Regulations of Yichang Municipality on Property Management of Residential Quarters

Chapter I General Provisions Article 1 In order to safeguard the legitimate rights and interests of owners, property service providers and other parties, standardize property management activities in residential quarters, and create a good living environment, these Regulations are formulated in accordance with the General Principles of the Civil Law of People's Republic of China (PRC), the Regulations on Property Management, the Regulations on Property Service Management of Hubei Province and other laws and regulations, combined with the actual situation of this Municipality. Article 2 These Regulations shall apply to the property management of residential quarters and their supervision and management activities within the administrative area of this Municipality.

The term "residential quarter" as mentioned in these Regulations refers to a relatively closed and independent residential group or residential area that has been built and put into use in accordance with the unified urban and rural planning, reached a certain scale and has relatively perfect infrastructure.

The term "property management" as mentioned in these Regulations refers to the activities of the owners to maintain, conserve and manage the houses and their supporting facilities, equipment and related sites in residential areas, and to maintain environmental sanitation and related order.

The term "property service providers" as mentioned in these Regulations includes property service enterprises and other managers. Article 3 Property management in residential quarters shall adhere to the principles of party building leading, government leading, territorial management, residents' autonomy, multi-party participation and professional service.

The people's governments at or above the county level shall incorporate the property management of residential quarters into the grass-roots social governance system and the development plan of modern service industry, improve incentive policies and measures, promote the standardized development of property services, improve smart properties, establish and improve the joint meeting system of property management, and coordinate and solve major problems in a timely manner. Article 4 The competent departments of housing and urban and rural construction of the people's governments at or above the county level shall be responsible for the supervision and management of the property management of residential quarters within their respective administrative areas, and perform the following duties according to the division of responsibilities:

(a) to formulate policies related to property management within their respective administrative areas and organize their implementation;

(two) to guide and supervise the street offices and Township People's governments to carry out property management related work;

(three) the establishment and maintenance of property services and management of electronic information platform, and supervise its legal and effective operation, to provide support for the owners of electronic voting;

(four) to supervise and manage the service quality of property service providers, and organize relevant assessment;

(five) to manage the credit information of property service providers and their employees, to evaluate the credit of property service providers, and to make it public, so as to facilitate the inquiry;

(six) business guidance, training, supervision and management of property service providers and their employees and owners' committees;

(seven) to supervise and manage the use and maintenance of the property;

(eight) to guide and supervise the property inspection and property service personnel to withdraw from the handover activities;

(nine) supervision and management of residential special maintenance funds deposited and used;

(ten) handling complaints in property management activities;

(eleven) other duties as prescribed by laws and regulations.

The administrative departments of development and reform, urban management, public security, civil affairs, natural resources and planning, ecological environment, market supervision and management, and emergency management of the people's governments at or above the county level shall, according to their respective functions and duties, do a good job in relevant supervision and management. Fifth street offices and Township People's governments shall supervise and manage the property management activities of residential quarters within their respective jurisdictions, and perform the following duties:

(a) to organize and guide the owners to set up the owners' meeting and elect the owners' committee;

(two) to supervise the owners' congress and the owners' committee to perform their duties according to law, and organize the assessment of the owners' committee;

(three) held a joint meeting to coordinate and solve the problems related to property management in a timely manner;

(four) in accordance with the comprehensive administrative law enforcement authority, according to the law to deal with illegal acts in residential areas;

(five) mediation of property management disputes;

(six) other duties as prescribed by laws and regulations. Article 6 Neighborhood committees shall assist neighborhood offices and township people's governments in property management, establish and improve the linkage mechanism of neighborhood committees, owners' committees and property service providers under the leadership of community (village) party organizations, and mediate property management disputes. Seventh public emergencies during the response, neighborhood offices and Township People's governments shall guide the property service providers to carry out the response work, and give material and financial support. Entrusted by the realty service provider to undertake the services provided by Grandpa * * * as stipulated in the realty service contract, it shall pay a reasonable fee.

Property service providers shall obey the unified command, actively cooperate with neighborhood (village) committees to carry out relevant work under the guidance of neighborhood offices and township people's governments, and implement various emergency measures according to law. Article 8 Property management industry associations shall strengthen the self-discipline management of the industry, formulate and organize the implementation of self-discipline industry norms under the guidance of the competent departments of housing and urban and rural construction, promote the legitimate operation and honest service of property service providers, and promote the healthy and orderly development of the industry. Chapter II Owners, Owners' Congress and Owners' Committee Article 9 The owner of a house is the owner. A person who has not obtained ownership by registration, but legally occupies the house based on legal acts such as buying, selling, giving, inheriting, removing or collecting compensation, is recognized as the owner in the property management relationship.

Owners shall exercise their rights and perform their obligations according to law, and shall not fail to perform their obligations on the grounds of giving up their rights.

Owners may entrust property users to exercise their rights and perform their obligations according to law. The entrustment shall be submitted to the owners' committee in writing.
