The term "urban residential property" as mentioned in these Measures refers to the houses and related facilities, equipment and venues in urban residential areas.
The term "property management" as mentioned in these Measures refers to the activities of property management enterprises to manage properties according to property management contracts and provide services for owners and users. Article 3 These Measures shall apply to the property management of urban residential areas within the administrative area of Dalian.
New urban residential areas and existing residential areas with complete facilities should implement property management; The original residential areas in the city with incomplete supporting facilities should be rectified and gradually create conditions to implement property management. Article 4 Dalian Real Estate Management Bureau and the real estate management departments of counties (cities), Lushunkou District, Jinzhou District, Dalian Economic and Technological Development Zone, Dalian Hi-tech Industrial Park and Dalian Jinshitan National Tourism Resort are the administrative departments in charge of property management within their respective jurisdictions.
City and county (city), District, Dalian Economic and Technological Development Zone, Dalian Hi-tech Industrial Park, Dalian Jinshitan National Tourism Resort Property Management Office, specifically responsible for the daily management of property management within their respective jurisdictions.
The relevant government departments and sub-district offices shall assist the administrative departments of property management to do a good job in property management, and guide, coordinate and supervise property management within their respective functions and powers. Chapter II Owners' Congress and Committee Article 5 The owners' committee is a mass organization for owners of urban residential areas to manage their own properties. The owners' committee is elected by the owners' congress or the owners' congress (hereinafter referred to as the owners' congress). Article 6 The owners' meeting is composed of all owners in the property management area; If there are a large number of owners, the owners' representatives may be elected in proportion to form the owners' meeting.
Users of public houses can elect representatives of property users in proportion, attend the owners' meeting as nonvoting delegates and exercise voting rights related to property users. Article 7 If the sales rate of public houses in the original residential area with complete facilities and equipment reaches more than 40%, and the sales occupancy rate of new residential areas reaches more than 50% of the total number of units, the original property owner or the development and construction unit shall organize the property owner to convene the owners' meeting under the coordination and guidance of the property management administrative department within 3 months after reaching the specified conditions. Eighth owners' meeting shall be held only when more than two-thirds of the owners with voting rights or representatives of owners and property users are present.
The decision made by the owners' congress shall be adopted by more than half of the owners or owners' representatives and property users with voting rights, and shall take effect after being announced in the property management area. Article 9 The owners' meeting shall be held every year 1 time. Upon the proposal of more than 20% owners or owners' representatives, or when the owners' committee deems it necessary, an interim owners' meeting may be convened.
When the owners' meeting is held, the property management administrative department, local neighborhood offices, public security police stations and other relevant units shall be invited to participate. Article 10 The functions and powers of the owners' congress:
(a) to review the owners' convention and the articles of association of the owners' committee;
(2) Electing or re-electing the owners' committee, and adding or replacing the members of the owners' committee;
(three) to listen to and consider the work report and financial report of the owners' committee on property management, and modify or cancel the inappropriate decisions of the owners' committee;
(four) to consider the entrustment method of the property management enterprise;
(five) to decide other related matters of property management. Article 11 The members of the owners' committee elected by the owners' congress are composed of 7 to 13 people, with a director 1 person and a deputy director 1 to 2 people. The director and deputy director are elected from the members of the owners' committee.
The term of office of the owners' committee is 3 years, and the chairman, vice-chairman and members can be re-elected.
Before the expiration of the term of office of the owners' committee, a general election shall be organized to produce a new owners' committee. Article 12 The rights of the owners' committee:
(a) the selection of property management companies, the signing, alteration or termination of property management contracts;
(two) to consider the annual work plan and cost budget of the property management enterprise;
(three) to inspect and supervise the property management of property management enterprises;
(four) to consider the charging standards and usage of property management services;
(five) responsible for the collection and management of maintenance funds;
(six) to supervise the use of public buildings, facilities, equipment and property management offices and business premises;
(seven) other rights granted by the owners' congress.
