Article 6 Before the house is pre-sold (sold), the construction unit shall entrust the property service evaluation and supervision institution to evaluate the property service fee according to the property service items and standards, and provide relevant information such as the project type, construction area, facilities and equipment used, promised service items and standards. When the owners' congress selects and replaces the realty service enterprise for the first time, it may entrust the realty service evaluation and supervision institution to evaluate the realty service cost. When there is a dispute between the owners, the realty service enterprises and other interested parties over the realty service fee, they may entrust the realty service evaluation and supervision institution to evaluate it. Article 7 When the construction unit hands over the property project to all the owners, it may entrust the property service evaluation and supervision institution to carry out the handover acceptance. Property service evaluation and supervision institutions shall, in accordance with the provisions, examine the buildings, structures, supporting facilities and equipment, related sites, drawings and materials of property projects, and operation and maintenance records of facilities and equipment in the property management area except the proprietary parts of the owners, and issue inspection reports. If all owners hire new realty service enterprises, other managers or manage themselves, they may entrust the realty service evaluation and supervision institution to organize inspection. Article 8 The owners, owners' congress or other relevant departments may entrust the property service evaluation and supervision institution to evaluate the property service quality according to relevant laws, regulations, service standards, industry standards, property service contracts and other factors. The rights and interests of all parties to the property service may entrust a third-party evaluation and supervision institution to track and evaluate the property service within the agreed time. Article 9 The property service appraisal and supervision business shall be entrusted by the property service appraisal and supervision institution, and no individual may undertake the appraisal and supervision business. Property service evaluation and supervision institutions and personnel engaged in evaluation and supervision business have an interest in the client or evaluation and supervision matters, which may affect the fair evaluation, and should be avoided. Tenth construction units, property service enterprises and relevant parties shall assist the property service evaluation and supervision institutions to conduct on-site investigation, truthfully provide the necessary information to the evaluation and supervision institutions, and be responsible for the authenticity of the information provided. Article 11 [Evaluation and Supervision Report] The property service evaluation and supervision institution shall engage in evaluation and supervision activities in accordance with the requirements of relevant laws, regulations, rules and technical specifications, and issue an evaluation and supervision report with reference to the model text formulated by the municipal housing administrative department. Evaluation of supervision report should include the purpose, basis and method of evaluation of supervision, the date and benchmark date of evaluation of supervision, the survey data of evaluation of supervision, the results and effective period of evaluation of supervision, and the signatures of evaluation supervisors. Article 12 [Result Application] The construction unit shall publicize the preliminary property service cost calculation report issued by the property service evaluation and supervision institution in the house sales place, and incorporate the service cost calculated by the property service evaluation and supervision institution into the house sales contract. Property service handover inspection report and property service quality assessment report shall be publicized in the property management area. Thirteenth [assessment supervision fee] property service assessment supervision in accordance with the principle of "whoever entrusts pays", the client and the property service assessment and supervision institutions negotiate to determine the amount of fees. Chapter III Appraisal and Supervision Institutions and Personnel of Property Services Article 14 An appraisal and supervision institution of property services shall meet the following conditions: (1) It has the qualification of an independent legal person and specializes in appraisal and supervision of property services; (2) The registered capital is more than 6,543,800 yuan; (3) Having a fixed office space and facilities, equipment and office conditions required for conducting evaluation and supervision business; (4) There shall be no less than 10 full-time management and technical personnel with engineering, management, economy and other related majors; (five) other conditions stipulated by laws, regulations and rules. Property service evaluation and supervision institutions that meet the above conditions shall go to the municipal housing administrative department for the record, and the municipal housing administrative department shall regularly publish the list of filing institutions. Fifteenth [experts] the municipal housing administrative department shall establish an expert database for the evaluation and supervision of property services, and regularly publish the list of experts. Property service evaluation and supervision institutions engaged in evaluation and supervision business, should choose experts from the expert database. Property service evaluation and supervision experts issue evaluation opinions and are responsible for the evaluation and supervision institutions; The evaluation supervision institution shall issue an evaluation supervision report and be responsible to the client. Article 16 [Entrusting] Where both parties entrust an evaluation and supervision institution to conduct handover inspection, the entrusting party may select experts from the expert database or industry experts from outside the expert database. If the client chooses an expert outside the expert database, it shall provide the resume and specific contact information of the industry expert to the municipal housing administrative department. After confirmation by the municipal housing administrative department, the project can be handed over for acceptance. Article 17 A realty service appraisal supervision institution shall engage in appraisal supervision business in accordance with the relevant provisions of this Municipality, and shall not issue appraisal supervision reports with tendentiousness, false contents, misleading statements or major omissions. Article 18 A property service evaluation supervisor shall not commit any of the following acts in the property service evaluation and supervision activities: (1) issue an evaluation and supervision report in his own name; (2) accepting remuneration or other property other than the entrustment contract and seeking other illegitimate interests; (3) colluding with the client to harm the interests of the other party; (four) allow others to engage in property service evaluation and supervision business in their own name; (5) Signing an evaluation and supervision report with false records, misleading statements or major omissions; (six) other acts prohibited by laws, regulations and rules.

Twenty-first [legal liability of the construction unit and the realty service enterprise] if the construction unit or the realty service enterprise violates the provisions of Article 10 of these measures, the housing administrative department shall order it to make corrections within a time limit and record it in the enterprise credit file; If losses are caused, it shall be liable for compensation according to law.
