Provisions of Guangzhou Municipality on the Administration of Non-motor Vehicles and Motorcycles (revised in 2020)

Chapter I General Provisions Article 1 In order to strengthen the management of non-motor vehicles and motorcycles, ensure orderly, safe and smooth road traffic, and protect the legitimate rights and interests of citizens, legal persons and other organizations, these Provisions are formulated in accordance with the Road Traffic Safety Law of the People's Republic of China, the Implementation Regulations of the Road Traffic Safety Law of the People's Republic of China and other laws and regulations, combined with the actual situation of this Municipality. Article 2 These Provisions shall apply to the traffic, production, sales and related management activities of non-motor vehicles and motorcycles within the administrative area of this Municipality. Article 3 The municipal and district people's governments shall lead the management of non-motor vehicles and motorcycles within their respective administrative areas and establish a comprehensive management mechanism for non-motor vehicles and motorcycles.

Public security organs are responsible for the registration and traffic management of non-motor vehicles and motorcycles.

The traffic administrative department shall be responsible for the supervision and management of road transport of non-motor vehicles and motorcycles, and formulate and organize the implementation of relevant management systems for goods distribution vehicles in professional wholesale markets.

The market supervision and management department is responsible for the supervision and management of the production quality and sales of non-motor vehicles and motorcycles.

Industry and information technology, commerce, land, planning, culture, radio and television, press and publication, development and reform, Guangzhou talent service management, urban management, government service data management and other management departments shall assist in the implementation of these Provisions within the scope of their respective duties.

Disabled Persons' Federation provides disabled persons with services such as purchasing motorized wheelchairs, training in driving skills, and laws and regulations on road traffic safety. Article 4 Sub-district offices and town people's governments shall cooperate with relevant administrative departments to do a good job in the management of non-motor vehicles and motorcycles within their respective jurisdictions.

The residents' committees, villagers' committees and property service enterprises shall assist the relevant administrative departments to carry out road traffic safety management in their residential areas.

Relevant industry associations shall strengthen industry self-discipline and assist relevant administrative departments in the management of non-motor vehicles and motorcycles. Article 5 The municipal traffic administrative department shall expand and optimize the public transport network, guide the district people's governments to promote the use of convenient community transport, and improve the short-distance public transport connection system. Article 6 The traffic administrative department of the municipal public security organ and the municipal market supervision and management, traffic and other administrative departments shall incorporate the identity information and related punishment information of the actors engaged in illegal acts such as assembly, illegal installation and modification, illegal production and sale of non-motor vehicles and motorcycles, and engaging in commercial passenger and cargo transportation by using non-motor vehicles and motorcycles into the credit files of individuals or enterprises in the public credit information management system of this Municipality. The identity information, vehicle information and related punishment information of the actor who uses non-motor vehicles and motorcycles to engage in illegal passenger and freight transportation shall also be included in the information systems of this Municipality such as traffic management and population management.

If the actor specified in the preceding paragraph is a non-resident of this Municipality, his identity information and relevant punishment information shall be sent to the administrative department of service management of Laisui personnel in this Municipality as the audit content of points deduction in the points management system of Laisui personnel in this Municipality. Article 7 People's governments at all levels and sub-district offices shall publicize laws and regulations on the management of non-motor vehicles and motorcycles through newspapers, radio, television, internet and other media to raise public awareness of road traffic safety.

The judicial administrative department shall incorporate these provisions into the publicity and education activities of the rule of law. Chapter II Road Traffic Management Article 8 When driving a non-motor vehicle on the road, the following provisions shall be observed:

(a) driving in a non-motor vehicle lane; On the road without designated non-motor vehicle lanes, bicycles travel within the range of 1.5 meters on the left side of the right lane, and human tricycles and disabled motorized wheelchairs travel within the range of 2.2 meters on the left side of the right lane;

(two) are not allowed to enter the motor vehicle lane, except the legal road;

(3) Do not drive into areas where non-motor vehicles are prohibited from passing, such as expressways, urban expressways, inner ring roads and river-crossing tunnels;

(4) When crossing the crosswalk, slow down and make way when pedestrians are crossing the crosswalk; When passing through a road without traffic signals, pedestrians should avoid it;

(5) Slow down before turning, raise your hand and turn on the turn signal with the turn signal; When overtaking the preceding vehicle, the overtaking vehicle shall not be hindered;

(six) shall not carry out other acts that affect safe driving;

(seven) other provisions of laws and regulations on road traffic safety. Article 9 The following vehicles and coasters are prohibited from driving on roads within the administrative area of this Municipality:

(a) assembly, illegal installation and modification and other disabled wheelchairs, electric bicycles and motorcycles that do not meet the national standards;

(two) disabled motorized wheelchairs that are not registered in this Municipality, except those holding temporary traffic signs in this Municipality;

(three) motorcycles that are not registered in this Municipality, except those that pass through designated areas at a specific time;

(4) Animal-drawn vehicles;

(five) electric unicycle, electric balance car and other sliding tools;

(six) other vehicles and taxiing tools that are prohibited from driving on the roads in this Municipality.

The specific measures for the administration of temporary traffic signs for disabled motorized wheelchairs specified in Item (2) of the preceding paragraph shall be formulated separately by the Municipal People's Government. The passage time and area specified in the third paragraph shall be announced to the public fifteen days in advance by the municipal public security organ.
