A few days ago, in order to safeguard the legitimate rights and interests of commercial housing buyers and promote the harmonious and healthy development of the real estate market, Chengdu Housing Management Bureau officially promulgated the Provisions on the Delivery and Use Process of Pre-sold Commercial Housing in Chengdu (hereinafter referred to as the "Regulations"), which clearly stipulated the contents that need to be publicized from the time of delivery of commercial housing to the time of delivery, from the delivery process to the illegal handling of development enterprises. It is understood that the "Regulations" will be officially implemented on April 12, with a validity period of 3 years.

If the delivery of commercial housing needs to be postponed, the developer must inform it in writing. The "Regulations" clarify that before the delivery of commercial housing, real estate development enterprises should inform the buyer in writing of the delivery period and matters needing attention. If it is necessary to delay delivery, the real estate development enterprise shall promptly inform the buyer in writing of the real situation, the measures being taken and the liability for breach of contract, and keep information communication with the buyer.
It is understood that these nine categories specifically include: (1) the completion acceptance certificate stipulated in the commercial housing sales contract; (two) the new residential ancillary facilities and equipment delivery record certificate; (three) residential engineering quality household acceptance results table; (four) the measured report of the commercial housing area; (five) property services to undertake inspection agreement; (six) residential quality guarantee; (7) Description of residence; (eight) the relevant taxes and maintenance funds involved in the registration of the ownership of commercial housing; (nine) the relevant person in charge of the real estate development enterprise to accept and handle the complaints in the delivery of commercial housing and their contact information. Among them, the delivery record certificate of new residential ancillary facilities and equipment shall be issued by the Housing Authority where the project is located.
In addition, in the commercial housing projects delivered for use, the regulations require real estate development enterprises to standardize the setting of general layout schematic diagram, building number identification, driving direction guidance, warning (warning words) and other signs, with clear handwriting and legend, which can be marked in Chinese and English if possible.
How to complete the delivery process of commercial housing in four steps?
"Regulations" clearly, the first step, the need for real estate development enterprises to verify the identity of property buyers. If the buyer cannot be present in person for some reason, he can issue a written authorization document to authorize others or other organizations to handle it.
The second step is to check the condition of the house. The real estate development enterprise shall assist the buyer to inspect the house condition on the spot, and make a written record of the house handover inspection together with the buyer.
The third step is to confirm the housing construction area and related expenses settlement. The real estate development enterprise shall confirm the construction area with the buyer and settle the expenses arising from the difference in the measured area. If it has been agreed that the real estate development enterprise will handle the registration formalities of commercial housing ownership on its behalf, the real estate development enterprise will collect relevant taxes and fees in accordance with the contract; If the buyer chooses to go through the ownership registration formalities by himself, the real estate development enterprise shall not forcibly collect relevant taxes and fees.
The fourth step is to handle the handover procedures for the possession and use of the house (turnkey). After completing the above procedures, the real estate development enterprise and the buyer hand over the house keys, and sign the House User Manual, the House Quality Guarantee, the House Handover Inspection Record Form, and the Household Acceptance Result Form of the Residential Project Quality to complete the delivery of the commercial house.
It is clearly pointed out in the "Regulations" that real estate development enterprises shall not pay relevant taxes or sign property management texts as preconditions for buyers to check housing conditions. In addition, the "Regulations" require that the problems that need to be rectified be confirmed in the housing handover inspection record form, and the development enterprise should complete it within the agreed time. After the maintenance is completed, the development enterprise shall organize the buyer to reinspect, and the reinspect result shall be signed by the buyer for confirmation.

What should I do if there is a dispute over the delivery? In this regard, the "Regulations" clearly stipulate that real estate development enterprises should properly handle contradictions and disputes in the process of handing over houses. If no agreement can be reached with the buyer at the time of handover, it shall be handled in accordance with the dispute settlement method agreed in the commercial housing sales contract; Matters not stipulated in the contract involve completion acceptance, planning, environmental protection, fire protection, meteorology, special equipment, etc. , you can report to the relevant departments. In addition, the "Regulations" also mentioned that real estate development enterprises may not pay relevant taxes or sign property management documents as a prerequisite for buyers to check the housing situation. At the same time, the problems found in the "House Handover Inspection Record Form" that need to be rectified shall be repaired within the agreed time. After the house maintenance is completed, the real estate development enterprise shall immediately organize the buyer to re-inspect, and the re-inspection result shall be signed by the buyer for confirmation.
Where the development enterprises violate the rules in the delivery process, the buyers can report, and the housing management department can order rectification, and reduce their credit score, and give it to informed criticism. It is clear in the "Regulations" that these violations include failing to handle the delivery procedures of commercial housing according to the prescribed procedures, forcibly charging relevant fees without agreement when delivering the house, and failing to publicize and provide relevant information at the delivery site as required when delivering the house.
