Is it illegal for property maintenance fund owners not to sign?

Legal analysis: maintenance fund is different from property management fee, and there is a qualitative difference between them. The nature of the maintenance fund is the special funds paid by the owners according to the regulations, which are mainly used for the maintenance of the property. Property management fee is the service fee charged by the property management company. Property management companies have no right to decide the collection and use of maintenance funds. Of course, the owners' committee can entrust a property management company to manage it. However, if the property company accepts the entrustment, it shall designate a special person as the manager of fund management and implement it according to the plan and scheme of the owners' committee. It shall be reported to the owners' committee in writing before each use, and shall be reported in writing after use, and shall be published and posted to the owners regularly with the use of property management fees.

Legal basis: Article 281 of the Civil Law of People's Republic of China (PRC), the maintenance fund of the building and its ancillary facilities belongs to the owner. With the consent of the owner, it can be used for local maintenance, renewal and transformation of elevators, roofs, external walls and barrier-free facilities. The collection and use of maintenance funds for buildings and their ancillary facilities shall be announced regularly. In case of emergency, if the building and its ancillary facilities need to be repaired, the owners' assembly or the owners' committee may apply for the maintenance funds of the building and its ancillary facilities according to law.
