Chapter II Fire Prevention of Chengdu Fire Protection Regulations

Article 6 The municipal, district (city) and county people's governments shall perform the following duties:

(a) to establish public security fire brigade and full-time fire brigade in accordance with the provisions of the state to enhance the ability of fire prevention, fighting and emergency rescue;

(two) to establish a joint meeting system for fire control work, and to study, coordinate and solve major problems in fire control work;

(three) to supervise and inspect the performance of fire safety duties by the relevant departments of the government at the same level;

(four) the public * * * fire facilities construction and fire control work business funds into the fiscal budget at the same level, to ensure capital investment;

(five) to organize relevant government departments to carry out targeted fire safety inspection and fire publicity and education;

(six) other fire safety duties as prescribed by laws and regulations.

Town (township) people's government, street offices shall organize and supervise the units in this area to do a good job in fire control; Guide, support and help community residents' committees and villagers' committees to carry out mass fire control work; Organize regular fire safety inspections to urge the elimination of fire hazards; Coordinate and cooperate with the handling of fire accidents.

Seventh fire control institutions of public security organs shall perform the following duties:

(a) to carry out fire supervision and inspection, and urge the rectification of fire hazards;

(two) responsible for the construction project fire design audit, fire acceptance, filing and spot checks, as well as public gathering places put into use, fire safety inspection before business;

(three) to determine the key units of fire safety within their respective administrative areas;

(four) responsible for the supervision and inspection of the use of fire protection products;

(five) to carry out fire safety publicity and organize fire safety training;

(six) to undertake fire fighting and rescue work, investigate the cause of the fire and count the fire losses;

(seven) to participate in major disasters and other emergency rescue work mainly to save people's lives;

(eight) to manage and guide the construction and training of the fire brigade;

(nine) other duties as prescribed by laws and regulations.

Article 8 Public security police stations shall carry out daily fire control supervision and inspection, be responsible for fire safety publicity and education, protect the fire scene, cooperate with fire accident investigation, and determine full-time (part-time) fire police.

Article 9 Community residents' committees and villagers' committees shall determine fire safety management personnel, improve the fire safety management system, organize residents (villages) to formulate fire safety conventions, publicize fire prevention, fire fighting and emergency escape knowledge, carry out fire safety inspection, and urge the rectification of fire hazards.

Tenth organs, organizations, enterprises and institutions are the main person in charge of fire safety, and are fully responsible for the fire safety work of their own units.

Units shall implement the fire safety responsibility system and post fire safety responsibility system step by step, clarify the fire safety responsibility step by step and post by post, and determine the fire safety responsible persons at all levels and posts.

Eleventh key units of fire safety shall perform the following fire safety duties in addition to the duties stipulated in Articles 16 and 17 of the Fire Protection Law of People's Republic of China (PRC):

(a) key units of fire safety signs in a prominent position;

(two) report to the fire department of the public security organ on the fire safety status and the performance of the fire safety obligations of the unit every quarter;

(three) to determine the fire safety administrator of the unit, and report to the fire department of the public security organ for the record within fifteen working days from the date of determination or change. Twelfth Municipal People's Government shall incorporate the fire safety layout, fire station, fire water supply, fire communication, fire truck passage, fire equipment and other fire protection plans into urban and rural planning, and be responsible for organizing their implementation.

Fire planning shall be prepared by the municipal planning administrative department in conjunction with the fire control institutions of the municipal public security organs, and the district (city) and county people's governments shall participate in the preparation.

Thirteenth planning administrative departments should plan the land for the construction of public fire control facilities in the planning, and the administrative departments of land and resources should provide fire control land according to the planning.

Article 14 The municipal, district (city) and county people's governments shall organize relevant departments to build, configure and maintain public fire control facilities such as fire stations, fire truck passages, fire communication and fire hydrants in accordance with fire control planning and technical standards.

If the public fire control facilities and equipment are insufficient or do not meet the actual needs, the fire control institution of the public security organ shall report to the people's government at the corresponding level in writing. The people's government that receives the report shall verify it in time and organize the relevant departments to build, rebuild, allocate or carry out technical transformation.

Fifteenth large crowded places construction projects and other special construction projects, the construction unit shall submit the fire control design documents to the fire control institutions of public security organs for examination and approval. Without the legality review or unqualified review, the department responsible for examining and approving the construction permit of the project shall not issue the construction permit, and the construction unit and the construction unit shall not carry out the construction.

In addition to the provisions of the preceding paragraph, the construction unit shall, within seven working days from the date of obtaining the construction permit according to law, report the fire control design documents to the fire control institution of the public security organ for the record, and the fire control institution of the public security organ shall conduct spot checks according to law. The construction unit shall submit random inspection data in accordance with the provisions of the construction project that has been randomly selected. The construction unit shall stop the construction and rectify the unqualified construction projects.

Article 16 If the fire protection design of a construction project has been audited by the fire control institution of the public security organ or put on record according to law and needs to be changed, the construction unit shall re-apply for the fire protection design audit or put on record.

Seventeenth in accordance with the national technical standards for fire control in engineering construction, after the completion of the construction project, the construction unit shall apply for fire control acceptance or filing in accordance with the following provisions:

(a) after the completion of the construction project audited by the fire control institution of the public security organ, the construction unit shall entrust a fire control technical service institution with corresponding qualifications to test the fire control facilities, electrical appliances and building decoration materials to meet the requirements of fire prevention performance. After passing the inspection, the construction unit shall apply to the fire control institution of the public security organ for fire control acceptance. Without acceptance or unqualified acceptance, it is prohibited to put into use;

(two) after the completion of other construction projects, the construction unit shall report to the fire department of the public security organ for the record within seven working days after the completion and acceptance, and the fire department of the public security organ shall conduct spot checks according to law. The construction unit shall submit random inspection data in accordance with the provisions of the construction project that has been randomly selected. If the spot check is unqualified, it shall be stopped and rectified.

