Regulations of Lhasa Municipality on the Administration of City Appearance and Environmental Sanitation

Chapter I General Provisions Article 1 In order to strengthen the administration of city appearance and environmental sanitation, create a clean and beautiful city environment and safeguard people's health, these Regulations are formulated in accordance with the Regulations of the State Council Municipality on the Administration of City Appearance and Environmental Sanitation and in light of the actual situation of this Municipality. Article 2 These Regulations shall apply to the urban built-up areas of this Municipality, the towns where the people's governments of counties (districts) are located and other areas where urbanization management is implemented. Article 3 The work of city appearance and environmental sanitation shall follow the principles of unified leadership, graded responsibility, departmental management, public participation and social supervision. Article 4 The Municipal People's Government shall exercise unified leadership over the work of city appearance and environmental sanitation in this Municipality.

The municipal competent department of city appearance shall be responsible for the management of city appearance and environmental sanitation, and organize the implementation of these regulations.

County (District) people's government shall lead the work of city appearance and environmental sanitation within their respective administrative areas.

County (District) municipal administrative departments responsible for the county (District) city appearance and environmental sanitation management.

Township (town) people's governments and sub-district offices shall be specifically responsible for the supervision and management of city appearance and environmental sanitation within their respective jurisdictions. Fifth city and county (District) urban management law enforcement departments shall, in accordance with their duties, impose administrative penalties on violations of city appearance and environmental sanitation in accordance with these regulations. Sixth public security, housing and urban and rural construction, land and resources planning, environmental protection, health, industry and commerce, forestry and greening departments should do a good job in the management of city appearance and environmental sanitation according to their respective responsibilities. Seventh city appearance, radio and television, education, culture, health and other departments should strengthen publicity and education of city appearance and environmental sanitation, and constantly improve citizens' awareness of city appearance and environmental sanitation. Eighth city and county (District) people's governments shall encourage scientific and technological research and innovation in the field of city appearance and environmental sanitation, and popularize and apply advanced technologies.

Encourage social funds to enter the field of city appearance and environmental sanitation, and gradually realize the marketization and socialization of environmental sanitation facilities construction and professional operation services. Article 9 All units and individuals have the obligation to maintain the city appearance and environmental sanitation, and shall not hinder or obstruct the city appearance and environmental sanitation staff from performing their official duties, and have the right to discourage and report acts that damage or destroy the city appearance and environmental sanitation. Tenth urban management law enforcement departments of the people's governments at or above the county level and their staff shall perform their duties of supervision and management in accordance with the law, strictly, fairly and civilly enforce the law, and shall not abuse their powers to damage the legitimate rights and interests of the management counterparts.

The supervisory organs of the people's governments at or above the county level shall carry out administrative supervision over the urban management law enforcement departments and their staff according to law. Eleventh people's governments at or above the county level urban management law enforcement departments to implement the law enforcement responsibility system and fault investigation system.

Complaints about urban management law enforcement or urban management law enforcement violations shall be investigated by the municipal administrative department within three working days, and the results of the investigation and handling shall be informed to the complainant. Twelfth units and individuals that have made outstanding contributions to the city appearance and environmental sanitation shall be commended and rewarded by the people's government of the city or county (District) or the municipal competent department of city appearance. Chapter II Responsibility of City Appearance and Environmental Sanitation Article 13 The municipal competent department of city appearance shall perform the following duties:

(a) the preparation of the administrative area of the city appearance and environmental sanitation planning;

(two) to formulate standards and norms for environmental health professional operations;

(three) to organize the implementation of the specific work of city appearance and environmental sanitation;

(four) to supervise and inspect the city appearance and environmental sanitation work within their respective administrative areas;

(5) Other duties as prescribed by law. Fourteenth city appearance and environmental sanitation work to implement the responsibility system. Units and individuals living in the area under their jurisdiction shall do a good job in the work of city appearance and environmental sanitation in the area of responsibility for city appearance and environmental sanitation.

The area of responsibility for city appearance and environmental sanitation refers to the buildings, structures or other facilities, places owned, used or managed by units and individuals and their areas within a certain range. The responsible persons in the following areas shall be determined in accordance with the following provisions:

(a) urban roads, squares, pedestrian underpasses and ancillary facilities shall be the responsibility of the responsible units and cleaning operation units in accordance with the division of responsibilities, of which the construction units shall be responsible for the roads under construction and the roads that have not been accepted and opened to traffic;

(two) residential streets by the neighborhood offices or township (town) people's government is responsible for;

(three) the implementation of property management in residential areas, the property management unit is responsible for;

(four) markets, exhibitions and other places, the management unit is responsible for;

(five) rivers, canals, reservoirs and their affiliated areas, by the management unit;

(6) The construction unit shall be responsible for the construction site; Has not yet been built, by the construction unit or the construction unit is responsible for;

(seven) responsible for the management and maintenance of urban green space;

(eight) tourist attractions and parks shall be in the charge of business units or management units;

(nine) the area of responsibility of organs, organizations, military units, universities, enterprises and institutions, with the adjacent intersection line as the boundary, the front wall is within the sidewalk kerb, and the unit is responsible for it.

Street vendors are responsible for the city appearance and environmental sanitation in front of the door in accordance with the three guarantees.

If the person responsible for city appearance and environmental sanitation is not clear, it shall be determined by the local city appearance department.
