Regulations of Beijing Municipality on Fire Control

Chapter I General Principles

Article 1 In order to prevent fires, reduce fire hazards, strengthen emergency rescue work, protect personal and property safety, and maintain public safety, these Regulations are formulated in accordance with the Fire Protection Law of People's Republic of China (PRC) and relevant laws and administrative regulations, combined with the actual situation of this Municipality.

Article 2 Organs, organizations, enterprises, institutions and individuals within the administrative area of this Municipality shall abide by these Regulations.

Unless otherwise provided by the state, the fire control work of forests, military facilities, railways, civil aviation and underground parts of mines shall be governed by its provisions.

Article 3 Fire control work shall follow the principle of giving priority to prevention and combining prevention with elimination, implement the responsibility system for fire control safety, and establish and improve a socialized fire control network in accordance with the principles of unified leadership of the government, supervision by departments according to law, overall responsibility of units and active participation of citizens.

Article 4 The municipal, district and county people's governments shall lead the fire control work within their respective administrative areas, formulate special plans for the development of fire control undertakings and incorporate them into the plans for national economic and social development, determine the fire control safety responsibilities of the relevant departments of the people's governments at the corresponding levels and the people's governments at lower levels, incorporate the funds for fire control undertakings into the fiscal budget, and gradually increase with the economic and social development.

Fifth city, district and county public security organs shall supervise and manage the fire control work within their respective administrative areas, and the fire control institutions of public security organs at the same level shall be responsible for the implementation.

The public security police station shall, in accordance with the provisions of the state and this Municipality, carry out daily fire supervision and inspection, deal with illegal acts of fire safety according to law, and guide the units, residents' committees and villagers' committees within their jurisdiction to implement fire safety measures.

Fire control institutions of public security organs and public security police stations shall, under the leadership of the people's government and public security organs, define the scope of responsibilities, cooperate with each other, and do a good job in fire control supervision.

Sixth organs, organizations, enterprises, institutions and other units shall perform the duties of fire safety as stipulated by laws and regulations, and be responsible for the fire safety of their own units.

Individual industrial and commercial households with fixed business premises shall abide by the provisions of the People's Republic of China (PRC) Fire Protection Law and these Regulations on the fire safety responsibility of units.

Article 7 Fire protection associations and other relevant trade associations shall establish and improve the self-discipline mechanism and management system of fire safety in the industry, formulate industry norms, publicize fire protection laws and regulations and professional knowledge, train relevant employees, and guide the fire protection work of fire protection technical service institutions and relevant units.

Article 8 This Municipality encourages relevant enterprises, institutions and scientific research institutions to carry out research and innovation in fire fighting science and technology, and encourages fire fighting organizations to use advanced scientific and technological achievements to improve their fire fighting and rescue capabilities.

Chapter II Fire Safety Responsibility

Article 9 The municipal, district and county people's governments shall perform the following fire safety duties:

(a) to establish and improve the system of joint meetings of fire safety committees and fire control work, and to study, coordinate and solve major problems in fire control work;

(two) to ensure the investment in the construction of public fire control facilities and fire control business;

(three) to formulate and organize the implementation of the annual and key fire control work plan;

(four) to organize relevant government departments to carry out fire safety inspection;

(five) the assessment and appraisal of the people's government at the next lower level to complete the annual fire safety responsibility target;

(six) supervision and inspection of the relevant departments of the people's government at the same level to perform their duties of fire safety;

(seven) other fire safety duties that should be performed according to law.

The fire safety committees of the municipal, district and county people's governments shall organize, guide and supervise the relevant departments of the people's governments at the corresponding levels and the people's governments at lower levels to perform fire control duties, coordinate the construction of fire control infrastructure, fire control organizations and other major issues, and urge the rectification of major fire hazards.

Education, civil affairs, housing and urban and rural construction, municipal appearance, transportation, agriculture, water affairs, commerce, culture, health, cultural relics, civil defense, tourism and other administrative departments shall be responsible for the relevant work of fire control management according to their respective responsibilities.

Township people's governments and sub-district offices shall be fully responsible for the fire safety work in their respective areas according to the provisions of laws, regulations and rules and the deployment of the people's governments at higher levels; Establish a leadership mechanism for fire safety management, supervise the fire supervision and management of government departments within their respective jurisdictions, and guide units, residents' committees and villagers' committees within their respective jurisdictions to perform their respective fire safety duties.

Tenth fire control institutions of public security organs shall perform the following fire safety duties:

(a) to carry out publicity of fire laws and regulations, and to guide units to carry out fire drills as needed;

(two) according to the implementation of the construction project fire design audit, fire acceptance, filing and spot checks, as well as public gathering places put into use, fire safety inspection before business;

(three) to formulate fire fighting plans and conduct on-the-spot drills, implement fire fighting and related emergency rescue, and investigate fire accidents according to law;

Article 11 Residents' committees and villagers' committees shall determine fire safety administrators, organize residents and villagers to formulate fire safety conventions, carry out fire prevention publicity and education, set up volunteer fire brigades as needed, and establish a fire safety joint defense system.

Twelfth units shall perform the following fire safety duties:

(a) the implementation of fire safety responsibility system, formulate the fire safety system and fire safety operating rules of the unit, formulate fire fighting and emergency evacuation plans and organize drills;

(two) in accordance with national standards and industry standards, the allocation of fire facilities and equipment, set up fire safety signs, and organize regular inspection and maintenance to ensure that it is in good condition and effective;

(three) in accordance with the inspection specifications, at least once a year to conduct a comprehensive inspection of building fire protection facilities to ensure that they are in good condition and effective. (seven) in accordance with the technical standards and regulations of fire control, electrical equipment, gas appliances and their lines and pipelines are tested, maintained and managed;

(eight) set up a fire control room in accordance with national standards, and the personnel on duty in the fire control room shall abide by the operating rules of the state and this Municipality, and shall not leave their posts without permission;

(nine) other fire safety duties as prescribed by laws and regulations.

The main person in charge of the unit is the person in charge of fire safety of the unit, and is fully responsible for the fire safety work of the unit.

Thirteenth key units of fire safety shall not only comply with the provisions of Article 12 of these regulations, but also perform the following fire safety duties:

(a) to determine the fire safety administrator and organize the implementation of the fire safety management of the unit;

(two) the establishment of fire files, determine the key parts of fire safety, set fire signs, and implement strict management;

(three) the implementation of daily fire inspection, and establish inspection records;

(four) to conduct pre-job fire safety training for employees, organize fire safety training at least once a year, and organize targeted fire drills at least once every six months;

Fourteenth individuals shall perform the following fire safety obligations:
