Regulations of Anhui Province on Property Management
The term "property management" as mentioned in these Regulations refers to the activities of the owners and the property management enterprises they choose to maintain, conserve and manage the houses, supporting facilities and related sites in accordance with the provisions of the property service contract, and maintain the environmental sanitation and order in the relevant areas. The construction administrative department of the third provincial people's government is responsible for the supervision and management of property management activities within the administrative area of this province.
City, county (city) people's government real estate administrative departments responsible for the supervision and management of property management activities within their respective administrative areas. The District People's Government shall determine a department responsible for the supervision and management of property management activities within its administrative area.
Other relevant departments of the people's governments at or above the county level shall, in accordance with their respective division of responsibilities, cooperate closely and do a good job in relevant management and supervision. Fourth people's governments at or above the county level shall support the property management industry to gradually establish a professional, socialized and market-oriented property management mechanism to improve the level of property management.
Property management enterprises enjoy preferential policies for the tertiary industry in accordance with relevant national and provincial regulations. Fifth street offices and Township People's governments shall assist the relevant administrative departments to supervise property management activities and coordinate the relationship between property management and community construction.
Residents' committees, villagers' committees and owners' congresses, owners' committees and property management enterprises shall, according to their respective responsibilities, support and cooperate with each other and do a good job in community management, community service and property management. Chapter II Owners, Owners' Congress and Owners' Committee Article 6 The owner of a house is the owner.
All owners in the property management area form the owners' meeting, and the owners' committee is elected as the executive body of the owners' meeting. The owners' congress represents and safeguards the legitimate rights and interests of all owners in the property management activities within the property management area. Seventh owners shall enjoy the following rights in addition to the rights stipulated in the "Regulations on Property Management" of the State Council:
(a) to put forward suggestions or questions to the owners' committee and the property management enterprise;
(two) the election of representatives of the owners, enjoy the right to be elected;
(three) to enjoy the right to use the property parts and facilities according to law;
(four) require other owners and property users to stop infringing on the interests of * * * *.
In addition to fulfilling the obligations stipulated in the State Council's "Regulations on Property Management", the owners should also cooperate with and support the property management activities implemented by property management enterprises in accordance with the owners' convention, property management service contract and property management system. Eighth owners' congress in addition to perform the duties stipulated in the "Regulations" of the State Council, but also exercise the following functions and powers:
(a) to decide on major issues involving the interests of the owners in the property management area;
(two) to approve the articles of association of the owners' committee;
(three) to listen to and consider the work report of the owners' committee;
(four) to change and cancel the inappropriate decisions of the owners' committee;
(five) to examine and approve the working funds of the owners' committee. Article 9 The owners' committee shall perform the following functions and powers in addition to the duties stipulated in the Regulations of the State Council Municipality on Urban Property Management:
(a) approved by the owners' meeting, to consider the management plan, supporting projects and major maintenance projects in the property management area formulated by the property management enterprise;
(two) with the consent of the owners' meeting, consider the charging standard of property management service fees in the property management area.
The owners' committee shall perform the following obligations:
(a) the implementation of the resolutions and decisions of the owners' congress;
(2) Abide by and perform the realty service contract;
(three) support and cooperate with the legitimate business and management activities of property management enterprises;
(four) to supervise and stop the illegal and improper behavior of property management enterprises. Tenth a property management area to set up an owners' meeting.
The division of property management areas shall fully consider the factors such as facilities and equipment, building scale, community construction, scale operation, convenient management and reducing management costs, and shall be carried out in accordance with the following provisions:
(a) new residential areas, including construction by stages or by more than two units, should be divided into a property management area according to the overall planning and design scope of the community;
(2) Non-residential properties in newly-built residential areas shall be divided into the same property management area as residential areas;
(3) If the scale of residential buildings is less than 20,000 square meters, several residential areas can be divided into one property management area according to the area surrounded by natural boundaries such as streets and roads;
(4) Commercial, office, hospital, school, factory, warehouse and other non-residential properties and single commercial and residential buildings with independent facilities and equipment can be closed for management and divided into a property management area.
Residential properties that have been built and managed before the implementation of these regulations can continue to be used as independent property management areas. Article 11 When preparing for the establishment of the owners' meeting, the owners' representative, the construction unit and the residents' committee at the location of the property shall form a preparatory group for the owners' meeting under the guidance of the property management administrative department of the people's government at the county level where the property is located, and be responsible for the preparations for the owners' meeting. The list of members of the preparatory group of the owners' congress shall be published in writing within the property management area.
The preparatory group of the owners' congress shall organize the owners to hold the first meeting of the owners' congress within 30 days from the date of composition. The first meeting of the owners' congress shall generally formulate the owners' convention and the rules of procedure of the owners' congress, and elect the owners' committee.
