Chapter I General Provisions Article 1 In order to promote the planning and construction of motor vehicle parking lots (garages) in this Municipality, standardize the management of parking lots (garages), meet parking demand, improve traffic conditions and ensure the coordinated development of urban traffic, Zhejiang Province has implemented the Road Traffic Safety Law of the People's Republic of China, the Urban and Rural Planning Law of People's Republic of China (PRC) and the Road Traffic Safety Law of the People's Republic of China. Article 2 These Measures shall apply to the planning, construction, use and related management activities of motor vehicle parking lots (garages) within the urban area of Hangzhou. Article 3 Motor vehicle parking lots (garages) as mentioned in these Measures (hereinafter referred to as parking lots) refer to various outdoor or indoor places where motor vehicles are parked. Article 4 Parking lots mentioned in these Measures include public parking lots, special parking lots and road parking spaces.

The term "public * * * parking lot" as mentioned in these Measures refers to the parking lot that is open to the society and provides parking services for unspecified objects, including the public * * * parking lot built separately and the public * * * parking lot built with supporting standards of super construction projects.

The term "special parking lot" as mentioned in these Measures refers to the parking lot that provides parking services for a specific object or a specific range of objects, including the special parking lot for the construction of public buildings and residential buildings, as well as the parking spaces set up on the roads or other sites owned by the owners within the building division.

The term "road parking spaces" as mentioned in these Measures refers to the parking places for motor vehicles set up on urban roads according to law, including free parking spaces and paid parking spaces. Article 5 The Municipal People's Government shall strengthen the unified leadership over the construction and management of urban parking lots and establish a comprehensive coordination mechanism for the construction and management of parking lots.

The municipal construction administrative department is the administrative department in charge of parking lot construction, responsible for the daily work of the comprehensive coordination mechanism for parking lot construction and management, and undertaking the organization, coordination, assessment and related supervision and management of parking lot construction activities.

The municipal administrative department of urban management is the administrative department in charge of parking lot management, responsible for the guidance, service, supervision and management of parking lot operation and maintenance activities, and promoting the utilization and convenient use of parking spaces.

The municipal planning and natural resources administrative department is responsible for the planning and land management of parking lots.

The municipal housing security administrative department is responsible for urging the property service enterprises to do a good job in the daily management of the special parking lot in the property management area in accordance with the provisions of the property service contract.

Development and reform, traffic management of public security organs, data resource management, fire rescue, ecological environment, civil air defense, market supervision, finance and other relevant departments shall, according to their respective responsibilities, coordinate the implementation of these measures. Article 6 The construction of public * * * parking lots shall be under the unified leadership and planning of the Municipal People's Government, and classified financing, construction and management shall be implemented at the municipal and district levels.

The construction of public parking lots adopts the mode of coexistence of government investment and social forces investment, and encourages and guides social forces to invest while government funds continue to invest. Article 7 The Municipal People's Government encourages social forces to invest in the construction and operation of public parking lots, and provides policy support for social forces to invest in the construction of public parking lots in terms of planning, construction and operation in accordance with the principle of "whoever invests benefits", and formulates relevant preferential policies such as tax reduction and exemption and government subsidies.

Specific measures to encourage social forces to invest in the construction and operation of public parking lots shall be formulated separately by the municipal construction administrative department in conjunction with the relevant municipal departments and implemented after being approved by the Municipal People's government. Article 8 The municipal and district people's governments shall arrange special funds for the construction of public parking lots. The municipal and district financial departments shall ensure that the public parking lot subsidy funds invested by social forces and the public parking lot construction funds invested by cities and districts are allocated in time according to their respective fund allocation methods. Chapter II Planning and Construction of Parking Facilities Article 9 When organizing the preparation of special planning for urban parking facilities, the municipal planning and natural resources administrative department shall adhere to the principle of differentiated supply of facilities and regulation and management of parking demand, determine the overall development strategy, supply system and layout and scale of parking facilities, fully consider the connection of parking facilities system with urban transportation hub and urban rail transit interchange station, and set up parking and interchange facilities in combination with urban rail transit network and bus hub. For areas with insufficient parking facilities, appropriate public parking land should be planned within a reasonable service radius to make up for the lack of parking facilities. Tenth municipal planning and natural resources administrative departments shall, when organizing the preparation of regulatory detailed planning, implement the location of public parking lots according to the relevant requirements of the special planning of urban parking facilities. Article 11 The municipal construction administrative department shall, according to the special planning and regulatory detailed planning of urban parking facilities, formulate the annual special planning of public parking lot construction in conjunction with the administrative departments of development and reform, finance and urban management, and incorporate it into the urban construction planning system at all levels in this Municipality. Twelfth public parking lots can be built by using the ground, ground or underground space according to law. Public parking lots that meet the catalogue of allocated land can allocate land; Those that do not meet the requirements shall be used for compensation according to law.

The land for public parking lots can only be held as a whole, and may not be registered or transferred separately, and its parking spaces may not be sold separately or in disguised form in the form of long-term lease.
