Do owners who buy second-hand houses now have to pay property fees first?

Legal analysis: According to the principle of relativity of contract, the property fee owed by the original owner is generated by the original owner and the property management company based on the original property service contract. The current owner and the former owner did not stipulate the undertaker of the property fee in the house transfer contract, and the house transfer does not mean the debt transfer. Therefore, the property management company has no right to ask the current owners to pay the property fees owed by the former owners. Owners in the purchase of second-hand housing, while ensuring the quality of housing, we must first find out whether the owners in Chu Yuan are in arrears. If there is any default, the seller shall be required to settle it in time, and it shall be stipulated in the transfer contract.

Legal basis: Civil Code of People's Republic of China (PRC).

Article 465 A lawfully formed contract shall be protected by law. A legally established contract is legally binding only on the parties, except as otherwise provided by law.

Article 466 If the parties have disputes over the understanding of the terms of the contract, they shall determine the meaning of the disputed terms in accordance with the provisions of the first paragraph of Article 142 of this Law.
