Regulations of Shenzhen Special Economic Zone on Planning Land Supervision (revised on 20 19)

Chapter I General Provisions Article 1 These Regulations are formulated in accordance with the basic principles of relevant laws and administrative regulations and the reality of Shenzhen Special Economic Zone (hereinafter referred to as the Special Zone) for the purpose of strengthening the supervision of planned land, standardizing the supervision and enforcement of planned land, ensuring the implementation of urban planning and protecting land resources. Article 2 These Regulations shall apply to the supervision of land planning in the Special Zone.

The term "planning land supervision" as mentioned in this Ordinance refers to the supervision and inspection of citizens, legal persons and other organizations' compliance with and implementation of urban planning and land management laws, regulations and rules, and the investigation and punishment of administrative law enforcement activities that violate urban planning laws, regulations and rules (hereinafter referred to as planning violations) and land management laws, regulations and rules (hereinafter referred to as land violations). Third planning land supervision work should follow the principles of strictness, standardization, justice and civilization. To investigate and deal with illegal planning and illegal land activities, the facts should be clear, the evidence conclusive, the procedures legal and the applicable laws correct. Fourth planning land supervision shall be managed at three levels: city, district and street, and the working mechanism of law enforcement at two levels shall be implemented.

City, district, street planning land supervision institutions are specialized agencies that perform the duties of planning land supervision, and carry out planning land supervision work according to law. Article 5 The municipal planning and natural resources department shall guide and supervise the planning land supervision institutions at all levels to perform their planning land supervision duties according to law.

Housing, construction, transportation, water supply, market supervision, urban management, comprehensive law enforcement and other relevant departments shall, within the scope of their respective duties, assist in planning land supervision, cooperate with planning land supervision institutions to investigate and collect evidence, implement administrative compulsory measures, and implement administrative punishment decisions.

The District People's Government and the sub-district offices are responsible for organizing and coordinating the planning and land supervision within their respective jurisdictions. Article 6 The public security organs shall designate specialized agencies to assist and cooperate with the planning land supervision institutions to carry out the planning land supervision work, and shall promptly stop and deal with acts that hinder the planning land supervision institutions from performing their duties according to law.

Explore the establishment of a cooperative mechanism between the planning land supervision institution and the public security organ for evidence collection, information sharing and law enforcement. Seventh encourage citizens, legal persons and other organizations to report illegal planning and land violations.

Encourage the news media to strengthen the supervision of public opinion on planning violations, land violations and planning land supervision. Eighth to encourage the development and construction units, owners' congress, owners' committee to prevent and control the planning and land violations in the property management area. The owners' committee and the realty service enterprise shall dissuade and stop the illegal acts of land planning within the realty management area, and report to the subdistrict office's land planning supervision institution in a timely manner. Chapter II Duties and Jurisdiction Article 9 Planning land supervision institutions shall perform the following supervisory duties:

(a) to check the compliance and implementation of land planning laws, regulations and rules by citizens, legal persons and other organizations, to understand the situation from relevant units and individuals, and to consult, copy or obtain documents and materials related to supervision matters;

(two) to investigate the illegal acts of planning and land, and to order the illegal acts to stop, and to order the relevant units and individuals to explain and explain the problems involved in the supervision matters;

(3) Implementing administrative compulsory measures according to law;

(four) to impose administrative penalties on illegal acts of planning and illegal acts of land according to law;

(5) Forced removal of illegal buildings, structures and facilities generated by illegal planning activities according to law;

(6) Dismantling illegal buildings in accordance with these regulations. Tenth city planning land supervision institutions shall perform the following duties:

(a) to formulate planning land supervision policies and organize their implementation and supervision;

(two) to accept complaints and reports on illegal planning and illegal land use;

(three) to investigate and deal with major illegal planning and illegal land cases assigned by the Municipal People's government and higher authorities;

(four) the organization of district and street planning land supervision institutions to carry out cross-regional and major law enforcement actions;

(five) to supervise, guide, inspect and assess the planning land supervision work of all districts and sub-district offices;

(six) the establishment of a unified planning land supervision information platform, to provide scientific and technological means for the city's planning land supervision, to achieve the city's planning land supervision information sharing;

(seven) other planning land supervision duties determined by the Municipal People's government. Eleventh district planning land supervision institutions shall perform the following duties:

(1) Accepting complaints and reports on illegal planning and land violations within its jurisdiction;

(two) to investigate and deal with illegal planning and illegal land cases within the jurisdiction;

(three) to coordinate the implementation of illegal land clearing and compulsory demolition of illegal buildings, structures and facilities within the jurisdiction;

(four) to urge the neighborhood office planning land supervision institutions within their respective jurisdictions to carry out daily inspections and other work, and to command and dispatch the neighborhood office planning land supervision institutions within their respective jurisdictions to carry out joint law enforcement and cross-inspection;

(five) to undertake other planning land supervision matters assigned by the municipal planning land supervision institutions and the district people's government. Twelfth street office planning land supervision institutions shall perform the following duties:

(a) daily inspection of citizens, legal persons and other organizations to comply with the laws, regulations and rules of urban planning and land management;

(two) to stop the illegal acts of planning land within the jurisdiction, and report to the district planning land supervision agency;

(three) to carry out the planning land supervision work in the name of the district planning land supervision institution;

(four) to undertake other planning land supervision matters assigned by the municipal and district planning land supervision institutions.
