Legal Analysis: According to Article 5 of the Measures for the Management of Maintenance Funds for Residential Facilities and Equipment jointly issued by the Ministry of Housing and Urban-Rural Development and the Ministry of Finance, when selling commercial housing, the buyer and the seller shall sign a maintenance fund payment agreement. Property buyers should pay the maintenance fund to the selling unit according to the proportion of 2-3% of the purchase price. The maintenance fund collected by the selling unit belongs to all owners and is not included in the residential sales income.

Legal basis: Article 44 of the Regulations on Property Management. Within the property management area, water supply, power supply, gas supply, heating, communication, cable TV and other units shall charge relevant fees to the end users. Where a realty service enterprise accepts the entrustment to collect the fees mentioned in the preceding paragraph, it shall not collect additional fees such as handling fees from the owners.
