Provisions of Xingtai Municipality on Prohibiting Fireworks and Firecrackers

Article 1 In order to strengthen the management of fireworks and firecrackers, prevent and control environmental pollution, and ensure the safety of the public, people and property, these Provisions are formulated in accordance with relevant laws and regulations and combined with the actual situation of this Municipality. Article 2 These Provisions shall apply to the prohibition of setting off fireworks and firecrackers and related supervision and management activities within the administrative area of this Municipality. Article 3 Fireworks and firecrackers are prohibited in the administrative areas of Xindu District, Du Xiang District, Renze District and Nanhe District of this Municipality.

Fireworks and firecrackers are prohibited in the urban areas where other people's governments at the county level are located.

The people's governments at the city and county levels may, according to the actual situation of their respective administrative areas, determine other areas where fireworks and firecrackers are prohibited, and make a timely announcement to the public.

Fireworks and firecrackers shall not be sold in areas where fireworks and firecrackers are prohibited. Article 4 It is forbidden to set off fireworks and firecrackers in the following places outside the forbidden zone:

(a) the office of the party and government organs, medical institutions, kindergartens, schools, nursing homes, parks, shopping malls, theaters, cultural relics protection units, large cultural and sports venues, archives, markets and other public places;

(2) Transportation hubs such as stations and airports and railway line safety protection zones;

(3) Units that produce and store inflammable and explosive articles;

(four) in the safety protection zone near the power transmission and transformation facilities and communication lines;

(five) forest, grassland, woodland, green space and other key fire prevention areas;

(6) Important military areas.

In the places listed in the preceding paragraph, the municipal and county people's governments shall organize the setting of warning signs prohibiting the discharge of fireworks and firecrackers, and do a good job in safety tips and prevention. Article 5 The people's governments at the municipal and county levels shall, according to the warning level of heavy pollution weather and in accordance with the prescribed procedures, start the emergency plan in time, release the warning information of heavy pollution weather to the society through the media, and implement emergency response measures such as prohibiting the discharge of fireworks and firecrackers in the whole region.

If emergency response measures are implemented to prohibit the discharge of fireworks and firecrackers in the whole region, the municipal and county people's governments shall issue a notice prohibiting the discharge of fireworks and firecrackers to the public through the media. Article 6 The people's governments at the city and county levels shall strengthen their leadership, establish a mechanism for deliberation and coordination, and make overall plans to prohibit the discharge of fireworks and firecrackers.

Township (town) people's governments and sub-district offices shall incorporate the prohibition of fireworks and firecrackers into the comprehensive management of grassroots social security, and strengthen organization, coordination, guidance and supervision.

The people's governments at all levels in this Municipality shall incorporate the relevant funds for prohibiting the discharge of fireworks and firecrackers into the fiscal budget at the same level. Seventh public security organs are responsible for the safety management of fireworks and firecrackers, and investigate and deal with illegal fireworks and firecrackers according to law.

Emergency management, market supervision, administrative examination and approval, urban management, ecological environment, meteorology, education, supply and marketing and other departments shall, in accordance with their respective responsibilities, strengthen cooperation and linkage, and do a good job in the control of fireworks and firecrackers. Eighth people's governments at all levels and their relevant departments should strengthen the publicity and education work of prohibiting the discharge of fireworks and firecrackers.

Neighborhood (village) committees, owners' committees and property service enterprises shall assist relevant departments in the work of prohibiting the discharge of fireworks and firecrackers, and strengthen publicity, education and guidance to residents (villages) and owners.

Organs, enterprises, institutions and other social organizations shall conduct publicity and education on the prohibition of fireworks and firecrackers in their own units and industries.

Radio, television, newspapers, Internet and other media units and outdoor advertising operators and publishers shall conduct public welfare publicity and public opinion supervision on the prohibition of fireworks and firecrackers.

Schools and guardians of minors shall educate minors on the safety of fireworks and firecrackers, and it is forbidden to set off fireworks and firecrackers.

Encourage social organizations and volunteers such as environmental protection to participate in voluntary service activities that prohibit the discharge of fireworks and firecrackers.

Encourage and advocate replacing fireworks and firecrackers with safe, environmentally friendly, low-carbon and green methods. Article 9 To apply for holding large-scale fireworks display activities such as fireworks evening, the organizer shall apply to the public security organ for permission in accordance with the provisions on hierarchical management.

If the public security organ approves the license, it shall announce the contents of the license to the public.

Fireworks evening and other large-scale fireworks display activities, the discharge operation units and workers shall carry out discharge operations in accordance with the fireworks safety regulations and the approved discharge operation plan. Article 10 Units and individuals that provide catering, accommodation, wedding and funeral services in areas where fireworks and firecrackers are prohibited shall inform their clients of the relevant provisions prohibiting the discharge of fireworks and firecrackers, and shall not provide fireworks and firecrackers related services for them, and discourage the discharge of fireworks and firecrackers within their city appearance and environmental sanitation responsibility areas; Those who refuse to listen to dissuasion shall report to the public security organ in time. Eleventh citizens, legal persons and other organizations have the right to report the illegal discharge of fireworks and firecrackers to the public security organs. The public security organ shall set up a special hotline for reporting, and after receiving the report, it shall promptly investigate and handle it or hand it over to the relevant departments in accordance with its duties and powers. If the report is true, it shall be rewarded, and the specific measures shall be formulated by the Municipal People's government. Twelfth any unit or individual who violates the provisions of administrative punishment, the relevant information shall be incorporated into the social credit information publicity system according to law. Article 13 If the relevant administrative departments and their staff neglect their duties, abuse their powers or engage in malpractices for selfish ends in the management of prohibiting the discharge of fireworks and firecrackers, the directly responsible person in charge and other directly responsible personnel shall be punished according to law.
