Measures of Shaoxing Municipality on the Administration of Affordable Housing

Article 1 In order to ensure the basic housing needs of low-income families in urban areas and standardize the construction, trading and management of affordable housing, these Measures are formulated in accordance with the relevant provisions of the Measures for the Administration of Affordable Housing in Zhejiang Province and the actual situation in Shaoxing City.

Article 2 The term "indemnificatory housing" as mentioned in these Measures refers to the indemnificatory policy commodity housing provided by the government with preferential conditions, limited construction standards, supply targets and sales prices.

Article 3 These Measures shall apply to the construction, transaction and management of affordable housing in Shaoxing city.

Article 4 The construction scale, project layout, construction standards, planning scheme, supply scope and objects, and sales price of affordable housing should be reasonably determined according to local economic and social development level, residents' housing situation and income level.

Fifth municipal construction administrative departments (hereinafter referred to as the competent department of affordable housing) are responsible for the construction and management of affordable housing in urban areas.

Development and reform, finance, land, planning and other departments in accordance with their respective responsibilities, responsible for the work of affordable housing.

Sixth affordable housing construction, trading and management, should adhere to the principles of openness, justice and fairness.

Any unit or individual has the right to complain and report illegal acts in the construction, trading and management of affordable housing. The competent department of affordable housing shall set up a complaint hotline and accept public supervision.

Seventh urban affordable housing construction plan organized by the Municipal People's government, and submitted to the provincial development and reform, construction, land administrative departments for the record.

The municipal development and reform administrative department shall, jointly with the construction, finance, planning, land and other departments, prepare the annual plan and land use plan for affordable housing construction according to the plan for affordable housing construction.

The development enterprise shall issue a "residential quality guarantee" and "instruction manual" to the buyers of affordable housing, and bear the warranty responsibility in accordance with the contract.

Fourteenth affordable housing construction area is generally 80 square meters or 60 square meters. Eligible families are restricted to purchase 1 set, in which families with three or more people (including three people) can purchase Xing Tao housing with a construction area of 80 square meters, and two people and single families who meet the requirements in the second paragraph of Article 17 of these Measures can purchase Xing Tao housing with a construction area of 60 square meters. Each set of high-rise and small high-rise buildings can increase the construction area by no more than 10 square meter.

Fifteenth affordable housing district planning and design should comply with the urban residential district planning and design norms.

Supporting infrastructure and public facilities in affordable housing areas shall be designed, constructed and delivered at the same time as the main project.

Seventeenth families who meet the following conditions can apply for the purchase of affordable housing:

(a) the family income is lower than the low income;

(3) Families without houses, or families whose per capita building area of houses demolished on state-owned land is less than 12 square meters, originally chose monetary compensation, but now they are selfless and do not rent public houses, or non-single families whose per capita building area is less than 12 square meters, or whose building area is less than 40 square meters.

Single persons who have reached the age of 35 and have no housing can apply for the purchase of affordable housing if they meet the conditions specified in items (1) and (2) of the preceding paragraph.

If the applicant's family has enjoyed housing distribution in kind, or purchased commercial housing through the market, or obtained housing by means of gift, inheritance, self-construction and lease of low-rent housing, its construction area shall be included in the approved scope of the applicant's family housing construction area.

Article 18 The competent department of affordable housing shall make a sales plan 15 days before accepting the application, and publicize it in the main media in the urban area. The sales plan includes the address, quantity, building area, apartment type, sales price and sales method of the house.

Nineteenth to apply for the purchase of affordable housing, it shall apply to the housing management office where the household registration is located, and submit the following written proof materials:

(1) Household registration certificate and family identity certificate;

(two) the family income certificate and housing situation certificate issued by the unit or the street office where the household registration is located;

(3) Other relevant certification materials.

The competent department of affordable housing shall conduct preliminary examination within 3 days from the date of receiving the application, and shall accept the application if it meets the provisions of the preceding paragraph.

Article 20 After accepting the application, the competent department of affordable housing can review the applicant's housing and previous housing changes by consulting the real estate registration information. The review period is 20 days.

To meet the requirements of the applicant, it should be publicized in the applicant's current residence and residence community, including the applicant's name, family income and housing situation. The publicity period is 10 days.

If there are complaints and reports after publicity, the competent department of affordable housing shall investigate and verify with relevant departments; The applicant who does not meet the prescribed conditions shall be disqualified and informed in writing; If there is no complaint or the complaint is not verified, an agreement shall be signed on the application form for affordable housing.

Twenty-first economic applicable housing sales price, within the area control standards, according to the economic applicable housing sales price to buy; Exceeding the area control standard, the excess shall be approved by the price administrative department in conjunction with the competent department of affordable housing with reference to the average price level of commercial housing in the same lot.

Income from the price difference of affordable housing exceeding the area control standard is included in the financial special account of affordable housing.

Twenty-second affordable housing prices should be compatible with the economic affordability of low-income families in cities and towns, and government pricing should be implemented in accordance with the principle of guaranteeing capital and making small profits, and announced to the public.

The sale of affordable housing should be clearly marked, and unpublished fees should not be charged outside the marked price.

Twenty-third affordable housing sales in short supply, you can take public lottery to determine the waiting object.

For families who failed to win the lottery in the last round, if they still meet the conditions for buying houses after examination, they will be given priority as the next round of buying houses according to the situation of saleable houses.

Twenty-fourth the purchase of affordable housing requires provident fund and commercial loans, according to the relevant provisions of the provident fund and commercial loans.

The applicant for affordable housing shall apply for ownership registration according to law after purchasing affordable housing. Housing and land registration departments shall indicate the housing type as affordable housing, the area purchased at the affordable housing price, the nature of the land, etc. in the registration certificate.

Twenty-fifth affordable housing in the housing ownership certificate and land use certificate for five years, can be listed for sale at market prices.

When selling affordable housing, the government should pay the land transfer fee or the income equivalent to the land transfer fee according to the regulations.

Twenty-sixth affordable housing listed for sale within a limited period of time, the relevant departments shall not handle the registration procedures for the change of real estate ownership.

If the ownership of affordable housing must be transferred due to court decisions, mediation, inheritance and other reasons within the limited listing period, the land transfer fee or income and related taxes and fees shall be paid in accordance with the regulations, and the transfer shall be allowed in advance.

Article 27 The government shall, when conditions permit, arrange some affordable housing for rent for families who are qualified to buy affordable housing but unable to buy it. The rent is calculated at the cost price and approved by the price management department.

The lessee, rent and area standard of affordable housing shall be stipulated separately.

Twenty-eighth affordable housing buyers in line with the provisions of these measures, the sale of affordable housing at market prices, shall not apply for the purchase of affordable housing; If it is really necessary to change the purchase, it shall be implemented in accordance with relevant regulations.

Twenty-ninth affordable housing development enterprises and affordable housing applicants who violate the relevant provisions of the management of affordable housing shall be punished by the competent department of affordable housing according to law.

Thirtieth national staff in the construction, trading and management of affordable housing in violation of the relevant provisions, by their units or administrative supervision organs shall be punished according to law.
