Provisions of Guangzhou Municipality on Housing Safety Management (revised on 20 10)
The term "housing safety management" as mentioned in these Provisions refers to the management to ensure the safe use of the building structure. Including housing safety appraisal management, dangerous housing management, housing emergency rescue and termite control management.
The fire safety of houses, the use safety of facilities and equipment, and the safety management of interior decoration of houses shall be implemented in accordance with other laws, regulations and rules. Article 3 Housing safety management shall follow the principle of putting prevention first and ensuring safety. Article 4 The Municipal Bureau of Land Resources and Housing Management is the administrative department in charge of housing safety management and is responsible for organizing the implementation of these Provisions. City Land Resources and Housing Authority District Branch (hereinafter referred to as the district branch) is responsible for the supervision and management of housing safety within its jurisdiction.
City Land Resources and Housing Authority, the district branch can entrust housing safety appraisal, dangerous housing management, termite control and other institutions to be responsible for the specific affairs of housing safety management.
Construction, planning, finance, industry and commerce, municipal administration, landscape, culture, environmental protection, city appearance and environmental sanitation, comprehensive law enforcement of urban management, fire protection, electric power and other departments shall, according to their respective responsibilities, cooperate with the housing safety management, and coordinate the implementation of these Provisions. Fifth construction, land and housing management, planning, urban management and other comprehensive law enforcement departments should accept complaints about illegal acts of unauthorized demolition of houses, and investigate and deal with them according to their duties.
The construction administrative department is responsible for investigating and dealing with the decoration enterprises that demolish and change houses without authorization, and the administrative department of land and housing management shall provide assistance.
The administrative department of land and housing management is responsible for investigating and dealing with the acts of demolishing houses in violation of housing safety management.
The planning administrative department is responsible for investigating and dealing with the acts of demolition of houses in violation of planning management.
Urban management comprehensive law enforcement departments are responsible for investigating and dealing with illegal housing construction.
The public security department is responsible for investigating and handling cases that resist or hinder the administrative law enforcement of housing safety management, and cooperating with the land and housing management department to do a good job in the administrative law enforcement of housing safety management. Article 6 The municipal and district people's governments shall strengthen the leadership and supervision over the housing safety management within their respective jurisdictions, and organize and coordinate relevant departments to do a good job in housing safety management.
The municipal and district people's governments shall formulate housing emergency rescue plans, set up housing safety emergency rescue headquarters, and organize and direct housing emergency rescue. Seventh the government should give full play to the role of housing safety appraisal, termite control and other industry organizations in housing safety management, and encourage and support industry organizations to carry out their work according to law.
Industry organizations shall assist the Municipal Bureau of Land Resources and Housing Management and the district branches to do a good job in housing safety management, and conduct industry self-discipline and supervision. Eighth City Land Resources and Housing Authority shall regularly organize the city's housing safety survey, the establishment of housing safety dynamic information management system. Article 9 The municipal and district people's governments shall guarantee special funds for housing safety management such as housing safety investigation, entrusted appraisal, emergency maintenance and escrow of dangerous houses, and emergency rescue.
Special funds for housing safety management shall be included in the departmental budget by the Municipal Bureau of Land Resources and Housing Management and the district branches, and shall be reported to the finance department at the same level according to the prescribed procedures. Chapter II Responsibility for Housing Safety Article 10 The owner of a house is the person responsible for housing safety. If the owner of the house is missing or the ownership of the house is unclear, the custodian shall be the person responsible for the safety of the house; If there is no custodian, the user of the house is the person in charge of housing safety. Unless otherwise agreed in the leased house.
The provisions of the Measures of Guangzhou Municipality for the Administration of Urban Housing Demolition shall apply to the responsibility for housing safety from the date of the announcement of housing demolition to the completion of the demolition work.
The safety responsibility of adjoining houses in cities with different properties, if otherwise stipulated in the Regulations on the Administration of Adjoining Houses in Cities with Different Properties, shall prevail. Eleventh housing safety responsible person is responsible for the safety of the housing structure and its ancillary facilities.
The person in charge of housing safety shall install anti-theft nets, air-conditioning brackets and other ancillary facilities in accordance with the requirements of the specification to ensure the safety, integrity and cleanliness of the house and its ancillary facilities, and regularly inspect the house and its ancillary facilities. Find hidden dangers, find them in time and treat them according to regulations. Twelfth houses belonging to cultural relics shall be applied by the administrative department of culture in accordance with the Law of People's Republic of China (PRC) on the Protection of Cultural Relics. Thirteenth housing use process, shall not have the following acts that affect the safety of housing:
(a) without the approval of the city planning department, changing the nature of use and opening (blocking) external doors and windows, closing balconies, setting up sheds or building (structures) on rooftops without authorization;
(2) storing and operating corrosive substances such as acid and alkali and inflammable and explosive dangerous goods in residential areas;
(three) the demolition of houses without authorization in the decoration activities, which affects the structural safety and normal use of houses.
The installation and use of ancillary facilities such as safety nets and air-conditioning brackets shall not endanger public safety. Fourteenth property service enterprises should publicize the safe use of houses, and regularly check the safety status of the common parts and facilities and equipment of the houses they manage according to the decision of the owners' meeting or the agreement of the property service contract.
If potential safety hazards are found, the realty service enterprise shall promptly report to the owners' committee in writing, post an announcement in a prominent position in the community, notify all owners, and organize appraisal and maintenance in accordance with the stipulations of the realty service contract.
