He himself does not accept the management of the property management company.

As a property manager, how do you solve Mr. Yang's problem? Does the property company have any responsibility in the theft case, and how big is the responsibility?

The answer is as follows:

On the first question:

First of all, as a shopkeeper, the theft of his shop belongs to a criminal case, so he should call the police at the first time and request the public security organ to file a case to solve the case. He should not ask the property company to bear its losses without reason, so the property company does not have to bear any responsibility.

Except in one case, for example, the property management contract signed by the property management company and Mr. Yang clearly states that the owner was stolen, or Mr. Wang issued a certificate to prove that there were obvious faults or mistakes in the property management process, which directly led to theft. You can try to negotiate with the property management company to make the property compensate for some of the losses, or in other words, as a property management company, you should take the initiative to bear some of the losses appropriately.

On the second question:

It is inappropriate for Mr. Yang to ask for a price reduction on the grounds that the property fee is too high. As a property manager, the solution is to issue the property fee pricing approval documents of the industrial and commercial bureau, the price bureau and other departments, and dispel his thoughts and ideas of asking for price reduction at will with legal relevant documents and procedures. If there are legal procedures, Mr. Yang has no right to question the pricing power of the property company.

In addition, Mr. Yang asked the property management company to cancel the management right on the grounds that the owners' committee was not established. You can explain to him that according to the regulations, 50% of the houses are to be sold and delivered, which is one of the conditions. The second condition is that the first house should be sold and delivered for more than two years, and the owners' Committee can only be established if it is fully satisfied. Mr. Yang entered the project in August 2008, less than two years after the second case analysis, so he did not have the conditions to set up the owners' committee.

Furthermore, this property management company was originally appointed. On the third point:

Mr. Yang reflected that the cleaning operation was not clean. First of all, it depends on the commitment and standard of the property company to cleaning service in the property service contract. If the property reaches the cleaning standard agreed in the contract, the property is not responsible.

If the security attitude is not good, you can ask Mr. Yang to issue a certificate of the relevant incident. If there is such a thing, the property management company should punish the security guard on duty.

As for the project, the maintenance personnel charge is also reasonable, because Mr. Yang is engaged in catering, and there are often problems such as blockage of his own sewer pipe. If it belongs to Mr. Yang's personal use, there is no doubt about the charge, but it should be noted that the property management company should have an open service charge standard and clearly mark the price.

Advertising in the public area needs to be paid, because the public area is shared by all owners and cannot be used by Mr. Yang himself. According to the principle of taking it from the people and using it for the people, it is completely reasonable if it is approved by the relevant departments.
