Measures for the Administration of Elevator Safety in Hainan Tibetan Autonomous Prefecture

Article 1 In order to strengthen elevator safety management, prevent elevator safety accidents, and ensure personal and property safety, these Measures are formulated in accordance with the Law of the People's Republic of China on Special Equipment Safety and other laws and regulations, combined with the actual situation of this state. Article 2 These Measures shall apply to the installation, renovation, maintenance, use, maintenance, inspection and testing of elevators and related supervision and management activities within the administrative area of this State.

The elevators mentioned in these Measures include manned (cargo) elevators, escalators and moving sidewalks. The specific scope is determined according to the national special equipment catalogue and special equipment safety technical specifications. Article 3 The people's governments at or above the county level shall strengthen the leadership of elevator safety work within their respective administrative areas, establish and improve the coordination mechanism of elevator safety work, coordinate and solve major problems in elevator safety work, and improve the scientific, standardized and informational level of elevator safety work.

The township (town) people's government shall assist in elevator safety related work. Fourth people's governments at or above the county level market supervision and management department is the administrative department in charge of elevator safety supervision and management within their respective administrative areas.

The competent department of planning and construction is responsible for the quality supervision and management of civil and steel structure construction projects such as elevator machine room, shaft and pit.

The real estate administrative department is responsible for urging the property service enterprises to perform elevator safety management duties according to law.

Public security, fire protection, health and other competent departments shall cooperate with the market supervision and management departments to do a good job in emergency rescue of elevator accidents.

Safety production supervision, development and reform, education, finance, industrial informatization, tourism and other departments shall, according to their respective responsibilities, do a good job in elevator safety. Fifth people's governments at or above the county level market supervision and management departments and relevant departments should strengthen the publicity and education of elevator safety work, popularize elevator safety knowledge, and enhance public safety awareness and self-protection ability.

Elevator users, maintenance units and inspection and testing institutions shall carry out publicity and popularization of elevator safety knowledge, advocate civilized elevator ride, and guide the public to use elevators correctly.

Kindergartens and schools should incorporate elevator safety knowledge into the important content of safety education, and cultivate the habit of safe and civilized use of elevators for children and students.

The news media should carry out public welfare publicity of elevator safety laws, regulations and safety knowledge, and supervise the elevator safety work by public opinion. Sixth encourage elevator installation, renovation, repair, maintenance and use of units to participate in elevator safety liability insurance. Article 7 Any unit or individual has the right to complain and report elevator safety violations and hidden dangers of elevator accidents to the market supervision and management department and other relevant departments.

After accepting reports and complaints, the market supervision and management department shall investigate and deal with them according to law, and inform the informants or complainants of the results. Article 8 The selection and configuration of elevators, as well as the engineering design of elevator shaft, pit, machine room, embedded guide rail bracket and standby power supply, shall conform to the relevant national and provincial regulations and standards, meet the requirements of building structure and use, and meet the requirements of first aid, fire fighting, communication and accessibility.

Escalators and moving sidewalks used in public transportation places such as stations, airports and crosswalks. It should be a public transport elevator that meets the requirements of relevant standards.

If the elevator design of the construction engineering design unit does not meet the relevant national and provincial regulations and standards, the construction drawing review institution shall not issue a qualified document for construction drawing review. Ninth before the elevator shaft construction, the construction unit shall organize the design, construction, supervision, elevator installation and other units to conduct a joint review. Do not meet the requirements of laws, regulations and standards, should be immediately rectified; Without rectification or rectification does not meet the requirements of elevator installation, the elevator shall not be installed. Article 10 The installation and use of passenger elevators shall be equipped with monitoring devices with the functions of operation parameter collection and network remote transmission.

Elevator users in public gathering places and residential quarters shall provide video monitoring facilities for elevators and ensure their normal use.

Elevator users and maintenance units shall not destroy, dismantle or interrupt the intelligent remote monitoring device of the elevator without authorization. Eleventh elevator installation, renovation, major repair process, should be carried out by the elevator inspection agencies in accordance with the requirements of safety technical specifications for supervision and inspection.

If the original manufacturing unit of the elevator has been cancelled, no longer has the corresponding license qualification or cannot provide installation, modification and maintenance, the owner or user of the elevator may entrust the unit that has obtained the corresponding license according to law to install, modify and maintain the elevator.

Elevator installation, renovation and maintenance units shall replace the product logo of the elevator within 30 days after the completion of the elevator renovation, indicating the date of renovation, the name of the renovation unit, the qualification license number and other information.

Elevator renovation and maintenance units shall be responsible for the safety performance of elevator renovation and maintenance. Twelfth elevator installation, renovation and maintenance is completed, the construction unit shall pass the relevant technical data and documents to the elevator owner or elevator user after inspection.

Elevator users shall establish elevator safety technical files. Thirteenth elevator users are responsible for the safety of elevator use and should be responsible for the safety of elevator use.

Elevator use units are determined in the following ways:

(a) the newly installed elevator has not been handed over to the owner, and the project construction unit is the elevator user;

(2) If the management is entrusted to a realty service enterprise or other unit, it shall be made clear in the entrustment contract or agreement that the entrusted realty service enterprise or other unit is the elevator user;

(three) the management of the property service enterprise or other units is not entrusted, and the owner of the elevator is the elevator user;

(4) When leasing a place equipped with elevators, the unit responsible for the use and management of elevators shall be stipulated in the lease contract; If there is no agreement or the agreement is unclear, the lessor shall be the elevator user.

The elevator that does not specify the elevator use unit shall not be put into use.
