Regulations of Chengdu Municipality on the Administration of Vegetable Bases

Chapter I General Provisions Article 1 These Regulations are formulated in accordance with the Land Administration Law of the People's Republic of China and other laws and regulations, combined with the actual situation in Chengdu, in order to ensure the vegetable supply of urban residents, develop vegetable production, stabilize the area of vegetable fields and strengthen the construction and management of vegetable bases. Article 2 These Regulations shall apply to the vegetable bases designated with the approval of the Municipal People's Government and the land planned as supplementary vegetable bases in Jinjiang District, Qingyang District, jinniu district, Wuhou District and chenghua district. Article 3 The Finance and Trade Office of Chengdu Municipal People's Government is in charge of the construction and management of vegetable bases in the whole city. District and Township People's governments are responsible for the construction and management of vegetable bases in their respective districts (townships).

Planning Commission, Agriculture Commission, Construction Commission, land, planning, agriculture and animal husbandry, food, second business and environmental protection departments shall, in accordance with the provisions of these regulations, do a good job in the construction and management of vegetable bases. Article 4 The layout and construction of vegetable bases must conform to the requirements of the overall urban planning, and the area of perennial vegetable bases shall be arranged and maintained according to the standard that the per capita non-agricultural population is not less than 2% of vegetable fields. Chapter II Protection Article 5 The protection of vegetable bases shall be strengthened according to the following grades:

(a) the permanent vegetable base designated by the Municipal People's Government and the land planned as a supplementary permanent vegetable base are first-class protected areas.

(two) the vegetable base within the scope of the city's recent development plan is a two-level protected area.

The planning map of vegetable base protection area shall be compiled and implemented by the competent department of vegetable base in conjunction with the Municipal Planning Bureau and the District People's Government. Article 6 Except for national key construction projects, no unit or individual may requisition or occupy vegetable fields in the first-class protected areas, and strictly control the requisition or occupation of vegetable fields in the second-class protected areas.

If it is really necessary to requisition or occupy vegetable fields in protected areas, it should be approved by the competent department of vegetable base in the city and submitted for approval according to legal procedures. Article 7 Any unit or individual who requisitions or occupies vegetable fields in vegetable bases must pay the new vegetable field development and construction fund, and no unit or individual may reduce or exempt it.

Requisition or occupation of vegetable fields in two protected areas, according to the requisition or occupation of vegetable fields in the first three years, six times the average annual output value per mu to pay the new vegetable field development and construction fund; Requisition or occupation of vegetable fields in first-class protected areas, and double payment of new vegetable field development and construction funds. Eighth new vegetable development and construction funds collected by the competent department of vegetable base, special storage, earmarking. For the construction and renovation of new and old vegetable fields, water conservancy construction, scientific research, promotion of new technologies, production and marketing service facilities and necessary management fees, the Municipal Finance Bureau and the Audit Bureau shall supervise. Ninth requisition or occupation of vegetable base, should implement the principle of first supplement and then use, arrange a certain number of turnover vegetable fields, to ensure that the area of perennial vegetable base is not reduced. The vegetable fields requisitioned or occupied every year shall be supplemented by the competent department of the municipal vegetable base in conjunction with the Municipal Agriculture Commission, the Agriculture and Animal Husbandry Bureau, the Land and Resources Bureau and the District People's Government. Article 10 The area of vegetable base is planned by the state, and vegetable farmers must ensure that enough vegetables are planted. The vegetable planting in the base is linked to the preferential materials provided by the state to vegetable farmers. It is strictly forbidden for any unit or individual to buy, sell or lease vegetable fields in protected areas, or to convert shares into shares by means of conversion or joint venture. Article 11 If the construction units and individuals requisition and occupy vegetable fields in protected areas and fail to start construction within six months after the official allocation by the land department (including the allocation of crops to be harvested), they shall pay the vegetable field waste fee. If it is barren for more than half a year but less than one year, it shall be paid at twice the average annual output value of the previous three years; If it is barren for more than one year and less than one and a half years, it will be paid at twice the average annual output value of the previous three years; If the land is deserted for more than one and a half years but less than two years, the land department shall report to the people's government at the same level for approval, recover the land and cancel the land use certificate in addition to paying the barren fee at three times the average annual output value of the previous three years. Twelfth units that cause pollution to vegetable bases must be treated within a time limit according to the provisions of the Environmental Protection Law of People's Republic of China (PRC). In the vicinity of the reserve, strictly control the new polluting projects. If it is really necessary to build a new building, there must be an environmental impact report approved by the Municipal Environmental Protection Bureau, and pollution prevention facilities and the main project should be designed and put into use at the same time.

Pesticides and other chemicals prohibited by the state from being used in vegetable fields are not allowed to be used in vegetable bases, and harmful waste residues and wastewater are not allowed to be dumped and discharged. Chapter III Construction Article 13 The construction of vegetable bases should rely on scientific and technological progress, strengthen scientific research, develop new varieties, popularize new technologies and improve yield and quality. Article 14 The permanent vegetable base shall carry out the construction of water system, roads and power supply in stages in a planned way, so as to realize water supply, electricity supply and access, and enhance the disaster resistance. Fifteenth strengthen soil improvement, improve soil fertility and multiple cropping index, improve the comprehensive production capacity of permanent vegetable bases, and use modern facilities to gradually realize production modernization. Article 16 District and Township People's governments shall establish a management and maintenance system for facilities such as canals, roads and power supply in vegetable bases, designate special personnel for management and regular maintenance, and keep the facilities in normal operation. Seventeenth vegetable base facilities construction and maintenance funds, according to the following ways to raise:

(1) Funds for new facilities in vegetable bases are raised from the new vegetable field development and construction fund;

(two) the daily management and maintenance of vegetable base facilities (except for projects damaged by serious natural disasters), from the township income and other channels to solve.
