Identification of property service defects

Legal subjectivity:

1. If the property service is defective, the property company has no right to ask the owner to bear the liquidated damages for the property fee. 2. The liability to pay liquidated damages only applies to breach of contractual obligations, and can only be applied if the parties have agreed on liquidated damages in the contract or the law stipulates that there is liquidated damages.

Legal objectivity:

Article 577 of the Civil Code of People's Republic of China (PRC), if one party fails to perform the contractual obligations or the performance of the contractual obligations does not conform to the agreement, it shall bear the liabilities for breach of contract such as continuing to perform, taking remedial measures or compensating for losses.
