Regulations of Zhengzhou Municipality on Property Management (202 1)
The term "property management" as mentioned in these Regulations refers to the activities of the owners to maintain, conserve and manage the buildings and their ancillary facilities and related sites in the property service area through hiring property service personnel or self-management, and to maintain environmental sanitation and related order. Article 3 Property management shall adhere to the principles of party leadership, government supervision, owner autonomy, professional services and industry self-discipline. Fourth, give full play to the role of the party organization as a fighting fortress, build a property management system under community governance led by grass-roots party building, establish a coordinated operation mechanism among residents' (village) committees, owners' committees and property service providers, fully mobilize residents' participation enthusiasm, and form a joint force of community governance. Article 5 The people's governments of cities, districts and counties (cities) shall incorporate property management into the development planning and community governance system of modern service industry at the same level, strengthen the organization and leadership of property management activities and their supervision and management, incorporate the required funds into the fiscal budget at the same level, establish and improve the comprehensive coordination mechanism of property management, and study and solve major problems.
Street offices and Township People's governments are responsible for organizing, guiding and supervising the property management activities within their respective jurisdictions. Neighborhood (village) committees carry out property management related work under the guidance of neighborhood offices and township people's governments. Sixth city housing security and real estate management department is responsible for the supervision and management of property management activities within the administrative area of this Municipality, and perform the following duties:
(a) to formulate policies related to property management in this Municipality and organize their implementation;
(two) to guide and supervise the county (city) property management department to carry out the supervision and management of property management activities;
(three) to establish a unified technical specification for property services in this Municipality;
(four) the establishment and maintenance of property information system;
(five) to guide and supervise the collection, management and use of special property maintenance funds in this Municipality;
(six) to promote the establishment of old residential property management mechanism;
(seven) to carry out publicity and training of laws and regulations related to property management;
(8) Other supervisory and administrative duties.
County (city) property management department is responsible for the supervision and management of property management activities within their respective administrative areas, and performs the following duties:
(a) the implementation of property management related laws and regulations, policies and systems;
(two) to guide the street offices and Township People's governments to implement property management;
(three) regular assessment of property services and management within the jurisdiction, and timely improve the supervision and management measures;
(four) to organize the owners' committee, the property service industry and other relevant personnel to carry out business training;
(five) to supervise the property service providers within their jurisdiction to abide by laws and regulations and perform property service contracts;
(6) Other supervisory and administrative duties.
Development and reform, urban and rural construction, natural resources and planning, judicial administration, market supervision and management, emergency management, public security, urban management, landscaping, ecological environment, sanitation, fire rescue institutions and other departments and units shall, according to their respective functions and duties, do a good job in the supervision and management of property management activities. Seventh city property management industry associations should strengthen industry self-discipline, standardize business practices, mediate industry disputes, and urge property service providers and employees to operate according to law, provide honest services, improve the level of property services, and promote the healthy development of the property service industry. Article 8 Encourage and support the application of Internet, big data, artificial intelligence and other information technologies in property services and management, build a smart property management service platform, improve the quality of smart property services, and promote the modernization of community governance capabilities.
For high-frequency matters and service scenarios involving the elderly and the disabled, we should adhere to the integration of traditional service methods and intelligent services to provide convenient property services. Ninth units and individuals are encouraged to participate in community property services and management activities in the form of voluntary service, public welfare publicity and popular science education. Chapter II Owners and Owners' Organizations Article 10 The owner of a house is the owner.
Failing to register the ownership of the house according to law, but in any of the following circumstances, the owner shall enjoy the rights and assume the obligations in the property management activities:
(a) to obtain the ownership of the house by the effective legal documents of the people's court or arbitration institution;
(two) the ownership of the house is obtained by inheritance;
(three) due to legal construction and other factual acts to obtain the ownership of the house;
(four) based on the civil legal act of buying and selling commercial housing with the construction unit, it has legally occupied the exclusive part of the building;
(5) Other circumstances stipulated by laws and regulations.
The owner refers to the owner of the exclusive part that has reached the delivery conditions but has not been sold or delivered to the property buyer.
The owner may entrust the property user to exercise the owner's rights and perform the owner's obligations according to law, and the entrustment shall be in written form.
