Article 1 In order to strengthen and improve urban property management, standardize property management activities, ensure the rational use of property, and safeguard the legitimate rights and interests of owners, property users and property management enterprises, these measures are formulated in accordance with the "Regulations on Property Management" of the State Council and other relevant provisions, combined with the actual situation of our city. Article 2 These Measures shall apply to urban property management within the administrative area of this Municipality. Article 3 The term "property" as mentioned in these Measures refers to houses and related facilities, equipment and venues.

The term "property management" as mentioned in these Measures refers to the activities of the owners to maintain, conserve and manage the houses, supporting facilities, equipment and related sites by hiring property management enterprises, and to maintain the environmental sanitation and order in the relevant areas.

The term "owner" as mentioned in these Measures refers to the owner of the property.

The term "property user" as mentioned in these Measures refers to the lessee of the property and other people who actually use the property.

The term "property management enterprises" as mentioned in these Measures refers to enterprises established according to law, with independent legal personality and engaged in property management services. Article 4 Anshan City Real Estate Bureau is the administrative department in charge of property management in urban residential areas of this Municipality, and the county (city) real estate administrative department is the administrative department in charge of property management in urban residential areas under its jurisdiction.

Other relevant administrative departments and sub-district offices (town people's governments) shall guide, coordinate and supervise property management within their respective functions and powers. Fifth new residential areas should implement property management.

New urban residential areas should be designed in strict accordance with the relevant national planning standards and meet the requirements of property management. The planning and design scheme shall include the following contents:

(1) For residential areas with a construction area of more than 20,000 square meters and less than 50,000 square meters, the construction unit shall provide property management space of not less than 1 10 square meters. If the construction area exceeds 50,000 square meters, for every increase of 6,543.8+0,000 square meters, there will be a corresponding increase of not less than 654.38+0 square meters of property management space;

If the supporting facilities are not complete, it should be combined with community construction, and the government, social forces or self-run housing units should be responsible for organizing and improving them.

Property management houses can be purchased in the community or built under the premise of planning permission. Residential areas with a construction area of less than 20,000 square meters shall provide property management houses of not less than 80 square meters. If the construction area is more than 20,000 square meters, for every increase of 6,543,800 square meters, there will be a corresponding increase of not less than 5 square meters of property management space. Article 7 The division of property management areas shall consider factors such as facilities and equipment, building scale and community construction.

Newly built residential areas, including residential areas built by stages or residential areas developed and built by two or more units, should be divided into a property management area, and supporting facilities and equipment should be used for * * *. If the residential area has been divided into several natural blocks or closed communities, it can be divided into independent property management areas.

The construction unit shall, at the same time as applying for the construction project planning permit, put forward the requirements for dividing the property management area to the property management administrative department. The administrative department of property management shall divide the property management areas in accordance with the provisions of the second paragraph of this article and register them for the record.

If the property management area is not divided or needs to be adjusted, the property management administrative department shall, jointly with the local street office, divide the property management area according to the specific layout of the property in accordance with the provisions of the second paragraph of this article, and register for the record. Eighth before the pre-sale of housing, the construction unit shall refer to the model text formulated by the Ministry of Construction, and formulate a temporary convention for owners as an annex to the housing sales contract. The temporary owners' convention shall stipulate the use and maintenance management of the property, the obligations of the owners, and the responsibilities that should be borne in violation of the temporary owners' convention. , but shall not conflict with laws, regulations and rules, and shall not infringe upon the legitimate rights and interests of property buyers. Article 9 The house sales contract signed by the construction unit and the house buyer shall include the plane layout of the construction project specified in the planning permission document of the construction project, and list the supporting facilities and equipment shared by all owners in the property management area in the annex of the house sales contract.

The supporting facilities and equipment shared by all owners mainly include:

(1) Property management place;

(2) guard room, telephone room, monitoring room, power distribution room, pump room, overhead floor and corridor;

(3) Non-motor vehicle garages (parking lots) built according to the plan within the property management area;

(four) public greening, roads and venues within the property management area;

(five) the facilities and equipment that the construction unit promises to be owned by all owners in the form of house sales contracts or other written forms;

(six) other facilities and equipment owned by all owners according to law. Tenth new residential areas in the owners' congress, the owners' congress before hiring property management companies, should implement the preliminary property management.

In the early stage of property management, the construction unit shall select qualified property management enterprises through bidding according to the relevant provisions of the state on property management bidding; If there are less than three bidders or the residential scale is less than 50,000 square meters, with the approval of the property management administrative department where the property is located, the property management enterprise with corresponding qualifications can be selected by agreement, and a written preliminary property service contract can be signed.
