Second, the strange housing appraisal price is unacceptable to us.
On April 16, 2009, the demolition office suddenly announced that the house expropriation price was 3,257 yuan per square meter, which was unacceptable, because in February 2009, the average house price in Yubei District of Chongqing was about 3,500 yuan per square meter, and in March it was about 3,900 yuan per square meter, and now the average house price has exceeded 4,000 yuan per square meter. Besides, some farmhouses recently levied in the suburbs are calculated at the price of more than 3,800 square meters. Why is the housing price in our city so low, and how can we "improve" the living conditions? Is this their principle of "benefiting the people"?
We can't accept the collection price of more than 3,200 square meters, but unfortunately, the demolition office and the Yubei District Government not only failed to hold a hearing in time, but insisted that it was "appraised by the appraisal company you chose". What a good choice. More than 500 relocated households have only 32 votes. Is this election legal and valid? At present, the demolition office threatens to deduct 1000 yuan every day after May 16, which violates the principle of "equal protection of state, collective and private property" in People's Republic of China (PRC) Property Law and the valuation requirements stipulated in People's Republic of China (PRC) Urban Real Estate Management Law. After 30 years of reform and opening up, the market economy has been established. Why are we still using the mode of administrative orders in the planned economy period to solve contradictions and suppress vulnerable groups? We are not unruly, and we demand that our house be expropriated according to the average house price in Yubei District in that month (except other relevant compensation).
Three. Conflicts of interest between demolition office and Jin Zhuo appraisal company.
At 3 o'clock in the afternoon of April 29, 2009, in front of the solemn neighborhood Committee of Shuangfeng Branch Road, there was a long line of demolition office staff waiting for the relocated households to sign the contract. Suddenly several men appeared, claiming to be from Chongqing Jin Zhuo Appraisal Company. One of them shouted: Our appraisal price is 4,257 yuan/square meter. Why did you (Chongqing Demolition Office) tamper with our appraisal price? We will sue you for damaging Jin Zhuo's reputation and image. The bearer also said: after our evaluation, according to the number of households that were demolished, each household issued a price evaluation material to solicit opinions from the masses (in fact, none of the relocated households got it) and asked if the people present at that time saw it. The scene was in chaos. After a while, those people were accepted into the neighborhood Committee. On the same day, the staff of the demolition office ended in a hurry.
However, the next day (April 30th), the demolished people sent three representatives to Chongqing Jin Zhuo Appraisal Co., Ltd. hopefully to consult and evaluate the price, but they changed their minds and said that the evaluated price was 3,257 yuan/square meter.
Strange! The farce on April 29th was caused by the conflict of interest between Jin Zhuo Appraisal Company and Yubei Demolition Office. What tacit understanding was reached to compromise the two sides? This is not another fool of the masses. What is this? This is not a blatant violation of legal dignity. What is this?
Fourth, our requirements:
1. Ask the Yubei District Government to publicize the use and planning of this land, and make it clear whether it is public welfare or business.
2. Conduct a special investigation on the fraud in the demolition process of Yubei District Demolition Office, severely deal with the relevant personnel who trample on legal dignity, and give the masses a satisfactory answer.
3. Ask the Yubei District Government to announce the qualification, evaluation procedure and price composition basis of Jin Zhuo Appraisal Co., Ltd., and conduct a special investigation on the incident on April 29th to give the masses a satisfactory answer.
4. Ask the demolition office to immediately stop the illegal act of forcing the demolished to sign a contract and hold a hearing on the compensation price for demolition, so that the solution of contradictions can return to the correct path of dialogue.
Yubei District is the window of Chongqing. Today, with the implementation of the Property Law of People's Republic of China (PRC) and the Urban Real Estate Management Law of People's Republic of China (PRC), there is still such blatant contempt for the law and wanton trampling on the dignity of the law. We call on our superiors to pay urgent attention to this incident, safeguard social fairness and justice, and safeguard the legitimate rights and interests of vulnerable groups.
