Chapter I General Principles

Article 1 In order to standardize the property management behavior and safeguard the legitimate rights and interests of the parties, these detailed rules are formulated in accordance with the provisions of the Regulations of Jiangsu Province on Property Management and the actual situation of this Municipality.

Article 2 These Provisions shall apply to property management activities within the administrative area of this Municipality.

[Newly built residential areas and existing residential areas with relatively complete supporting facilities shall be subject to property management.

The original residential area with incomplete supporting facilities shall be rectified by the people's government of the district (county, city) where it is located, and gradually create conditions for the implementation of property management. Property management should be implemented in buildings, industrial areas and other properties with relatively complete supporting facilities.

Article 3 Nantong Real Estate Management Bureau is the administrative department of property management in this Municipality (hereinafter referred to as the administrative department of property management).

The main responsibilities are:

(a) the implementation of the relevant provisions of the property management, property management industry service standards;

2) Responsible for the qualification examination, annual inspection and business guidance of property management enterprises;

3) Responsible for the registration of the owner's organization;

(four) in conjunction with the relevant departments to supervise and inspect the management activities of property management enterprises;

(five) responsible for guiding the work of the owners' organizations and property management enterprises, and coordinating and handling the contradictions and problems in property management;

6) Investigate and deal with "illegal breach of contract" in property management activities according to law.

7) Responsible for coordinating and speeding up the rationalization of various relationships related to property management.

County (city) construction administrative department is the administrative department in charge of property management within its administrative area, and its specific responsibilities are determined by the people's government at the same level.

Article 4 Departments and units such as construction, planning, urban management, environmental protection, transportation, public security, prices, industry and commerce, power supply, postal services and telecommunications shall be responsible for coordinating, guiding and supervising the relevant work of residential quarters in accordance with relevant laws and regulations and these Detailed Rules.

Fifth property management industry in accordance with the relevant provisions of the state and the province to enjoy the preferential policies of the tertiary industry (residential services). County (city) people's government should support the development of property management industry, and gradually establish a professional, socialized and market-oriented property management system to improve the level of property management.

Chapter II Owner's Self-management

Sixth owners through the owners' congress or the owners' congress and the owners' committee to implement autonomous management of the property. If the number of owners in the property management area is small, the owners can decide the organizational form of property management by themselves.

The owners' meeting is composed of all owners in the property management area. If there are a large number of owners, owners' representatives may be elected to form the owners' assembly (hereinafter referred to as the owners' assembly).

Article 7 Owners shall enjoy the following rights:

1) Attend the owners' meeting and vote on major issues involving the interests of the owners;

2) The right to vote and be elected by the owners' committee;

3) Supervise the work of the owners' committee;

4) Participate in the choice of property management enterprises;

5) Enjoy services consistent with property management fees;

(six) to supervise the management service activities of property management enterprises;

7) Other rights stipulated by laws and regulations.

The Owner undertakes the following obligations:

1) Abide by the laws, regulations and rules of property management;

2) Abide by the owners' convention;

3) Abide by the relevant decisions of the owners' congress and the owners' committee;

4) Pay the property management service fee as agreed in the contract;

(five) to pay the maintenance fund in accordance with the relevant provisions of the state, province and city;

6) Other obligations stipulated by laws and regulations.

Article 8 The owners' congress shall exercise the following functions and powers:

(a) to consider, amend and adopt the owners' convention and the articles of association of the owners' committee;

(two) election and replacement of members of the owners' committee;

3) Review the work report of the owners' committee;

(four) to supervise the work of the owners' committee and change or cancel the inappropriate decisions of the owners' committee;

(five) to examine and approve the report of the owners' committee on the selection or dismissal of property management enterprises;

6) Decide on major issues concerning the interests of the owner.

Article 9 The owners' meeting shall be convened by the owners' committee at least once a year. Upon the proposal of the owners who hold more than 30% of the voting rights in the property management area, the owners' meeting may be convened temporarily, and the owners' committee shall convene the owners' meeting on the proposed topic within 15 days after receiving the proposal.

The number of owners with voting rights, one person, one vote for ordinary houses; Other properties are calculated according to the construction area of the property they own. The specific calculation rules shall be formulated separately by the Municipal Housing Authority.

Owners holding more than half of the voting rights shall attend the convening of the owners' meeting. Matters decided by the owners' meeting shall be passed by more than half of the voting rights held by the owners attending the owners' meeting.

Article 10 In the property management area, if the construction area of the property that has been delivered for use reaches 50%, or the construction area of the property that has been delivered for use reaches 30% but less than 50%, but it has been used for more than one year, the first owners' meeting shall be held in accordance with the provisions of these Detailed Rules, and the owners' committee shall be elected.

The property management department where the property is located shall guide the owners to hold the first owners' meeting.

Eleventh owners' committee is an organization that represents and safeguards the legitimate rights and interests of all owners in property management activities, and is responsible to the owners' meeting. The owners' committee shall perform the following duties:

1) Convene and preside over the owners' meeting;

(two) to draw up the draft owners' convention, the draft articles of association of the owners' committee and their amendments, and submit them to the owners' congress for adoption;

(3) With the consent of the owners' meeting, hiring or dismissing the property management enterprise, and signing, modifying or terminating the property management contract with the property management enterprise after deliberation and consent of the owners' meeting;

4) With the approval of the owners' meeting, be responsible for the management and use of the maintenance fund, and continue to raise funds when the maintenance fund is insufficient;

(five) to examine and approve the annual property management work plan and major measures proposed by the property management enterprise;

6) Listen to the opinions and suggestions of owners and users, and supervise the management service activities of property management enterprises;

(seven) the implementation of the relevant decisions of the owners' congress;

8) Accept the supervision of the owners, the owners' congress and the property management administrative department;

9) Urge the owners and users to abide by the owners' convention and relevant regulations;

10) Other duties entrusted by the owners' meeting.

Article 12 The owners' committee shall be elected by the owners' congress. The number of members of the owners' committee shall be an odd number of five to fifteen, and its members shall not hold part-time jobs in property management enterprises. Members of the owners' committee are elected for a term of three years and may be re-elected.

The owners' committee may elect a director and several deputy directors. The meeting of the owners' committee shall be convened by the director or the deputy director entrusted by the director. The meeting must be attended by more than half of the members, and the decision must be agreed by more than half of all members of the owners' Committee.

The owners' committee shall not engage in business activities.

Thirteenth owners' committee elected by the first owners' meeting shall, within thirty days from the date of election, register and confirm with the local property management administrative department. The date of registration confirmation is the date of establishment of the owners' committee.

Where the relevant matters registered by the owners' committee change, the registration of change shall be handled.

If the owners' committee terminates due to the loss of property within the property management area, it shall go through the cancellation of registration.

Article 14 The owners' convention is a code of conduct on the use, maintenance and management of property concluded by the owners, which is binding on all owners and users. The owners' convention and the articles of association of the owners' committee shall come into effect as of the date of consideration and adoption by the owners' congress, and shall be reported to the local property management administrative department for the record within fifteen days from the date of entry into force.

Fifteenth decisions made by the owners' congress and the owners' committee shall be published in the property management area and shall be binding on all owners and users.

Decisions made by the owners' congress and the owners' committee shall not conflict with laws, regulations and rules.

The model text of the owners' convention and the articles of association of the owners' committee shall be formulated separately by the Municipal Housing Authority.
