance, the district special equipment safety supervision and management department shall order them to make corrections within a time limit; If no correction is made within the time limit, a fine ranging from 1000 yuan to 5,000 yuan shall be imposed.

Article 49 If an elevator maintenance unit violates the provisions of Item 4, Item 5 and Item 6 of Article 27 of these Measures, the district special equipment safety supervision and management department shall order it to make corrections within a time limit and impose a fine of 6,543,800 yuan and 20,000 yuan.

Fiftieth elevator maintenance units in violation of the provisions of article thirtieth of these measures, the municipal special equipment safety supervision and management department shall order them to make corrections within a time limit; If no correction is made within the time limit, a fine ranging from 1000 yuan to 5,000 yuan shall be imposed.

Fifty-first special equipment inspection agencies in violation of the provisions of article thirty-first, article thirty-second, the municipal special equipment safety supervision and management department shall order it to make corrections within a time limit; If no correction is made within the time limit, a fine ranging from 1000 yuan to 5,000 yuan shall be imposed.

Fifty-second in violation of the provisions of these measures, special equipment safety supervision and other administrative departments and their staff have one of the following acts, by the higher authorities or supervisory organs to the directly responsible person in charge and other directly responsible personnel shall be punished according to law:

(1) Renovation refers to the activity of changing the main stress structure, mechanism (transmission system) or control system of the original elevator through replacement, adjustment and installation, which leads to the change of elevator performance parameters and technical indicators.

(2) Repair refers to the activities of replacing the original parts with new parts or disassembling, processing and repairing the original parts without changing the original performance parameters and technical indexes of the elevator. The specific scope is determined in accordance with the relevant provisions of the state.

(3) Daily maintenance refers to the activities of cleaning, lubricating, inspecting, adjusting and replacing wearing parts of elevators in order to ensure that the elevators meet the requirements of corresponding safety technical specifications and standards.

(4) Elevator failure refers to the event that the specified function is lost or the safety is endangered for some reason during the use of the elevator, such as the abnormal action of the control system or electromechanical components of the elevator and the action of the safety protection device, which leads to the elevator stopping, being trapped, rushing to the top, squatting, etc.

(5) Safety evaluation refers to the activity that the evaluation institution accepts the entrustment of the entrusting party, analyzes and evaluates the risks existing in one or more links such as equipment ontology, use management and daily maintenance, and puts forward reasonable and feasible safety countermeasures for the purpose of realizing elevator safety.

Article 54 These Measures shall come into force on March 1 day, 2065.
