Measures for the Administration of Municipal Fire Hydrants in Zibo (revised on 20 19)

Article 1 In order to strengthen the management of municipal fire hydrants, improve the ability to resist fire and maintain public safety, these measures are formulated in accordance with the Fire Protection Law of People's Republic of China (PRC) and the Regulations of Shandong Province on Fire Protection, and combined with the actual situation of this Municipality. Article 2 These Measures shall apply to the planning, construction, maintenance, use, supervision and management of municipal fire hydrants within the administrative area of this Municipality. Article 3 The term "municipal fire hydrant" as mentioned in these Measures refers to the fire-fighting water supply device and its auxiliary equipment which are connected with the water supply pipe network and consist of valves, water outlets and shells and are specially used for fire prevention and fire fighting and rescue. Article 4 The municipal, district and county people's governments shall strengthen the organization and leadership over the construction and management of municipal fire hydrants, clarify the management responsibilities, coordinate and solve major problems in the construction and management of municipal fire hydrants, and incorporate the construction and maintenance costs of municipal fire hydrants into the fiscal budget at the corresponding level. Fifth municipal fire hydrants should be synchronized with public infrastructure planning, design, construction and acceptance.

City, district and county people's governments shall organize the preparation of special plans for urban fire protection, including the layout of municipal fire hydrants, water consumption, water pressure and other specific contents.

The design, construction, installation and maintenance of municipal fire hydrants and their water supply pipelines shall meet the requirements of relevant national technical standards and norms. Article 6 The development and reform department shall incorporate the investment in municipal fire hydrant construction into the government investment project plan, and strictly examine the contents of municipal fire hydrant construction in the project feasibility study report or project application report when going through the formalities of project approval, approval and filing.

Housing and urban-rural construction departments shall list the construction of municipal fire hydrants as supporting contents of municipal road projects, incorporate them into the project investment budget, and design, install and accept them synchronously with municipal road projects.

The water administrative department shall organize water supply enterprises to implement the construction and maintenance of municipal fire hydrants. If the setting of municipal fire hydrants on the built roads does not meet the relevant technical standards, it shall be responsible for organizing the implementation of supplementary construction, and jointly check and accept with the fire rescue institutions.

Where a fire rescue agency finds it necessary to build or maintain a municipal fire hydrant, it shall promptly put forward opinions and work plans, and report in writing to the people's government at the same level for research and decision. Seventh municipal fire hydrant construction funds should be included in the total investment of municipal roads. Municipal fire hydrant construction and maintenance funds, by the water administrative department at the county level every year to the financial department at the same level proposed budget, included in the financial budget at the same level, after the audit of the financial department allocated to the water administrative department, earmarking. Article 8 Water supply enterprises shall, in accordance with the requirements of relevant technical standards and norms, lay water supply pipelines, build municipal fire hydrants, and maintain and manage municipal fire hydrants in accordance with the following provisions:

(a) once every six months to check and maintain the municipal fire hydrant within the jurisdiction, to ensure that it is in good condition and effective;

(two) after receiving the notice of the municipal fire hydrant damage repair telephone or relevant departments, it shall immediately organize the repair and maintenance, and timely feedback the repair situation;

(3) Establish archives of municipal fire hydrants, truthfully record the location, quantity, number, specification, distribution, inspection and maintenance of municipal fire hydrants, and submit the archives to local fire rescue agencies once every six months;

(four) other duties that should be performed according to law. Article 9 The water administrative department of the county people's government shall organize the construction of municipal fire hydrants in towns and villages with centralized water supply networks.

In towns where there are no municipal fire hydrants or the water supply for fire fighting and rescue is insufficient, the Town People's Government shall set fire truck water intake facilities or equipped with motorized fire pumps in rivers, lakes, reservoirs, ponds, pools, wells and other water sources where the local water quality and quantity are guaranteed, and report the location and quantity to the local fire rescue agencies.

Villagers' committees and residents' committees shall assist in the construction of water intake facilities for municipal fire hydrants and fire engines. Article 10 Municipal fire hydrants shall be used for fire prevention or fire fighting and rescue, and no unit or individual may commit any of the following acts:

(a) damage, misappropriation and unauthorized opening of municipal fire hydrant water;

(two) burying, occupying and shielding municipal fire hydrants;

(3) stacking articles, setting up stalls, parking vehicles, and building buildings (structures) that affect the use of municipal fire hydrants within 5 meters;

(four) other acts that hinder the use of municipal fire hydrants.

If it is really necessary to dismantle or relocate the municipal fire hydrant due to municipal construction, it shall be approved by the local fire rescue agency; If it is necessary to cut off the water supply pipe network due to failure or maintenance, it shall inform the local fire rescue agency in advance. Article 11 The municipal, district and county people's governments shall sign annual fire safety responsibility letters with the people's governments at lower levels and the relevant departments of the people's governments at the corresponding levels, and clarify the objectives, tasks, assessment, rewards and punishments of municipal fire hydrant management.

The municipal, district and county people's governments shall regularly supervise and assess the construction and management of municipal fire hydrants of the relevant departments of the people's governments at the corresponding levels and the people's governments at lower levels.

The people's governments at lower levels shall report to the people's governments at higher levels the annual municipal fire hydrant construction management within their respective administrative areas. If the people's government at a lower level fails to complete the task of building and maintaining municipal fire hydrants, the people's government at a higher level shall list it as a major safety hazard and supervise it. Article 12 People's governments at all levels and relevant departments, in violation of the provisions of these measures, shall be ordered by the people's government at a higher level, the competent department at a higher level or the supervisory organ to make corrections within a time limit, informed criticism, and the directly responsible person in charge and other directly responsible personnel shall be punished according to law:

(a) the setting of municipal fire hydrants can not meet the relevant standards or planning requirements, and the rectification plan has not been formulated or implemented;

(two) did not complete the annual municipal fire hydrant construction and maintenance tasks;

(three) the new construction, renovation and expansion of municipal roads are not in accordance with the provisions of the construction of municipal fire hydrants;

(four) do not perform the duties of municipal fire hydrant management;

(five) refusing or delaying the construction and management of municipal fire hydrants coordinated by the government;

(6) Failing to build water intake facilities for fire engines or not equipped with motorized fire pumps;

(seven) other circumstances in violation of the provisions of these measures.

For those who fail to perform the management duties of municipal fire hydrants, resulting in ineffective fire fighting and rescue, resulting in more than a large fire accident, the administrative responsibility of the relevant responsible personnel shall be investigated according to law; If a crime is constituted, criminal responsibility shall be investigated according to law.