Eighteenth construction units should be in accordance with the fire control design documents approved or filed by the fire control institutions of public security organs.

The construction unit shall designate a special person to be responsible for the fire safety of the construction site. The construction unit shall formulate and implement the fire safety management system, equipped with necessary fire control facilities and equipment.

Nineteenth construction projects need to be put into use ahead of schedule, the fire department of the public security organ may, according to the application of the construction unit, carry out acceptance in accordance with the relevant provisions of the state on fire control acceptance of construction projects.

Twentieth any unit or individual shall not arbitrarily change the nature of the use of buildings, reduce fire conditions.

Article 21 Fire fighting technical service institutions and their practitioners engaged in fire fighting design, construction, safety assessment, testing and maintenance of building fire fighting facilities shall obtain corresponding qualifications according to law, provide fire fighting technical services in accordance with national laws, regulations and relevant provisions, and be responsible for the conclusions issued.

Twenty-second buildings with automatic fire control facilities, property units or management units shall sign maintenance contracts with units with corresponding qualifications, implement maintenance responsibilities, and ensure the normal operation of automatic fire control facilities.

The property right unit or management unit of automatic fire control facilities shall conduct a comprehensive inspection of automatic fire control facilities every year and report the inspection to the fire control institution of the public security organ for the record.

If the building is equipped with a fire control room, the property right unit or management unit shall ensure that the fire control room is manned 24 hours a day in accordance with relevant management regulations.

Twenty-third outdoor advertising, light poles, overhead pipelines, green landscape and other settings shall not affect the passage of fire engines, fire fighting and personnel escape, and shall not damage the fire prevention conditions of buildings.

Twenty-fourth building fire safety should be unified management.

Property management of buildings, public fire safety work by the property management unit.

Without the implementation of property management, property owners and users should set up fire safety organizations for management.

Twenty-fifth * * building fire safety facilities and equipment maintenance, renovation or renovation funds, in accordance with the provisions of relevant laws and regulations, by the special maintenance funds to solve.

If no special maintenance fund is set up, it shall be borne by the property owner in accordance with the agreement; If there is no agreement or the agreement is unclear, the property owner shall bear it in proportion to the exclusive part.

Twenty-sixth buildings provided by property owners should be contracted, leased or entrusted for management, and meet the requirements of fire safety.

The contractor, the lessee or the trustee shall stipulate the fire safety responsibilities of all parties. If there is no agreement or the agreement is not clear, it shall perform the corresponding fire safety responsibilities within the scope of its use and management.

Twenty-seventh unified planning and construction of rural residential areas, should meet the requirements of fire spacing, set up the necessary fire control facilities.

The main roads in rural areas should meet the needs of fire engines.

If there is a production and living water supply network in rural areas, outdoor fire hydrants shall be set up; If natural water sources such as rivers and ponds are used as fire water sources, fire water intake facilities shall be set up; There is no production and living water supply network and natural water source, and a fire pool should be set up to meet the needs of fire fighting.

Twenty-eighth kindergartens, primary and secondary schools, welfare homes, nursing homes, special education schools, hospitals and other units shall formulate fire fighting and emergency evacuation plans and conduct fire drills every year.

Twenty-ninth public transport enterprises shall, in accordance with national standards, industry standards or enterprise standards, configure fire safety protection systems and other fire control facilities and equipment for public transport vehicles put into use.

Thirtieth catering establishments with a building area of more than 300 square meters, where canned liquefied gas is used as fuel in a decentralized way, shall adopt centralized gas supply, and pipeline natural gas shall be used if conditions permit, and meet the requirements of the relevant national fire control technical specifications.

Thirty-first * * * entertainment business period, it is strictly prohibited to welding, gas welding, painting and other construction and equipment maintenance operations.

During the business and use of crowded places, it is forbidden to use open flame operations such as electric welding and gas welding. If it is necessary to carry out open fire operation due to special circumstances such as construction, it shall go through the examination and approval procedures in advance in accordance with the regulations, effectively separate the construction area from the use area with fire prevention measures, remove flammable and combustible substances in the hot work area, equip with fire-fighting equipment, and supervise by special personnel to ensure the fire safety of the construction and use scope.

The provisions of the first and second paragraphs of this article shall apply to the use of open flame operations such as electric welding and gas welding in the adjacent areas of crowded places.

Thirty-second public gathering places and units that produce, transport, store and sell inflammable and explosive dangerous goods shall take out fire public liability insurance in accordance with relevant laws and regulations.

Thirty-third units shall organize the following personnel to participate in the fire safety training organized by the fire control institutions of public security organs:

(a) the person in charge of fire safety and the manager;

(2) Full-time and part-time firefighters;

(three) the design, construction, supervision and inspection personnel of fire control engineering;

(4) personnel who install, maintain, test and operate fire control facilities, personnel on duty in the fire control room and employees of fire control technical service institutions;

(five) the operation and management personnel of inflammable and explosive dangerous goods, as well as those who have fire hazards such as electric welding and gas welding;

(6) Managers of public gathering places;

(seven) other personnel as prescribed by laws and regulations.
