Regulations of Suzhou Municipality on Property Management in Residential Areas

Chapter I General Provisions Article 1 In order to regulate the property management activities in residential areas, safeguard the legitimate rights and interests of the parties and create a good living environment, these Regulations are formulated in accordance with the People's Republic of China (PRC) Property Law, the the State Council Property Management Regulations, the Jiangsu Property Management Regulations and other laws and regulations, combined with the actual situation of this Municipality. Article 2 These Regulations shall apply to the property management activities of residential areas within the administrative area of this Municipality. Article 3 An owner may entrust a property service enterprise to implement professional and market-oriented property management, or manage the property by himself. Fourth city and county-level city and district real estate administrative departments are responsible for the management and supervision of property management activities within their respective administrative areas.

Neighborhood offices (Town People's Government) shall perform the relevant duties stipulated in these Regulations, coordinate the relationship between property management and community construction, and assist the real estate administrative departments to guide and supervise property management.

City and county-level city and district people's governments and their planning, construction, urban management, environmental protection, industry and commerce, price, landscaping, finance, public security and other relevant administrative departments shall, according to their respective functions and duties, do a good job in the supervision and management of property management. Article 5 The Property Management Association is a self-regulatory organization in the property service industry, which is mainly responsible for formulating the code of conduct in the property service industry, organizing professional training for employees in the property service industry, mediating internal disputes in the industry, and handling other matters entrusted by the real estate administrative department. Chapter II Owners, Owners' Congress and Owners' Committee Article 6 In property management activities, owners shall enjoy the following rights:

(1) Accepting the services provided by the realty service enterprise according to the stipulations of the realty service contract, and using the parts and facilities of the realty according to law;

(two) to enjoy the right to vote and be elected by the owners' representatives and members of the owners' committee;

(three) to participate in the meeting of the owners' congress and exercise the right to vote;

(four) to propose the convening of the owners' congress or the owners' congress (hereinafter referred to as the owners' congress) and put forward suggestions on the relevant matters of property management;

(five) have the right to know and supervise the use of * * parts of the property, * * facilities and equipment, related sites and special maintenance funds;

(six) to supervise the owners' committee and the realty service enterprise to perform the realty service contract;

(seven) require other owners and non-owners to stop infringing on public interests;

(eight) other rights stipulated by laws and regulations.

In the property management activities, the owners shall perform the following obligations:

(1) Abide by the temporary management statute, management statute and the rules of procedure of the owners' (representatives') meeting (hereinafter referred to as the rules of procedure of the meeting), and support the realty service enterprises to implement realty management activities in accordance with the realty service contract and the realty management system;

(two) abide by the rules and regulations of the use of * * * parts and facilities, the maintenance of public order and environmental sanitation in the property management area;

(three) to implement the decisions of the owners (representatives) congress and the decisions made by the owners' committee authorized by the owners' committee;

(four) to pay the property service fee on time, and shall not default or refuse to pay;

(five) in accordance with the relevant provisions of the state to pay special maintenance funds;

(six) shall not harm the public interest and the legitimate rights and interests of others;

(seven) other obligations stipulated by laws and regulations. Article 7 The owners' (representatives') meeting shall be established in the property management area, and the property management shall be implemented by the property service enterprises. The above-ground and underground buildings, facilities and equipment and related sites within the same property management area shall not be managed separately. The owners' meeting is composed of all owners in the property management area.

If the number of owners is small and it is decided not to set up the owners' meeting with the unanimous consent of all owners, all owners shall perform the duties of the owners' meeting.

If the number of owners exceeds 100, the owners may decide to set up an owners' meeting to perform the duties of the owners' meeting. Article 9 The owners' congress is composed of representatives elected by the owners in proportion. Generally, there are not less than 30 owners' representatives, and each building has at least one owner's representative.

Before attending the owners' meeting, the owners' representatives shall solicit the opinions of the owners they represent in writing on the matters to be discussed at the owners' meeting; If all the owners need to vote, the votes for, against and abstention of the owners shall be signed by the owners' representatives and submitted to the owners' meeting. Article 10 The first meeting of owners (representatives) shall be held if the property management area meets any of the following circumstances:

(a) the construction area of the delivered property has reached more than 50% of the construction area of the property management area, or reached 30% but less than 50%, but it has been delivered for more than one year;

(two) the residential area developed by stages in the same property management area, the property construction area has not reached 30%, but it has been delivered for more than two years. Under the guidance of the real estate administrative department, the preparatory work for the first owners' (representatives') meeting shall be organized and recommended by the neighborhood office (town people's government) where the property is located.

Property management area in line with the provisions of article tenth, the construction unit and the early realty service enterprise shall promptly inform the street office (Town People's Government) in writing. Street offices (Town People's Government) shall, within 30 days from the date of receiving the written notice, be responsible for organizing, guiding and coordinating the establishment of the preparatory group for the first owners' (representatives) meeting. Without timely written notice, the street office (town people's government) shall take the initiative to organize, guide and coordinate the establishment of the preparatory group for the first owners (representatives) conference.

The number of the preparatory group is an odd number of five to nine people, including one representative from the sub-district office (Town People's Government) and one representative from the construction unit. The head of the preparatory group is the staff of the sub-district office (Town People's Government). After the list of members of the preparatory group is determined, it shall be announced in the property management area.

The construction unit and the prophase realty service enterprise shall provide the preparatory group with the list of owners, the construction area of the property, the delivery time of the property sale and other documents, and provide the necessary manpower and site support.

The expenses for the preparation and establishment of the first owners' (representatives') meeting shall be borne by the construction unit.
