The latest laws and regulations on high-altitude parabolic objects

Deliberately throwing objects from high altitude, which has not caused serious consequences, but is enough to endanger public safety, shall be convicted and punished in accordance with the crime of endangering public safety by dangerous means as stipulated in Article 114 of the Criminal Law; Causing serious injury, death or heavy loss of public or private property. The newly promulgated civil code stipulates the accountability of "throwing objects at high altitude" from the above three levels, with the aim of eradicating the urban bad habit of "throwing objects at high altitude" from the legal level and restoring the safety of ordinary people.

Preventing parabolic events at high altitude as soon as possible can better protect people's lives and property. The provisions of the civil code on parabolic behavior at high altitude not only make the victims get compensation or compensation as much as possible, but also pay more attention to preventing this behavior in advance. To this end, the Civil Code specifically stipulates that building managers such as property service enterprises should take necessary safety measures to prevent the occurrence of high-altitude parabolic situations; Those who fail to take necessary security measures shall bear the tort liability for failing to fulfill their security obligations according to law. Although taking the prevention of high-altitude parabolic events as the legal security obligation of building managers such as property service enterprises has expanded the scope of responsibility of building managers such as property service enterprises, it is beneficial for relevant competent departments to collect evidence in time and confirm infringers, and can effectively prevent building managers such as property service enterprises from shirking their responsibilities, resulting in difficulties for victims to defend their rights.

Legal basis:

Article 1254 of the Civil Code of People's Republic of China (PRC).

After compensation, the user of the building who may cause damage has the right to recover from the infringer.

Property service enterprises and other building managers shall take necessary safety measures to prevent the occurrence of the situations mentioned in the preceding paragraph; Those who fail to take necessary security measures shall bear the tort liability for failing to fulfill their security obligations according to law.
